Code§6103 Portion APN 204-430-13 RESOLUTION NO. 2000- 83 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING ORDERING THE ABANDONMENT OF 919 SQUARE FEET, MORE OR LESS, OF THE AREA DEDICATED TO THE CITY OF REDDING FOR OPEN SPACE AND TRAIL PURPOSES WITH THE RECORDING OF THE MAP FOR UNIT 6 OF THE RIDGEVIEW SUBDIVISION IN BOOK 20 OF MAPS AT PAGE 40, SHASTA COUNTY RECORDS (A-1-00). WHEREAS: A. On March 21, 2000, by Resolution 2000-56, the City Council adopted a resolution of intention to abandon the hereinafter-described portion of an area dedicated to the City of Redding for open space and trail purposes (hereinafter referred to as the "Area of Abandonment"). B. Proceedings have been duly conducted and held in accordance with the provisions of California Government Code Section 51090, et seq. C. This abandonment is SUBJECT TO the following occurring prior to the recording of this resolution in the office of the Shasta County Recorder: (a) A 15-foot building setback shall be established adjacent to the north property line. All buildings, wood decks, wood patios, and similar accessory structures constructed of combustible materials are prohibited within the setback area. (b) A property-line adjustment has been recorded in the Office of the Shasta County Assessor-Recorder to make the "Area of Abandonment" part of the residential lot at 2381 Cumberland Drive. (c) The abandonment fee, if any, that the property owner must pay to the County Treasurer has been paid in full. D. When the above conditions have been met, the Area of Abandonment will not be needed for public use. NOW, THEREFORE, THE CITY COUNCIL FINDS, RESOLVES AND ORDERS AS FOLLOWS: 1. The above recitals are true and correct. 2. The Area of Abandonment is described in Exhibit A and shown crosshatched as the "Area of Abandonment"on the map attached and made a part hereof by reference. 3. The City Council makes the following findings in connection herewith: (a) No public purpose described in Government Code Section 51084 will be served by keeping the land as open space; (b) The abandonment is not inconsistent with the purposes of Article 4, Termination of an Open-space Easement, of Government Code Section 51090, et seq.; (c) The abandonment is consistent with the Redding General Plan; and (d) The abandonment is necessary to avoid a substantial financial hardship to the landowner due to involuntary factors unique to him. 4. All requirements of California Government Code Section 51090, et seq., have been complied with. 5. The City Council has ratified the Negative Declaration prepared in connection herewith, finding that no significant effect on the environment is created hereby. 6. That certain portion of the area dedicated to the City of Redding for open space and trail purposes as set forth in paragraph 2 hereof be abandoned, PROVIDED THAT this abandonment shall not become effective nor shall this resolution be recorded until the following conditions have been met: (a) A 15-foot building setback shall be established adjacent to the north property line. When the Director of Development Services advises the City Clerk that the above requirements have been met, the City Clerk is directed to record a certified copy of this resolution, attested by the Clerk under seal, in the office of the Shasta County Assessor/Recorder. A-1-00 1047.01 EXHIBIT "A" All that portion of the 6.02 acre open space and trail dedication as shown on the map of Ridgeview Subdivision, Unit No. 6 filed for record in Book 20 os Maps at page 40, Shasta County Records, described as follows: Beginning at the Northeast corner of Lot 3 of said Ridgeview Subdivision, Unit No. 6; thence, along the Northerly line of said Lot 3, S.60°29'55"W., 68.23 feet to the Northeast corner of Lot 2 of said Subdivision; thence, along the Northerly line of said Lot 2, N.68°23'42"W., 34.62 feet to the Northwest corner of the real property described in the deed recorded in book 3610 of Official Records at page 273 Shasta County Records; thence, N.77°10'12"E., 93.91 feet to the Point of Beginning; containing 919 square feet.
