HomeMy WebLinkAboutReso 2000-158 - Clover Creek Flood Protection RESOLUTION NO. 2000- /S' A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING ADOPTING THE MITIGATED NEGATIVE DECLARATION AND MITIGATION MONITORING PROGRAM FOR THE CLOVER CREEK FLOOD PROTECTION AND ENVIRONMENTAL ENHANCEMENT PROJECT,ENVIRONMENTAL DETERMINATION,ED-3-00. WHEREAS,the City of Redding,as lead agency for the Clover Creek Flood Protection and Environmental Enhancement Project, has conducted the following environmental review for the proposed Project: A. A Mitigated Negative Declaration was circulated for review and comment on June 19, 2000. B. A public hearing was conducted by the Board of Administrative Review on July 26, 2000. C. The public hearing was continued to August 9,2000, in order to provide additional time for review by the California Department of Fish and Game of new information and revised mitigation measures. D. Mitigation measures were modified to incorporate issues raised during the comment period, and those mitigation measures were discussed at the public hearing on August 9, 2000. E. The Board of Administrative Review adopted the Mitigated Negative Declaration at its meeting on August 9, 2000. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Redding, based upon the entire record of the environmental review for the Clover Creek Flood Protection and Environmental Enhancement Project, makes the following findings: 1. All required notices of intent to adopt a Mitigated Negative Declaration were made,and such notices contained the information required by CEQA Guidelines Section 15072. 2. A public hearing was held at which modifications to mitigation measures were considered;the measures as modified are more effective than the mitigation measures replaced,and the mitigation measures as modified will not cause a significant effect on the environment. 3. There is no substantial evidence that the Project as proposed will have a significant effect on the environment, and the Mitigated Negative Declaration represents the lead agency's independent judgment and analysis. 4. A Mitigation Monitoring Program has been prepared to determine responsibility and scheduling for the specified mitigation measures. BE IT FURTHER RESOLVED that the City Council of the City of Redding hereby adopts 16 (1) the Mitigated Negative Declaration for the Clover Creek Flood Protection and Environmental U\ pC Enhancement Project,Ed-3-00;and(2)the Mitigation Monitoring Program. Copies of the Mitigated Negative Declaration and the Mitigation Monitoring Program are attached hereto and made a part hereof by reference. Box 496071, Redding, CA 96049-6071 530.225.4020 FAX 530.225.4495 MITIGATED NEGATIVE DECLARATION The Development Services Director has determined that PUBLIC HEARING—ENVIRONMENTAL IMPACT DETERMINATION ED-3-00,by the City of Redding, proposing to construct the Clover Creek Flood Protection and Environmental Enhancement Project on a 145-acre site located east of Shasta View Drive, 1,500 feet south of Hartnell Avenue, and 3,000 feet west of Airport Road in a "U" Unclassified District, does not have a substantial impact upon the environment and that an environmental impact report is not necessary. The decision that the proposed project will not have a significant effect upon the environment is based on an initial study prepared by the City Development Services Department. The following has also been determined: 1. The project is compatible with the Redding General Plan. 2. The project will not significantly alter existing land form. 3. The project is compatible with surrounding land use. 4. The project is compatible with the code of the City of Redding, California. 5. The project is subject to the attached mitigation measures. If there are substantial changes that alter the character of the proposed project,another environmental impact determination will be necessary. A copy of the initial study and supporting documents may be obtained at the City of Redding Development Services Department, 777 Cypress Avenue, Redding, California 96001. ohn Keaney Senior Planner Dated: June 19, 2000 TABLE 1-1 SUMMARY OF MITIGATIONS CLOVER CREEK FLOOD PROTECTION AND ENVIRONMENTAL ENHANCEMENT PROJECT MM No. Mitigation Measure E-1 Pursuant to Redding Municipal Code Chapter 16.12,any grading,filling or excavation activities require a permit be obtained from the Department of Public Works. Information that may be required within the permit application includes an Engineering Geological Report, Erosion and Sediment Control Plan and a Soil Engineering Report. The contractor will prepare and implement an interim and final erosion control plan as outlined in Redding Municipal Code chapter 16.12. E-2 In compliance with Redding Municipal Code Chapter 16.12,the contractor shall conduct grading and clearing operations in conformance with the applicable permit requirements of the U.S.Army Corps of Engineers, State Department of Fish and Game, the Regional Water Quality Control Board, and all other state and federal agencies having jurisdiction. Permits from these agencies may include, but are not limited to, a Department of the Army permit, Streambed Alteration Agreement, 401 Water Quality Certification or Waiver, and a General Construction Activity Stormwater Permit. E-3 Erosion-control measures shall be implemented at the appropriate level and in a proactive manner during all seasons as specified by the Director of Public Works. All material necessary to implement the short-term measures shall be on-site prior to the commencement of work(Redding Municipal Code Chapter 16.12). A-1 The following Standard Mitigation Measures, as outlined in the City of Redding General Plan, shall be incorporated into project construction activities: • Water active construction sites at least twice daily as directed by the Public Works Department. • All trucks hauling dirt,sand, soil or other loose materials shall be covered or should maintain at least two feet of freeboard(i.e.,minimum vertical distance between top of the load and the trailer) in accordance with the requirement of CVC Section 23114. • Sweep streets at the end of the day if visible soil materials are carried onto adjacent public paved roads. • All grading operations shall be suspended when winds(as instantaneous gusts)exceed 20 miles per hour as directed by the AQMD. • Apply nontoxic soil stabilizers according to manufacturer's specification to all inactive construction areas (previously graded areas inactive for ten days or more). • Exposed stockpiles of soil and other backfill material shall be enclosed or covered,and watered twice daily or have soil binders added. • Install wheel washers where vehicles enter and exit unpaved roads onto paved roads,or wash off trucks and any equipment leaving the site each trip. A-2 Carbon monoxide emissions shall be reduced through the following measures: • Vehicle and equipment idling shall be limited to the fullest extent practicable. Clover Creek Summary of Mitigations -1- August 9,2000 • Construction activities and the delivery or hauling of project-related materials shall be organized to maximize productivity and reduce truck and vehicle trips to the fullest extent practicable. • Equipment used by the city and the contractor for the project shall be maintained in good working order and comply with any applicable standards for pollutant emissions. W-1 If groundwater is encountered during excavation activities, the contractor may employ the following dewatering activities: • Pumping into temporary impoundments prior to release into Clover Creek downstream of project activities. W-2 The contractor will obtain a Clearing, Grading, Fills and Excavation permit from the City of Redding. Information that may be required within the permit application includes an Engineering Geological Report, Erosion and Sediment Control Plan and a Soil Engineering Report. The contractor will prepare and implement an interim and final erosion control plan as required by Ordinance No. 1986. The following measures, as outlined in Redding Municipal Code Section 16.12.120,will be adhered to: • Erosion-control measures shall be installed during any season at the direction of the Public Works Director. All materials necessary to implement the interim plan shall be on site prior to commencement of work. • The period between the 15th day of October and the following 15th day of April is found and determined to be the period in which heavy rainfall occurs in the city. During this period no clearing or grading in excess of two hundred fifty cubic yards may be commenced on any single site if the public works director determines by visual inspection that such work will endanger the public health and safety or is otherwise prohibited by state or federal regulations. W-3 In compliance with Ordinance No. 1986, the contractor shall conduct grading and clearing operations in conformance with the applicable permit requirements of the U.S. Army Corps of Engineers, State Department of Fish and Game, the Regional Water Quality Control Board, and all other state and federal agencies having jurisdiction. Permits from these agencies may include, but are not limited to, a Department of the Army permit, Streambed Alteration Agreement,401 Water Quality Certification or Waiver,and a General Construction Activity Stormwater Permit. W-4 The contractor shall prepare a Notice of Intent to be forwarded to the State Water Resources Control Board requesting authorization under the National Pollutant Discharge Elimination System General Construction Activity Stormwater Permit. In compliance with the permit conditions,the contractor shall retain a qualified erosion and sediment control specialist to prepare a Stormwater Pollution Prevention Plan (SWPPP) which outlines best management practices (BMPs). The objective of the SWPPP is to identify sources of sediment and other pollutants that affect the quality of stormwater discharges and to describe and ensure the implementation of practices to reduce sediment and other pollutants in stormwater discharges. W-5 All fueling and oil changing activities for construction equipment shall be limited to the staging areas, as identified during the development of the Stormwater Pollution Prevention Plan, sufficiently away from streams or watercourses, and/or sensitive habitat. BR-1 Before the start of construction, the City shall retain a professional arborist to conduct a tree survey of all trees with a diameter breast height (d.b.h.) of 6 inches or greater that could be impacted by implementation of the proposed project. The survey will record: species, diameter breast height,condition/health and any special considerations. Oak trees with a d.b.h.of 6 inches Clover Creek Summary of Mitigations -2- August 9,2000 C. or greater that will be removed as a result of the project shall be mitigated at a ratio of 3:1. Depending upon size and health of oak trees slated for removal,the City Planning Division may require an even higher replacement ratio. Replacement trees shall be limited to oak species that currently exist on the project site. Oak trees shall be planted in groves comparable to the naturally- occurring oak woodlands found on the project site. Replaced trees shall be monitored by a qualified biologist semi-annually for a minimum of 3 years to ensure that the total number of surviving replacement trees meets a survival standard of 75 percent at the completion of the monitoring period. During that 3-year period,an annual monitoring report shall be submitted to the City Planning Division that summarizes the success of the mitigation and provides any necessary remediation measures in the event that the success criteria are not being met. BR-2 The following measures, in accordance with the City of Redding Tree Preservation Ordinance, shall be implemented: • Before the start of any clearing,excavation,construction,or other work on the site,every tree designated for preservation shall be clearly delineated in the field. The delineation markers shall remain in place for the duration of all work. Where deemed appropriate by the approving authority, a barrier of posts and flagging or other appropriate materials may be required to be erected around protected trees. A plan shall be established for the removal and disposal of brush,earth,and other debris in order to avoid injury to any protected tree which is to be saved. • Where construction activities will result in encroachment within the drip line of a protected tree, special measures shall be incorporated to allow the roots to obtain oxygen, water, and nutrients. The Development Services Director may require the applicant to provide recommendations by a registered professional forester or a certified arborist setting forth the measures necessary to minimize impacts to the tree. • No storage or dumping of oil,gasoline,chemicals,or other substances that may be harmful to trees shall occur within the drip line of any protected tree or on any other location on the site from which such substances might enter the drip line of a protected tree. All other conditions of the City's Tree Preservation Ordinance and Guidelines for Tree Protection shall be implemented. BR-3 Prior to construction,the City shall perform surveys for the presence of raptor nests or burrows. If no active nests are found,construction may proceed. If any occupied nests or burrows are found within areas to be potentially impacted by construction,the City,in consultation with DFG, shall implement mitigation measures, such as passive relocation(for burrowing raptors), or establish buffer areas where construction activity is prohibited until the end of the nesting season(early March to mid-August) or until the young have fledged. If nesting raptors are found,a qualified biologist shall monitor the nest to determine when the young have fledged. If feasible,trees could be removed outside the nesting season to avoid impacts to tree-nesting raptors. BR-4 For temporary or permanent impacts to jurisdictional wetlands/waters of the United States,the project applicant shall apply for a Clean Water Act,Section 404 permit,from the U.S.Army Corps of Engineers. Conditions of the 404 permit, including the mitigation measures to ensure no net loss of wetland habitat, shall be implemented. The project currently proposes to construct 10 to 15 acres of seasonal wetland,marsh, and perennial pond habitat in addition to an undetermined amount of vernal pool habitat, which will result in an estimated 3:1 creation/impact ratio. Monitoring of avoided or created wetland mitigation habitat, a standard permit condition, shall occur in accordance with permit requirements. The 404 permit will include success criteria similar to those in Table 1 of the Initial Study. Clover Creek Summary of Mitigations -3- August 9,2000 rl BR-5 Prior to construction activities, the project applicant will contract with qualified biologists to conduct determinate level surveys for the presence/absence of listed invertebrate species vernal pool fairy shrimp and vernal pool tadpole shrimp. Should listed species be found,the applicant shall initiate consultation with the U.S. Fish and Wildlife Service for potential impacts to listed invertebrates(vernal pool fairy shrimp and vernal pool tadpole shrimp),and/or their habitat(i.e., vernal pools and possibly seasonal wetlands). Subsequent to consultation,the Service will issue a Biological Opinion outlining conditions to mitigate for any impacts to listed species or habitat. The project applicant shall comply with the conditions, including mitigation requirements, set forth in that Biological Opinion. Mitigation for impacts to listed invertebrates typically involves two components: preservation and creation. The current Programmatic Consultation requires a preservation ratio of 2:1 and a creation ratio of 1:1. On-site preservation or creation may involve higher ratios. BR-6 Pursuant to California Fish and Game Code Section 1601,the City shall prepare a Notification to the California Department of Fish and Game requesting a Streambed Alteration Agreement. A Streambed Alteration Agreement is required for any project that intends to substantially divert or obstruct the natural flow or, or substantially change the bed, channel, or bank of, or use the material from the streambed of a water course. The California Department of Fish and Game will propose measures that will protect fish and wildlife during construction activities. The City shall obtain an Agreement and implement the condition of the Agreement, including any necessary measures to mitigate for impacts to riparian habitat. BR-7 Prior to construction activities,the project applicant shall complete the surveys for which it has contracted with qualified biologists to perform for the presence of any rare plant species. Should rare plant species be found,consultation with appropriate resource agencies such as the U.S.Fish and Wildlife Service and the California Department of Fish and Game shall be initiated. Measures to reduce or eliminate impacts to rare plant species,as developed through consultation, shall be implemented. Typical measures may include transplanting of perennial plants to on-or off-site appropriate habitat or,for annual plants,collection of seed materials and/or seed-bearing soil and redistribution in on-or off-site appropriate habitat. BR-8 Prior to construction activities, the City shall contract with a qualified biologist to collect seeds and seed-bearing soil from the three sites where Dwarf Red Bluff Rush is located. The seeds and seed-bearing soil will be placed in the created wetland habitat in locations approved with the Section 404 permit. Success criteria for the revegetation shall be verification by a qualified biologist of plant populations estimates of 150-200 plants in three separate locations three years after completion of the project. N-1 Construction activities shall be limited to daylight hours between (7 a.m. and 7 p.m.) in areas where sensitive receptors are located. No construction shall be permitted on Sunday and federal holidays (City of Redding Ordinance 1986 Section 16.40.120, Subsection H). N-2 In noise sensitive areas,construction equipment,compressors,and generators shall be fitted with heavy duty mufflers specifically designed to reduce noise impacts. N-3 Enforce existing applicable sections of the California Vehicle Code related to vehicle or equipment mufflers and modified exhaust systems. N-4 Ensure that any municipal vehicles or noise-generating mechanical equipment purchased or used by the City of Redding complies with acceptable standards. N-5 Ensure vehicle speed limits through residential neighborhoods are adhered to. Clover Creek Summary of Mitigations -4- August 9,2000 T-1 In accordance with Redding Municipal Code Section 16.12.120,Subsection E,the City ofRedding Public Works Director shall approve all access routes and may impose such regulations with respect to access routes to and from grading sites as he shall determine are required in the interest of public safety. Traffic control devices,including flagmen, signs and markers,shall be utilized at appropriate places along the designated routes of access to such sites. The size or type of hauling equipment shall be limited in accordance with the width and conditions of the street. CR-1 An archaeological monitor should be present during deep excavation work. CR-2 In the event that a potential cultural resource is discovered during the course of project construction activities,all work shall cease in the immediate vicinity of the find until a qualified archaeologist examines the site and evaluates the potential significance of the resource. Upon completion of the site examination,the archaeologist shall submit a report to the City describing the significance of the find and make recommendations on its disposition. The City shall implement the recommendations of the report.
