HomeMy WebLinkAboutReso 2017-074 - Affordable Housing RESOLUTION NO. 2017-074 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING EXTENDING THE TIME PERIOD DURING WHICH THE SUCCESSOR HOUSING AGENCY MAY RETAIN PROPERTY IDENTIFIED AS ASSESSOR'S PARCEL NUMBERS 108-010-043, 104-350-019, 104-350-018, 114-060-032, 116-440-025, AND 115-170-001 FOR THE DEVELOPMENT OF HOUSING AFFORDABLE TO EXTREMELY LOW- AND LOW- INCOME HOUSEHOLDS WHEREAS, on February 1, 2012, the Redding Redevelopment Agency ("RRA") was dissolved pursuant to Health and Safety Code (HSC) Sections 34161 - 34166; and WHEREAS, pursuant to HSC §34176, by Resolution No. 2012-007, the City Council of the City of Redding elected to become the Successor Housing Agency to the RRA ("Successor Housing Agency"); and WHEREAS, HSC §34176(a)(1), provides for all rights, powers, duties, obligations, and housing assets (as defined by HSC §34176(e)) of the redevelopment agency to be transferred to the Successor Housing Agency; and WHEREAS, on February 2, 2012, such transfer did occur; and WHEREAS, HSC §34176(2) requires that the Successor Housing Agency submit to the State Department of Finance (DOF) a list of all transferred housing assets for DOF review and approval; and WHEREAS, on July 31, 2012, a Housing Assets Transfer Form was submitted to DOF for its review and approval; and WHEREAS, on August 30, 2012, DOF issued its written approval of the transfer of all assets as listed on the Housing Asset Transfer Form to the Successor Housing Agency; and WHEREAS, the Housing Asset Transfer Form included the following properties, all of which were acquired using moneys from the Low- and Moderate-Income Housing Fund: Assessors Parcel Numbers 108-010-043, 104-350-019, 104-350-018, 114-060-032, 116-440-025, AND 115-170-001; and 7-3 I WHEREAS, HSC §34181(f), requires that the Oversight Board approve by resolution 0 the housing asset transfer at a public meeting after at least 10 days' notice to the public of the J proposed action; and WHEREAS, on February 26, 2013, the Oversight Board adopted Resolution 2013-003 0 approving the transfer of all non-cash housing assets of the Redding Redevelopment Agency to J the Successor Housing Agency; and --C WHEREAS, Section 33334.16 of the California Health and Safety Code stipulates that the Agency shall, within five years from the date it acquires the properties, initiate activities consistent with development of the properties for housing affordable to persons and families of low and moderate income; and WHEREAS, Section 33334.16 of the California Health and Safety Code provides that if development has not been initiated within this period, the legislative body may extend the period during which the Successor Housing Agency may retain the properties for one additional period not to exceed five years; and WHEREAS, the City Council, as the legislative body for the City of Redding, wishes to extend the period for the Successor Housing Agency to retain the properties for not more than an additional five years and this extension shall be deemed retroactive to August 30, 2017; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Redding as follows: 1. The intention of the extension is for the properties to be used for the development of housing units affordable to persons and families of extremely low- and low-income. 2. In the event that physical development of any of the properties for this purpose has not begun by the end of the extended period, or if the Successor Housing Agency does not comply with this requirement, the property(s) on which physical development has not begun shall be sold and the proceeds from the sale shall be deposited in the Low- and Moderate-Income Housing Asset Fund.
