HomeMy WebLinkAboutReso 2018-046 - Exception to the 180 Day Wait Period RESOLUTION NO. 2018-046 May 15, 2018 RESOLUTION FOR EXCEPTION TO THE 180-DAY WAIT PERIOD GC sections 7522.56 & 21224 WHEREAS, in compliance with Government Code section 7522.56 the Redding City Council must provide Ca1PERS this certification resolution when hiring a retiree before 180 days has passed since his or her retirement date; and WHEREAS, David Braithwaite, CID 7925955203, retired from the City of Redding in the position of Project Coordinator, effective March 23, 2018; and WHEREAS, section 7522.56 requires that post-retirement employment commence no earlier than 180 days after the retirement date, which is September 19, 2018, without this certification resolution; and WHEREAS, section 7522.56 provides that this exception to the 180-day wait period shall not apply if the retiree accepts any retirement-related incentive; and WHEREAS, the Redding City Council, the City of Redding and David Braithwaite certify that David Braithwaite has not and will not receive a Golden Handshake or any other retirement-related incentive; and WHEREAS, the Redding City Council hereby appoints David Braithwaite as an extra help retired annuitant to perform certain duties of the Project Coordinator for the City of Redding under Government Code section 21224, effective May 16, 2018; and WHEREAS, the entire employment agreement, contract or appointment document between David Braithwaite and the City of Redding has been reviewed by this body and is attached herein; and WHEREAS, no matters, issues, terms or conditions related to this employment, and appointment, have been or will be placed on a consent calendar; and WHEREAS, the employment shall be limited to 960 hours per fiscal year; and WHEREAS, the compensation paid to retirees cannot be less than the minimum nor exceed the maximum monthly base salary paid to other employees performing comparable duties, divided by 173.333 to equal the hourly rate; and WHEREAS, the maximum base salary for this position is $9,201 and the hourly equivalent is $53.08, and the minimum base salary for this position is $6,539 and the hourly equivalent is $37.73; and WHEREAS, the hourly rate paid to David Braithwaite will be $53.08; and WHEREAS, David Braithwaite has not and will not receive any other benefit, incentive, compensation in lieu of benefit or other form of compensation in addition to this hourly pay rate; NOW, THEREFORE, BE IT RESOLVED THAT the Redding City Council hereby certifies the nature of the appointment of David Braithwaite as described herein and detailed in the attached employment agreement/contract/appointment document and that this appointment is necessary to fill a critically needed role of Project Coordinator for the City of Redding only to assist with special project work for the Public Works Department. Mr. Braithwaite will be working on the special project of providing staff level analysis and assistance regarding the modeling and development of plan reviews for the Water, Wastewater, and Storm Drain Utilities. The City has very intricate computer models for the utilities' infrastructure. These models were developed by Mr. Braithwaite and he has the unique knowledge and skills to run this program. Mr. Braithwaite is also responsible for review of all hydraulic studies and performs hydraulic analysis, including floodplain issues on development projects for Development Services- Planning. With 17 years of experience in engineering, Mr. Braithwaite has a unique understanding of the models necessary to coordinate flushing with Water Distribution staff, design requirements for capital improvement projects, fire flow requests by developers, development reviews, and sanitary sewer flow inquiries. Permanent staff within the department will continue to perform essential duties, while having Mr. Braithwaite available on an as needed basis for a maximum of 450 hours or until December 30, 2018, whichever occurs first. Although Mr. Braithwaite will be assigned the title of Project Coordinator, he will not be assuming all of the roles and responsibilities of that position. EXPLANATION OF ACTION David is a Retired Annuitant being re-hired as approved by City Council on 5/15/2018. In compliance with Government Code Section 7522.56 and the California Public Employees' Retirement System (CaIPERS), Mr. Braithwaite is being rehired as an extra-help Retired Annuitant to work on the special project of using intricate computer models for the utilities infrastructure to coordinate flushing with Water Distribution staff, design requirements for capital improvement projects, fire flow requests by developers, development reviews, and sanitary sewer flow inquiries. In addition, Mr. Braithwaite reviews all hydraulic studies and performs hydraulic analysis, including floodplain issues on development projects. D.
