RESOLUTION NO. 2000- /07/
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING
SUMMARILY VACATING THE PORTIONS OF THE RIO STREET
RIGHT-OF-WAY THAT ARE EXCESS RIGHT-OF-WAY IN THE
HAMMERHEAD TURNAROUND [A-3-00].
WHEREAS:
A. Easement rights to the areas proposed for vacation were dedicated to the City of
Redding for public use (public service easement and street right-of-way) as shown on Parcel Map
No. LS-66-90 for Marvin Oliver recorded February 23, 1993, in Book 30 of Parcel Maps at
page 2, Shasta County Records.
B. The two areas proposed for vacation are excess street right-of-way, lying adjacent
to the area that is required for the Rio Street hammerhead turnaround.
C. It is the recommendation of staff that the City summarily vacate the previously-
dedicated areas, as more particularly described in Exhibit A and shown crosshatched on Exhibit
B attached and made a part hereof by reference, as said areas are excess and not required as a
public service easement or street right-of-way.
NOW, THEREFORE, THE CITY COUNCIL DETERMINES, RESOLVES AND
ORDERS AS FOLLOWS:
1. The City Council elects to proceed in this matter under the provisions of the Public
Streets, Highways and Service Easements Vacation Law as set forth in Section 8333, et
seq., of the Streets and Highways Code of the State of California.
2. The City Council approves the request to summarily vacate the previously-dedicated
areas more particularly described in Exhibit A and shown crosshatched on Exhibit B
attached and made a part hereof. Said areas are excess right-of-way and not required for
the Rio Street hammerhead turnaround.

3. The excess public service easement and street right-of-way has not been used for the
purposes for which it was dedicated or acquired for five consecutive years immediately
preceding this vacation. Therefore, from and after the date this resolution is recorded,
those portions of the land dedicated to the City of Redding, as described in Exhibits A
and B, shall no longer be used for public service and street right-of-way purposes.
4. The City Clerk is directed to cause a certified copy of this resolution of vacation, attested
by the Clerk under seal, to be recorded in the office of the Shasta County
Assessor/Recorder.
I HEREBY CERTIFY that the foregoing resolution was introduced, read and adopted at
a regular meeting of the City Council on the 6th day of June, 2000, by the following vote:

Two parcels of land in Section 14 of the P.B. Reading Grant in the City of Redding, Shasta
County, California, being portions of the 0.12-acre dedication for street right-of-way and public
service easement shown on the map filed for record in Book 30 of Parcel Maps at page 2, Shasta
County Records, consisting of Parcels A and B, described as follows:
PARCEL A
Beginning at the most Southerly corner of Parcel 2 as shown on the aforementioned map; thence,
along the Northeasterly line of said 0.12-acre dedication, N.56°21'58"W., 20.00 feet; thence,
S.33°38'02"W., 5.00 feet; thence, along a 20.00-foot radius curve, concave Easterly, through a
central angle of 90°00'00", an arc distance of 31.42 feet to a point on the Southeasterly line of
said 0.12-acre dedication; thence, along said Southeasterly line, N.33°38'02"E., 25.00 feet to the
Point of Beginning.
PARCEL B
Commencing at the most Southerly corner of Parcel 2 as shown on the aforementioned map;
thence, S.33°38'02"W., 90.00 feet to the most Southerly corner of said 0.12-acre dedication
being the TRUE POINT OF BEGINNING of this parcel; thence, along the Southwesterly line
thereof, N.56°21'58"W., 20.00 feet; thence, N.33°38'02"E., 5.00 feet; thence, along a 20.00-foot
radius curve, concave Southerly, through a central angle of 90°00'00", an arc distance of 31.42
feet to a point on the Southeasterly line of said 0.12-acre dedication; thence, along said
Southeasterly line, S.33°38'02"W., 25.00 feet to the TRUE POINT OF BEGINNING.
