Also present were: City Manager Barry Tippin, City Attorney Barry E. DeWalt, Acting Assistant City Manager/Public Works Director Brian Crane,Deputy City Manager Greg Clark, City Clerk Pamela Mize, Assistant City Clerk Sarah Sheetz, and Executive Assistant Sharlene Tipton. The City Manager introduced Department Directors that were in attendance: Personnel Director Sheri DeMaagd, Finance Director Dennice Maxwell, Police Chief Roger Moore, Community Services Director Kimberly Niemer, Information Technology Director Tony Van Boekel, and City Treasurer Allyn Feci Van Hooser. The Pledge of Allegiance to the Flag was led by Mayor Weaver. The Invocation was provided by Pastor Aaron Hayes, The Stirring Church PRESENTATIONS 2A. Presentation by Sean Dugan, MD, regarding the Children's Legacy Center. [A-050-060] Shasta Community Health Center Pediatrician Sean Dugan, MD, provided a PowerPoint presentation, incorporated herein by reference. He shared the mission of the Children's Legacy Center and expressed that the current goal is to raise $70,000 to move forward with the Center. He noted that more information is available at info(&childrenslegacy.org. 2B. Mayor's Proclamation declaring October 2017 as Domestic Violence Awareness Month in the City of Redding_ [A-050-060-600] Mayor Weaver presented a Mayor's Proclamation to Chris Haedrich, President of the OneSafe Place Board of Directors, declaring October 2017 as Domestic Violence Awareness Month in the City of Redding. Mr. Haedrich provided an invitation to the Council and staff regarding the upcoming event entitled "UNDAUNTED -An evening with author and survivor Matthew Sandusky", incorporated herein by reference. CONSENT CALENDAR The following matters were considered inclusively under the Consent Calendar and each Report to Redding City Council (staff report) is incorporated herein by reference: 4(a). Approve Minutes — Special Meeting of July 27, 2017; Regular Meeting of August 15, 2017; and Regular Meeting of October 3, 2017. [A-050-060] 4(b). Approve Payroll and Accounts Payable Registers. [A-050-100-500] Approve: (1) Accounts Payable Register No. 7 for the period of September 30, 2017, through October 13, 2017, for a total of $4,371,902.86 for check numbers 129513 through 129841, inclusive, ACH Transfer numbers 13835 through 13869, inclusive, and Wire Transfer numbers 7096 through 7131, inclusive; and(2)Payroll Register No. 8 for the period of September 24, 2017, through October 7, 2017, in the amount of $3,027,990.40, for electronic deposit transaction numbers 448528 through 449423, inclusive, and check numbers 603575 through 603594, inclusive; SUMMARY TOTAL: $7,399,893.26 10/17/2017 297 4(c). Adopt Ordinance No. 2576, an ordinance of the City Council of the City of Redding, amending Redding Municipal Code Title 1 (General Provisions), Chapter 1.15 (Abatement of Properties, Buildings and Conditions) by amending Section 1.15.50 (Public Nuisances Specified); amending Title 2 (Administration and Personnel), Chapter 2.57 (Administrative Hearings Board), by amending Section 2.57.060 (Jurisdiction); amending Title 16 (Buildings and Construction), Chapter 16.01 (Building Official Permits), by amending Section 16.01.020 (Board of Appeals); amending Title 16 (Buildings and Construction), Chapter 16.09 (Housing Code) by amending Section 16.09.010 (Uniform Housing Code Adopted); and amending Title 17 (Subdivisions), Chapter 17.34 (Residential Condominium Conversions), by amending Section 17.34.050 (Standards for Condominium Conversion Projects); all111 relating to the maintenance and inspection of real property and the adoption of the International Property Maintenance Code. Set a Public Hearing for the regularly scheduled meeting of the City Council on November 7, 2017, to consider a revenue-neutral simplification of the Large Commercial electric rate structure effective with the January 2018 billing cycle. [E-090-100] Jake Mangas, President and Chief Executive Officer of the Chamber of Commerce, spoke in support of the City's proactive and transparent approach. 4.5(b). Accept the Redding Electric Utility Monthly Financial Report for August 2017 and the Industry Activities Update. [B-130-070] 4.10(a).Accept the General Fund Monthly Financial Report for August 2017. [B-130-070] 4.11(a).Authorize the following action relative to Bid Schedule No. 4916, Street Striping and Pavement Marking Services: (1) award Bid to Apply-A-Line, for an amount not to exceed $250,000 per year for the initial year term; and (2) authorize the City Manager or his designee to extend the contract annually for a maximum of two additional years if agreeable by both parties with all prices, terms, and conditions remaining the same. [B-050-100\S-070-200] 4.11(b).Authorize the following action relative to the State of California Public Utilities Commission Federal Section 130 grant for Shasta Street Railroad Crossing Improvements Project: (1) accept the Federal Section 130 grant; (2) authorize the Mayor to execute the Caltrans Contract No. 75LX312 (C-7416) with the CPUC; and (3) adopt Resolution No. 2017-091, a resolution of the City Council of the City of Redding approving and adopting the 11th Amendment to City Budget Resolution No. 2017-057 to appropriate $417,560 in grant funding for said project. [G-100-170/B-030-070/T-100-300] 4.11(c).Accept Bid Schedule No. 4893 (Job No. 2489-63), Sidewalk Leveling Project 2017, awarded to Trip Stop Sidewalk Repair, Inc., as satisfactorily complete. [B-050-020/S-070-285] 4.11(d).Adopt Resolution No. 2017-092, a resolution of the City Council of the City of Redding authorizing: (1) submittal of a loan application in an amount of$190,000 to the State of California Department of Transportation, Division of Aeronautics for the design,engineering,and construction of roofing and exterior improvements to the CHP leased Hangar at Benton Airpark; and (2) the City Manager, or designee, to execute the loan application and any subsequent documents to obtain and manage the loan; and (3)certifying the City's ability to repay the loan. [B-050-020/S-050-100/A-090-020] 10/17/2017 298 4.11(e).Approve the following actions: (1) authorize the Public Works Director to submit an Application for a Transportation Investment Generating Economic Recovery Discretionary Grant for the South Bonnyview Road/Interstate 5 Interchange Project; and (2) authorize the Public Works Director to sign a letter of support for the Interstate 5 Redding to Anderson Six-Lane Project. [G-100-070/S-070-100-707] 4.11(f).Authorize staff to begin project development activities for the Victor/Churn Creek/Rancho Roundabout Project, to include preliminary engineering, environmental compliance work,utility impacts,permitting requirements and improved cost estimates for construction. [B-130-070/S-070] Kevin Nagy requested that utility lines be placed underground during this process. A MOTION WAS MADE by Council Member McElvain, seconded by Council Member Schreder, that the foregoing items on the Consent Calendar be accepted, acknowledged, adopted, approved, and/or authorized as recommended. REGULAR CALENDAR: REPORTS & COMMUNICATIONS OF DEPARTMENTS, BOARDS, COMMISSIONS AND COMMITTEES 9.1(b). Purchase and Sale Agreement with The McConnell Foundation for the former Police 111 Facility. [C-070-200/C-050-550] Mayor Weaver recused himself and left the room due to property ownership within • close proximity to the subject property. City Manager Tippin highlighted the Report to Redding City Council (staff report), incorporated herein by reference. On behalf of The McConnell Foundation, Rachel Hatch and John Mancasola spoke regarding the vision for the future use of the property. The PowerPoint presentation and photos are incorporated herein by reference. Jake Mangas (Chamber of Commerce), and John Truitt (Viva Downtown), spoke in support of the Sale Agreement. A MOTION WAS MADE by Council Member Sullivan, seconded by Council Member Winter, to: (1) approve a Purchase and Sale Agreement with The McConnell Foundation for the sale of property owned by the City of Redding,known as the former Police Facility located at 1313 and 1371 California Street; (2) adopt a Notice of Exemption under the California Environmental Quality Act; (3) authorize the Mayor to execute the Agreement; and (4) directed that the proceeds of the sale be placed in a contingency reserve fund to be used to offset budget deficit or as payment on the debt for the new police station. Annual Report by Shasta Cascade Wonderland Association (SCWA) on Tourism Activity. [B-130-030-700/E-050] Deputy City Manager Clark summarized the Report to Redding City Council (staff report), incorporated herein by reference. SCWA General Manager Laurie Baker provided a PowerPoint presentation, and two magazines,Fall 2017 Via and the All Star Game 2016 Major League Baseball Official Program, all incorporated herein by reference, related to the past, present, and future marketing activities of the Redding Convention and Visitors Bureau under a Service Agreement (C-5348)with the City. By consensus, the City Council accepted the Annual Report from the Shasta Cascade Wonderland Association. 9.10(b).OpenGov Presentation and Approval to Report Financial Information on a Quarterly Basis [B-130-070] Finance Director Maxwell highlighted the Report to Redding City Council (staff report), incorporated herein by reference. Greg Robinett, Senior Accountant, provided a presentation demonstrating how to navigate the OpenGov Transparency Portal on the City of Redding's website. A MOTION WAS MADE by Council Member Schreder, seconded by Council Member Sullivan, to: (1) accept the report; and (2) approve presentation of General Fund and Electric Utility Fund financial information from monthly to quarterly. The Vote: Unanimous Ayes. 9.14(a).Cannabis Commercial Activity [M-020] City Attorney DeWalt summarized the Report to Redding City Council (staff report), incorporated herein by reference. Mr. DeWalt provided background information relative to Proposition 64 (the "Adult Use of Marijuana Act" or"AVMA")that was approved by the electorate November 9, 2016. He mentioned that three public workshops were held regarding Cultivation; Retail Sale; and Manufacture of Cannabis Products and Laboratory Testing. He noted that the workshops served the dual purpose of educating the public and soliciting public input on the subject matter. The following spoke in support of allowing the commercial sale of cannabis: Patrick Carpenter, Mimi Moseley, Rob McDonald, Peter Rogers, Annie Brassfield, Stephen Hazel, Shasta Heart, Bill Gilbert, Blue Mobley, Jerrod Vassar, Terry Mines, Patrick Gorman, Robyn Carpenter, Eric Karamian, Johne Clark, and James Crockett. The following spoke in opposition to the commercial sale of cannabis: Cathy Grindstaff, and Betty Cunningham. Ms. Cunningham provided the Council and staff with a handout entitled "The Legalization of Marijuana in Colorado: The Impact Volume 5 October 2017, prepared by the Rocky Mountain High Intensity Drug Trafficking Area (www.rmhidta.org)", incorporated herein by reference. The City Attorney presented the "Decision Tree", incorporated herein by reference, and the Council Members provided input on the individual line items. The City Council directed the City Attorney to return to Council to seek an extension of the current Interim Urgency Ordinance and begin drafting ordinances to address the Adult Use of Marijuana Act based on the Council's responses to the "Decision Tree" provided in the staff report. PUBLIC COMMENT - for non-agendized matters within the city's jurisdiction. [E-050-500] Joseph James promoted the creation of a Small Business Association Hubzone for the Stillwater Business Park. 10/17/2017 300 [P-150-150] Stephen Hazel stated he was recently assaulted and provided a handout to the Council, incorporated herein by reference. [P-150-150] Kati Rynearson relayed that law enforcement did not respond to her recent emergency call at her business. CLOSED SESSION At the hour of 10:07 p.m.,Mayor Weaver announced that the Council would adjourn to Closed Session. At the hour of 10:18 p.m., Mayor Weaver reconvened the Closed Session to Open Session and reported that in reference to: 13A.
