lt -AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF REDDING
ADOPTING THE DOWNTOWN REDDING SPECIFIC PLAN AND
NEGATIVE DECLARATION
The City Council of the City of Redding Does Ordain as Follows:
Section 1. Findings of Fact. The City Council finds and declares as follows:
A. Redding's General Plan, adopted on October 3, 2000, and effective on
November 2, 2000, contains guidelines for development in Downtown, as expressed in the
Downtown Focus Area Guidelines of the Community Development and Design Element. The
preparation of a Downtown Specific Plan is recommended in said guidelines.
B. Pursuant to Government Code Section 65451,the Downtown Redding Specific Plan
includes all required text and diagrams.
C. Pursuant to Government Code Section 65454,the Downtown Redding Specific Plan
is consistent with the General Plan's goals and policies. The boundaries of said Specific Plan are
identified in Exhibit "A," attached hereto and incorporated herein by reference.
D. The Downtown Redding Specific Plan land use designations are consistent with the
balance of the General Plan.
E. The Downtown Redding Specific Plan is necessary to properly implement the goals
and policies of the General Plan.
F. The public necessity, convenience, and general welfare require adoption of the
Downtown Redding Specific Plan and proposed amendments to the zoning ordinance and zoning
district boundaries.
G. Negative Declaration has been prepared by the City of Redding that describes and
analyzes the significant effects of the Downtown Redding Specific Plan, including discussion of
ways to avoid the significant effects.
H. The Negative Declaration has been prepared pursuant to the California Environmental
Quality Act(CEQA)of 1970(California Public Resources Code Section 21000 et seq.),as amended,
and the State guidelines thereto(California Code of Regulation,Title 14, Section 15000 et seq.),as
amended, and the Environmental Review Procedures contained in the Redding Municipal Code
(Chapter 18.64), including circulation of the following documents to the public for comment and
review as follows:
1. Negative Declaration, including initial study, prepared, and circulated with
the Notice of Completion allowing public review from October 26,2000,until November 27,2000;
and
2. Notice of Availability was published by law on October 27,2000,and posted
for 30 days by the County Clerk on October 26, 2000.
I. The Redding Planning Commission held a formal public hearing on November 14,
2000, after providing all public notices required by State law and the Redding Municipal Code, at
which time all members of the public were provided an opportunity to comment on all related
environmental and planning documents submitted as required by law. At the meeting,the Planning
Commission reviewed the Downtown Redding Specific Plan and all environmental documents and,
following the public hearing, recommended that the City Council adopt the Downtown Redding
Specific Plan and Negative Declaration.
J. The City Council held a formal public hearing on January 16, 2001, after providing
all public notices required by State law and the Redding Municipal Code,at which time all members
of the public were provided an opportunity to comment on all related environmental and planning
documents submitted as required by law.
Section 2. Zoning Districts
The"Zoning Map of the City of Redding, California,"dated March 19, 1956, as amended,
is hereby altered as set forth on the map attached hereto and made a part hereof,and,as provided for
in Chapter 18.35 of the Redding Municipal Code, the "SP" Specific Plan Combining District is
hereby combined with the three new zoning districts created by the Downtown Redding Specific
Plan, as follows:
1. "CBD-SP," Central Business District
2. "UBD-SP," Uptown Business District
3. "SGD-SP," Southern Gateway District
The text of the three new zoning districts is set forth in the Downtown Redding Specific Plan
and is incorporated herein by reference.
Parcels outside the three new districts, but within the Specific Plan area, will retain their
current zoning and will be combined with the"SP"Specific Plan Combining District and the City's
Zoning Map shall be altered accordingly.
Section 3. Adoption of the Negative Declaration and Downtown Redding Specific Plan
1. Adoption of the Negative Declaration. The City Council does hereby find that:
a. The Negative Declaration is warranted and that there is not substantial
evidence that the Downtown Redding Specific Plan will have a significant effect on the
environment; and
b. Modifications made to the Downtown Redding Specific Plan subsequent to
publication of the Negative Declaration were minor in nature and do not introduce additional
environmental impacts not already addressed; and
c. The Negative Declaration and its supporting documentation reflect the
independent judgement and analysis of the City of Redding; and
d. The Negative Declaration is complete and adequate in addressing the
environmental effects of the Downtown Redding Specific Plan and has been completed in
compliance with the California Environmental Quality Act (CEQA) of 1970 (California Public
Resources Code Section 21000 et seq.), as amended, and the State guidelines thereto (California
Code of Regulations,Title 14, Section 15000 et seq.), as amended, and the Environmental Review
Procedures contained in the Redding Municipal Code (Chapter 18.64), and is hereby adopted.
2. Adoption of the Downtown Redding Specific Plan. The City Council does hereby
adopt the Downtown Redding Specific Plan.
Section 4. This ordinance shall take effect 30 days after the date of its adoption;and the City
Clerk shall certify to the adoption of this ordinance and cause its publication according to law.
I HEREBY CERTIFY that this ordinance was introduced and read at a regular meeting of
the City Council on the jr2thday of,Tantiary , 2001, and was read and adopted at a regular
meeting of the City Council on the 6th day of February , 2001, by the following vote:
