WHEREAS: A. On May 21, 2002, by Resolution 2002-81, the City Council approved the Report of the Engineer as filed relating to Landscape Maintenance District"C" (District), and gave notice of the time and place of the June 4, 2002, public hearing regarding the proposed annexation and the levy and collection of assessments for fiscal year 2002-2003. B. A diagram of the area encompassed by the District, including the subdivision proposed to be annexed in, individual maps, and summaries are attached and made a part hereof. C. The public hearing, duly and properly noticed, commenced at the City Council Chambers, 777 Cypress Avenue, Redding, California, on June 4, 2002, and was concluded prior to the adoption of this resolution. At the public hearing, the City Council gave every interested person an opportunity to object to the proposed annexation and assessments. D. All legal prerequisites to the adoption of this resolution have occurred. THEREFORE, THE CITY COUNCIL FINDS, RESOLVES, DETERMINES AND ORDERS AS FOLLOWS: 1. The matters set forth above are true and correct. 2. With respect to the additional territory proposed for annexation into Area 1 of Landscape Maintenance District"C,"namely the Churn Creek Park Subdivision: (a) The owner has filed its Petition and Consent to said inclusion; and waived the resolutions, engineer's report, notices of hearing, and the right of a majority protest with regard to the area proposed to be annexed as provided by Section 22608 of the Streets and Highways Code. (b) The real property proposed for annexation is situate in the City of Redding, Shasta County, California, and described as Lots 1-48 inclusive and Remaining Parcel R-1 of the Churn Creek Park Subdivision, as shown on the map recorded June 30, 2000, in Book 22 of Maps at page 58, Shasta County Records (APN 073-490-01 through 30; 073-500-01 through 18; and 073-500-19). (c) The City Council hereby orders the annexation of the Churn Creek Park Subdivision into Area 1 of Landscape Maintenance District "C" for the maintenance of landscaping, miscellaneous lighting, mulching, vandalism, repairs to the irrigation system, electric and oQ water charges, replacement of vegetation as necessary, removal of trimmings, rubbish, debris and other solid waste, the cleaning, sandblasting and painting of any walls and other improvements to remove or cover graffiti, administrative costs, and such other maintenance and incidental expenses set forth in Streets and Highways Code Sections 22526 and 22531, all as more particularly authorized pursuant to the Landscaping and Lighting Act of 1972. 3. The diagram of the assessment district contained in the Engineer's Report is confirmed. 4. The City Council has considered all oral statements and written protests or communications made or filed by interested persons at the public hearing of June 4, 2002, and expressly overrules any and all protests filed objecting to the proposed annexation and assessments to be levied in the District. 5. The City Council finds that the Engineer has fairly and properly apportioned the costs of the improvements to each lot/remaining parcel in the District (including the above subdivision annexed into Area 1) in proportion to the estimated benefits to be received by each lot/remaining parcel from the improvements. 6. An assessment of $7.46 against each lot/remaining parcel located within the District for fiscal year 2002-2003 is adopted and confirmed, except that an assessment shall not be levied on property owned by a federal or state governmental agency or another local agency. 7. The City Clerk shall forthwith transfer to the Auditor and the Assessor/Recorder of Shasta County a certified copy of this resolution and a certified copy of the assessment district diagram contained in the Engineer's Report for Landscape Maintenance District"C."
