HomeMy WebLinkAboutReso 2001-066 - Landscape Maintenance District B RESOLUTION NO. 2001- (pip LANDSCAPE MAINTENANCE DISTRICT"B" A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING APPROVING THE REPORT OF THE ENGINEER AS FILED, AND DECLARING ITS INTENTION TO: (1) ANNEX UNIT 3 OF THE WHITE HAWK ESTATES SUBDIVISION INTO AREA 13 OF THE DISTRICT; (2) ANNEX UNIT 18 OF THE RAVENWOOD ESTATES SUBDIVISION INTO AREA 14 OF THE DISTRICT; AND (3) LEVY AND COLLECT ASSESSMENTS FOR FISCAL YEAR 2001- 2002 PURSUANT TO THE LANDSCAPING AND LIGHTING ACT OF 1972, COMMENCING WITH SECTION 22500 OF THE STREETS AND HIGHWAYS CODE. WHEREAS: A. The City Council heretofore ordered the consolidated formation of Landscape Maintenance District"B" (District)under authority granted by the Landscaping and Lighting Act of 1972, as set forth in Part 2 of Division 15 of the Streets and Highways Code of the State of California. B. The purpose of the District is to provide maintenance to those landscaping improvements required within the public rights-of-way by the conditions of development approval of the subdivisions contained therein. C. No substantial changes in existing improvements are proposed for fiscal year 2001- 2002. D. The Engineer has filed his Report with the City Clerk pursuant to Streets and Highways Code Section 22565, et seq. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL THAT: 1. The Report of the Engineer, as filed, is hereby approved. 2. It is the intention of the City Council to: (a) Annex Lots 1-30 inclusive of Unit 3 of the White Hawk Estates Subdivision into Area 13 of the District. The developer has signed a Petition and Consent for the annexation,and a waiver of the proceedings pursuant to Streets and Highways Code Section 22608. (b) Annex Lots 1-14 inclusive of Unit 18 of the Ravenwood Estates Subdivision into Area 14 of the District. The developer has signed a Petition and Consent for the annexation, and a waiver of the proceedings pursuant to Streets and Highways Code Section 22608. (c) Levy and collect assessments for fiscal year 2001-2002 equally amongst all the lots and remaining parcels that encompass the District,which lots and remaining parcels are more particularly described in the diagrams and location maps attached and made a part hereof, except that it shall not impose an assessment upon a federal or state governmental agency or another local agency. 1_ So 3. The existing improvements for each subdivision in the District are set forth under the attached column entitled "Landscape Description &Square Footage." 4. The general locations of the lots and remaining parcels in the District are set forth under the attached column entitled "Access/Location." 5. The Report of the Engineer,on file with the City Clerk,contains a full and detailed description of the improvements, the boundaries of the District—including the areas proposed to be annexed in—and any zones therein,and the proposed assessments upon the assessable lots and remaining parcels within the District. 6. No substantial changes in existing improvements are proposed for fiscal year 2001-2002. Only costs for the maintenance of landscaping,miscellaneous lighting,mulching,vandalism,repairs to the irrigation system, electric and water charges, replacement of vegetation as necessary, removal of trimmings, rubbish, debris and other solid waste, the cleaning, sandblasting and painting of any walls and other improvements to remove or cover graffiti,administrative costs, and such other maintenance and incidental expenses as are authorized by Streets and Highways Code Sections 22526 and 22531, will be assessed. 7. A public hearing will be held on Tuesday, May 1, 2001, at the hour of 7:00 p.m., or as soon thereafter as the matter may be heard, in the City Council Chambers located at 777 Cypress Avenue, Redding, California,to address to address the proposed annexation of the additional territories into the District and the levy of the proposed assessment for fiscal year 2001-2002. The proposed assessment for fiscal year 2001-2002 of$71 is the same as last year's assessment.
