RESOLUTION NO. 2001- X29
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING
SUMMARILY VACATING PUBLIC UTILITY AND ROAD EASEMENTS
GENERALLY LOCATED AT THE NORTHWEST CORNER OF
BENTON DRIVE AND STATE HIGHWAY 273 (A-8-00).
WHEREAS:
A. That parcel of land shown as Sulphur Creek Road (Future Street), and also those
5.00 foot public service easements adjacent to said road, as shown on Parcel Map No. L.S. 10-82
recorded in Book 22 of Parcel Maps at page 134, Shasta County Records, were dedicated to the
City of Redding for public utility and road easements.
B. The owners of the property located at 460 North Market Street have asked that the
City vacate the area described in Exhibit A and shown crosshatched on Exhibit B attached and
made a part hereof by reference, as the public utility and road easements have not been used for
the purposes for which they were dedicated or acquired for five consecutive years immediately
preceding the proposed vacation.
C. The Engineering Division of the Development Services Department has advised the
City Council that there are no in-place public utility facilities that are in use or would be affected
by the proposed vacation, and that—subject to the City retaining the easements set forth in
Exhibit A—the public utility and road easements are not required for street and other public
purposes.
NOW, THEREFORE, THE CITY COUNCIL DETERMINES, RESOLVES AND
ORDERS AS FOLLOWS:
1. The City Council elects to proceed in this matter under the provisions of the Public
Streets, Highways and Service Easements Vacation Law as set forth in Section 8333, et
seq., of the Streets and Highways Code of the State of California.
2. The City Council approves the request to summarily vacate that parcel of land shown as
Sulphur Creek Road (Future Street), and also those 5.00 foot public service easements
adjacent to said road, as shown on Parcel Map L.S. 10-82 recorded in Book 22 of Parcel
Maps at page 134, Shasta County Records, and being more particularly described in
Exhibit A and shown crosshatched on Exhibit B attached hereto, subject to the City of
Redding reserving and excepting therefrom the following:
(a) The Southerly 5.00 feet of the above-described land lying adjacent to Benton
Drive (shaded area on attached Exhibit B), which is reserved as a 5.00 foot
public service easement; and
(b) Any portion lying within the "5' P.U.E." adjacent to the "38' R/W - Sulpher
Creek Rd." as shown on said Parcel Map.
The area being vacated shall be divided along the centerline of said Sulphur Creek Road
(Future Street), and the resultant portions shall be merged with the adjacent parcels of
land, namely Parcel "A" and Parcel "B" as shown on Exhibit B attached hereto.
3. The area being vacated has not been used for the purposes for which it was dedicated or
acquired for five consecutive years immediately preceding the proposed vacation; is not
required; and there are no other public facilities located therein. Therefore, from and after
the date this resolution is recorded, the area hereby vacated—but not the easements set
forth in paragraph 2 above being retained by the City—shall no longer constitute public
utility and road easements for street and other public purposes.
4. The City Clerk is directed to cause a certified copy of this resolution of vacation, attested
by the Clerk under seal, to be recorded in the office of the Shasta County
Assessor/Recorder.
I HEREBY CERTIFY that the foregoing resolution was introduced, read and adopted at
a regular meeting of the City Council on the 20thday ofNovember, 2001, by the following vote:

AND ALSO THOSE 5.00 FOOT P.U.E.'S ADJACENT TO SAID ROAD, AS SHOWN ON
PARCEL MAP L.S. 10-82 RECORDED IN BOOK 22 OF PARCEL MAPS, AT PAGE 134,
SHASTA COUNTY RECORDS. EXCEPTING THEREFROM THE SOUTHERLY 5.00 FEET
OF THE ABOVE DESCRIBED LAND LYING ADJACENT TO BENTON DRIVE, WHICH IS
RESERVED AS A 5.00 FOOT PUBLIC SERVICE EASEMENT. ALSO EXCEPTING ANY
PORTION LYING WITHIN THE "5' P.U.E."ADJACENT TO THE "38' R/W - SULPHER
CREEK RD."AS SHOWN ON SAID PARCEL MAP.
THE ABANDONMENT SHALL BE DIVIDED LONG THE CENTERLINE OF SAID
SULPHUR CREEK ROAD (FUTURE STREET) AND THE RESULTANT PORTIONS
SHALL BE MERGED WITH THE ADJACENT PARCELS OF LAND, PARCEL"A"AND
PARCEL"B"AS SHOWN ON SAID MAP.
