None RESOLUTION NO. 2000- / 3 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING ORDERING THE VACATION OF A PORTION OF TWIN VIEW BOULEVARD ADJACENT TO PROPERTY LOCATED AT 787 TWIN VIEW BOULEVARD (A-6-82). WHEREAS: A. On August 16, 1982, by Resolution 82-131, the City Council adopted a resolution of intention to vacate the hereinafter-described area of abandonment. The conditions set forth in the resolution were satisfied in 1991 upon development of the abutting property, but a resolution ordering the abandonment was never recorded. B. Proceedings have been duly conducted and held in accordance with the provisions of the Public Streets, Highways and Service Easements Vacation Law as set forth in Section 8300, et seq. of the Streets and Highways Code of the State of California, including a public hearing held on September 20, 1982. C. This vacation is subject to the City of Redding reserving and excepting from the proposed vacation an easement for slope purposes and an easement for public utility purposes. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF REDDING FINDS, RESOLVES AND ORDERS AS FOLLOWS: 1 The above recitals are true and correct 2. The proposed area of abandonment is that portion of Twin View Boulevard adjacent to the property located at 787 Twin View Boulevard, as more particularly described in Exhibit A and shown on Exhibit B attached and made a part hereof, hereafter called 'Area of 58.00'R/W Abandonment. ' �.9 3. On the basis of the initial study prepared by the Planning Division of the Development Services Department, the City Council finds that the subject vacation will not have a significant effect upon the environment and approves the negative declaration with the following findings: (a) The project is compatible with the Redding General Plan, the surrounding land use, and the Redding Municipal Code; and (b) The project will not significantly alter the existing land form. 4. All requirements of California Streets and Highways Code Section 8300, et seq., have been complied with. 5. Public convenience and necessity require the reservation and exception of an easement for slope purposes and an easement for public utility purposes over the proposed 'Area of 58.00' R/W Abandonment, " as more particularly described in paragraph 6 below. 6. The 'Area of 58.00' R/W Abandonment' is hereby vacated, PROVIDED THAT the following easements are hereby reserved and excepted from the vacation: (1) An easement for slope purposes over the Northwesterly 18.00 feet of the 58.00 foot wide 'Area of Abandonment'; and (2) An easement for public utility purposes included within a strip of land 15.00 feet wide over the 58.00 foot wide 'Area of Abandonment.' The Northwesterly line of said 15.00-foot-wide strip to be the Southeasterly line of the above-described 18.00-foot- wide slope easement. 7. The City Clerk is directed to record a certified copy of this resolution, attested by the Clerk under seal, in the office of the Shasta County Assessor/Recorder. Leonard Wingate, Ci Attorney 2 LEGAL DESCRIPTION OF ABANDONMENT OF RIGHT-OF-WAY Being a strip of land 58.00 feet wide as measured perpendicular to the Northwesterly line of that certain parcel described in Deed to Kenneth L Knighten recorded February 11, 1991, in Book 2687 of Official Records at Page 253, Office of the Recorder, Shasta County, California. The sidelines of said strip shall be lengthened or shortened to terminate at property lines of said parcel. Reserving therefrom an easement for slope purposes over the Northwesterly 18.00 feet of the above described 58.00 foot wide strip. Also reserving therefrom an easement for public utility purposes included within a strip of land 15.00 feet wide over the above described 58.00 foot wide strip.
