HomeMy WebLinkAboutReso 2000-072 - LMD "C" RESOLUTION NO. 2000 52, - LANDSCAPE MAINTENANCE DISTRICT "C" A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING APPROVING THE REPORT OF THE ENGINEER AS FILED, AND DECLARING ITS INTENTION TO LEVY AND COLLECT ASSESSMENTS FOR FISCAL YEAR 2000-2001 PURSUANT TO THE LANDSCAPING AND LIGHTING ACT OF 1972,COMMENCING WITH SECTION 22500 OF THE STREETS AND HIGHWAYS CODE. WHEREAS: A. The City Council heretofore ordered the consolidated formation of Landscape Maintenance District "C" (District) under authority granted by the Landscaping and Lighting Act of 1972, as set forth in Part 2 of Division 15 of the Streets and Highways Code of the State of California. B. The purpose of the District is to provide maintenance to those landscaping improvements required within the public rights-of-way by the conditions of development approval of the subdivisions contained therein. C. No substantial changes in existing improvements are proposed for fiscal year 2000- 2001. D. The Engineer has filed his Report with the City Clerk pursuant to Streets and Highways Code Section 22565, et seq. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL THAT: 1. The Report of the Engineer, as filed, is hereby approved. 2. Within Area 1 of the District, all of that certain real property situate in the City of Redding, Shasta County, California, formerly designated as part of R-1, is now described as Lots 1-20 inclusive of the Blossom Park Subdivision,Unit 5,as shown on the map recorded February 26, 1999, in Book 22 of Maps at page 31, Shasta County Records. 3. It is the intention of the City Council to levy and collect assessments for fiscal year 2000-2001 equally amongst all the lots and remaining parcels that encompass the District, which lots and remaining parcels are more particularly described in the diagrams and location maps attached and made a part hereof, except that it shall not impose an assessment upon a federal or state governmental agency or another local agency. 4. The existing improvements for each subdivision in the District are set forth under the attached column entitled "Landscape Description & Square Footage." 5. The general locations of the lots and remaining parcels in the District are set forth under the attached column entitled "Access/Location." 6. The Report of the Engineer,on file with the City Clerk,contains a full and detailed description of the improvements, the boundaries of the District and any zones therein, and the proposed assessments upon the assessable lots and remaining parcels within the District. 7. No substantial changes in existing improvements are proposed for fiscal year 2000-2001. Only costs for the maintenance of landscaping,miscellaneous lighting,mulching,vandalism,repairs to the irrigation system, electric and water charges, replacement of vegetation as necessary, removal of trimmings, rubbish, debris and other solid waste, the cleaning, sandblasting and painting of any walls or other improvements to remove or cover graffiti, administrative costs, and such other maintenance and incidental expenses as are authorized by Streets and Highways Code Sections 22526 and 22531, will be assessed. 8. A public hearing will be held on Tuesday, June 6, 2000, at the hour of 7:00 p.m., or as soon thereafter as the matter may be heard, in the City Council Chambers located at 777 Cypress Avenue, Redding, California, to address the levy of the proposed assessment for fiscal year 2000-2001. The proposed assessment for fiscal year 2000-2001 of$7.46 is the same as last year's assessment.
