HomeMy WebLinkAboutOrdinance - 2274 - Mobile Fueling Operations • ORDINANCE NO. 4Z- AN ZAN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF REDDING ADDING SECTION 3.08.160 TO THE REDDING MUNICIPAL CODE, MOBILE FUELING OPERATIONS. The City Council of the City of Redding does ordain as follows: Section 1. Chapter 3.08, General Airport Regulations, of the Redding Municipal Code is hereby amended by adding Section 3.08.160, Mobile Fueling Operations, to read as follows: 3.08.160 Mobile Fueling Operations. No persons shall use, operate or provide mobile fueling equipment or facilities at the Redding Municipal Airport or Benton Airpark, except as follows: A. A Full-Service Fixed Base Operator, as defined in Section 3.08.160 G., may operate mobile fueling equipment or facilities owned or leased by the operator for the benefit of persons using the Airports. B. A Specialty-Fixed Base Operator,as defined in Section 3.08.160 G.,that is an authorized helicopter repair and charter facility, may operate mobile fueling equipment or facilities owned by the operator to exclusively fuel helicopters owned or leased by the operator. The fuel used in such mobile fueling equipment or facilities must be purchased from one of the Airports' Full-Service Fixed Base Operators. C. The State of California, California Highway Patrol Air Operations, may operate mobile fueling equipment or facilities owned by the State of California to exclusively fuel helicopters and fixed- wing aircraft owned by the State of California. The fuel used in such mobile fueling equipment or facilities must be purchased from one of the Airports' Full-Service Fixed Base Operators. D. Upon consultation with the City of Redding Fire Chief,or his designee,the Airports Manager may authorize, under urgent or emergency conditions, the use of mobile fueling operations on either Airport that do not follow the aforementioned categories. In this case,all appropriate fuel flowage fees,and any and all applicable future fees and service charges that may be adopted,are to be paid pursuant to the City's Schedule of Fees and Service Charges. E. The Airports Manager may approve the use of mobile fueling equipment by aircraft operators that are tenants of either Airport,provided such equipment is used solely to fuel private aircraft which are registered in the operator's name. In this case, all appropriate fuel flowage fees, and any and all applicable future fees and service charges that may be adopted, are to be paid pursuant to the City's Schedule of Fees and Service Charges. F. All such use, operation or provision of mobile fueling equipment or facilities must comply at all times with all federal, state and local laws, rules, regulations and ordinances, including the Uniform Fire Code. G. For the purposes of this section, the following phrases when used in this section shall have the following meanings respectively ascribed to them: "Full-Service Fixed Base Operator"means a proprietor of a commercial operation offering a full range of defined aeronautical activities and services to the general public and based at the Airport. Only Full-Service Fixed Base Operators are permitted to commercially sell and dispense aviation fuel and petroleum products on the Airport. "Speciality-Fixed Base Operator" means a proprietor of a commercial operation offering one or more specific aeronautical activities or services to the general public and based at the Airport. Section 2. The passage of this ordinance is not a "project"according to the definition in the California Environmental Quality Act, and therefore is not subject to the provisions requiring environmental review. Section 3. This ordinance shall take effect 30 days after the date of its adoption, and the City Clerk shall certify to the adoption thereof and cause its publication according to law.
