RESOLUTION NO. 2000- 2„.
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING
ORDERING THE VACATION OF ONLY THE PEDESTRIAN/ACCESSBICYCLE
PATH PORTIONS OF THE 15- AND 20-FOOT EASEMENTS LOCATED
BETWEEN THE RESIDENTIAL LOTS AT 1974 AND 1988 JEANAE COURT AND
2027 MARTIAN WAY (A-6-99).
WHEREAS:
A. On January 18, 2000, by Resolution 2000-10, the City Council adopted a resolution of
intention to vacate the hereinafter-described Areas of Abandonment.
B. Proceedings have been duly conducted and held in accordance with the provisions of the Public
Streets, Highways and Service Easements Vacation Law as set forth in Section 8300, et seq. of the Streets
and Highways Code of the State of California.
C. This abandonment is subject to the retention of all underlying public services easements by the
City.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF REDDING FINDS,
RESOLVES AND ORDERS AS FOLLOWS:
1. The Areas of Abandonment are generally located between the residential lots at 1974 and 1988
Jeanae Court and 2027 Martian Way, and described as follows:
(a) A 15-foot pedestrian and access easement over a portion of Lot 30 of the Victor Estates
Subdivision, and a 20-foot pedestrian easement over a portion of Lot 31 of the Victor Estates
Subdivision, acquired by dedication on the map recorded in Book 21 of Maps, at page 5,
Shasta County Records. Said pedestrian and access easements are more particularly described
in Exhibit A and shown crosshatched on Exhibit A-1 attached and made a part hereof.
The City is retaining all underlying public service easements over Lots 30 and 31 that the City
acquired by dedication on the Victor Estates Subdivision map recorded in Book 21 of Maps, at
page 5, Shasta County Records.
(b) The pedestrian/bicycle path portion of the 15-foot public service and pedestrian/bicycle path
easement over Parcels 1 and 2 which the City acquired by deed recorded December 26, 1997,
in Book 3633 of Official Records at page 781, Shasta County Records, as more particularly
described in Exhibit B and shown crosshatched on Exhibit B-1 attached and made a part hereof.
The City is retaining all underlying public service easements over Parcels 1 and 2.
2. On the basis of the initial study prepared by the Development Services Department, the City Council
finds that the subject vacation will not have a significant effect upon the environment and approves
the negative declaration with the following findings:
(a) The project is compatible with the Redding General Plan, the surrounding land use, and the
Redding Municipal Code; and
(b) The project will not significantly alter the existing land form.
3. All requirements of California Streets and Highways Code Section 8300, et seq., have been
complied with.
4. Public convenience and necessity require the retention of all underlying public service easements
over the Areas of Abandonment to preserve rights-of-way for existing public utilities.
5. The proposed Areas of Abandonment are unnecessary for present or prospective public use.
Therefore, the Areas of Abandonment are hereby vacated, subject to retaining all underlying public
service easements.
6. The City Clerk is directed to record a certified copy of this resolution, attested by the Clerk under
seal, in the office of the Shasta County Assessor/Recorder.
I HEREBY CERTIFY that the foregoing resolution was introduced, read and adopted at a
regular meeting of the City Council on the 7th day of Mar , 2000, by the following vote:
