WHEREAS: A. On April 17, by Resolution 2001-66, the City Council approved the Report of the Engineer as filed relating to Landscape Maintenance District"B" (District),and gave notice of the time and place of the May 1, 2001, public hearing regarding the proposed annexation and the levy and collection of assessments for fiscal year 2001-2002. B. A diagram of the area encompassed by the District, including the areas proposed to be annexed in, individual maps, and summaries are attached and made a part hereof. C. The public hearing, duly and properly noticed, commenced at the City Council Chambers, 1313 California Street, Redding, California, on May 1, 2001, and was concluded prior to the adoption of this resolution. At the public hearing, the City Council gave every interested person an opportunity to object to the proposed assessments. D. All legal prerequisites to the adoption of this resolution have occurred. THEREFORE, THE CITY COUNCIL FINDS, RESOLVES, DETERMINES AND ORDERS AS FOLLOWS: 1. The matters set forth above are true and correct. 2. With respect to the additional territory proposed for annexation into Area 13 of Landscape Maintenance District"B,"namely Unit 3 of the White Hawk Estates Subdivision: (a) The owner has filed its Petition and Consent to said inclusion; and waived the resolutions, engineer's report, notices of hearing, and the right of a majority protest with regard to the area proposed to be annexed as provided by Section 22608 of the Streets and Highways Code. (b) The real property proposed for annexation is situate in the City of Redding, Shasta County, California, and described as Lots 1-30 inclusive of the White Hawk Estates Subdivision, Unit 3, as shown on the map recorded June 24, 1999, in Book 22 of Maps at page 37, O • Shasta County Records (APN 104-240-07 through 20; 104-300-15, 16, 18 through 20, 22 through 30, 34, 38). (c) The City Council hereby orders the annexation of Unit 3 of the White Hawk Estates Subdivision into Area 13 of Landscape Maintenance District "B" for the maintenance of landscaping, miscellaneous lighting, mulching, vandalism, repairs to the irrigation system, electric and water charges, replacement of vegetation as necessary, removal of trimmings, rubbish, debris and other solid waste, the cleaning, sandblasting and painting of any walls and other improvements to remove or cover graffiti, administrative costs, and such other maintenance and incidental expenses set forth in Streets and Highways Code Sections 22526 and 22531, all as more particularly authorized pursuant to the Landscaping and Lighting Act of 1972. 3. With respect to the additional territory proposed for annexation into Unit 14 of Landscape Maintenance District"B,"namely Unit 18 of the Ravenwood Estates Subdivision: (a) The owner has filed his Petition and Consent to said inclusion; and waived the resolutions, engineer's report, notices of hearing, and the right of a majority protest with regard to the area proposed to be annexed as provided by Section 22608 of the Streets and Highways Code. (b) The real property proposed for annexation is situate in the City of Redding, Shasta County, California, and described as Lots 1-14 inclusive of the Ravenwood Estates Subdivision, Unit 18, as shown on the map recorded December 1, 2000, in Book 22 of Maps at page 70, Shasta County Records (APN 077-550-01 through 14). (c) The City Council hereby orders the annexation of Unit 18 of the Ravenwood Estates Subdivision into Area 14 of Landscape Maintenance District "B" for the maintenance of landscaping, miscellaneous lighting, mulching, vandalism, repairs to the irrigation system, electric and water charges, replacement of vegetation as necessary, removal of trimmings, rubbish, debris and other solid waste, the cleaning, sandblasting and painting of any walls and other improvements to remove or cover graffiti, administrative costs, and such other maintenance and incidental expenses set forth in Streets and Highways Code Sections 22526 and 22531, all as more particularly authorized pursuant to the Landscaping and Lighting Act of 1972. 4. The diagram of the assessment district contained in the Engineer's Report is confirmed. 5. The City Council has considered all oral statements and written protests or communications made or filed by interested persons at the public hearing of May 1, 2001, and expressly overrules any and all protests filed objecting to the proposed assessments to be levied in the District. 6. The City Council finds that the Engineer has fairly and properly apportioned the costs of the improvements to each lot/remaining parcel in the District (including the above areas annexed into Areas 13 and 14) in proportion to the estimated benefits to be received by each lot/remaining parcel from the improvements. 7. An assessment of$71 against each lot/remaining parcel located within the District for fiscal year 2001-2002 is adopted and confirmed, except that an assessment shall not be levied on property owned by a federal or state governmental agency or another local agency. 2 8. The City Clerk shall forthwith transfer to the Auditor and the Assessor/Recorder of Shasta County a certified copy of this resolution and a certified copy of the assessment district diagram contained in the Engineer's Report for Landscape Maintenance District"B."
