AN ORDINANCE OF THE CITY OF REDDING AMENDING TITLE 10
(PUBLIC PEACE, MORALS AND WELFARE), CHAPTER 10.19
(UNLAWFUL SOLICITATION) BY AMENDING SECTION 10.19.030
(ALL SOLICITATIONS PROHIBITED AT SPECIFIED LOCATIONS)
AND AMENDING TITLE 13 (STREETS AND SIDEWALKS), CHAPTER
13.24 (OBSTRUCTION OF STREETS AND SIDEWALKS) BY ADDING
SECTION 13.24.070 (INTERFERENCE WITH VEHICULAR TRAFFIC),
IN ORDER TO ABATE DANGEROUS CONDITIONS TO PEDESTRIANS
AND MOTORISTS
THE CITY COUNCIL OF THE CITY OF REDDING DOES ORDAIN AS FOLLOWS:
Section 1. Title 10 (Public Peace, Morals and Welfare), Chapter 10.19 (Unlawful
Solicitation), Section 10.19.030 (All Solicitations Prohibited at Specified Locations), is hereby
amended to read as follows:
10.19.030 -All solicitations prohibited at specified locations.
A. No person shall solicit, ask or beg within fifteen feet of any entrance or exit of any bank,
savings and loan association, credit union or check cashing business during its business
hours or within fifteen feet of any automated teller machine during the time it is available
for customers' use. However, when an automated teller machine is located within an
automated teller machine facility, such distance shall be measured from the entrance or
exit of the automated teller machine facility.
B. No person shall solicit, ask or beg within an automated teller machine facility where a
reasonable person would or should know that he or she does not have the permission to
do so from the owner or other person lawfully in possession of such facility.
C. No person shall solicit, ask or beg in any parking lot or structure at any time from one
half-hour after sunset to one-half hour before sunrise.
D. No person shall solicit, ask or beg in any public transportation vehicle.
Section 2. Title 13 (Streets and Sidewalks), Chapter 13.24 (Obstruction of Streets
and Sidewalks), Section 13.24.070 (Interference with Vehicular Traffic) is hereby added to the
Redding Municipal Code to read as follows:
13.24.070 - Interference with vehicular traffic.
A. No person shall intentionally interfere with vehicular traffic.
B. The following definitions apply in this section:
1. To "interfere with vehicular traffic" means to enter or remain upon a roadway in
order to engage in any conduct that obstructs or impedes the free flow of
vehicular traffic on any public roadway.
2. To "enter" means to cross the vertical plane of the edge of a roadway, which
includes crossing the vertical plane of the roadway by any part of a person's body
or any extension thereof or by use of any device used to extend a person's ability
to reach into the roadway.
C. The following are not considered to be interfering with vehicular traffic:
1. A public employee performing his/her duties.
2. A person summoning or requiring aid in an emergency situation.
Section 3. Severability. If any section, subsection, sentence, clause or phrase of this
ordinance is for any reason held by a court of competent jurisdiction to be invalid or
unconstitutional, such decision shall not affect the validity of the remaining portions of the
ordinance. The City Council of the City of Redding hereby declares that it would have passed
this ordinance and each section, subsection, sentence, clause and phrase thereof irrespective of
the fact that one or more sections, subsections, sentences, clauses or phrases may be held invalid
or unconstitutional.
Section 4. The passage of this ordinance is not a "project" according to the definition
in the California Environmental Quality Act, and therefore is not subject to the provisions
requiring environmental review.
Section 5. This ordinance shall take effect thirty (30) days after the date of its
adoption, and the City Clerk shall certify to the adoption thereof and cause publication according
to law.
I HEREBY CERTIFY that the foregoing ordinance was introduced and read by the City
Council of the City of Redding at a regular meeting on the 7th day of November, 2017, and was
duly read and adopted at a regular meeting on the 5th day of December, 2017, by the following
vote:
