HomeMy WebLinkAboutReso 2002-081 - LMD , RESOLUTION NO. 2002- (11/ LANDSCAPE MAINTENANCE DISTRICT"C" A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING APPROVING THE REPORT OF THE ENGINEER AS FILED; REDESIGNATING VARIOUS PARCELS CURRENTLY WITHIN AREAS 2, 3 AND 4; AND DECLARING ITS INTENTION TO: (1) ANNEX CHURN CREEK PARK SUBDIVISION INTO AREA 1;AND (2) LEVY AND COLLECT ASSESSMENTS FOR FISCAL YEAR 2002- 2003 PURSUANT TO THE LANDSCAPING AND LIGHTING ACT OF 1972, COMMENCING WITH SECTION 22500 OF THE STREETS AND HIGHWAYS CODE. WHEREAS: A. The City Council heretofore ordered the consolidated formation of Landscape Maintenance District"C"(District)under authority granted by the Landscaping and Lighting Act of 1972, as set forth in Part 2 of Division 15 of the Streets and Highways Code of the State of California. B. The purpose of the District is to provide maintenance to those landscaping improvements required within the public rights-of-way by the conditions of development approval of the subdivisions contained therein. C. In Areas 2, 3 and 4, certain parcels formerly known as R-1 or R-2 have been redesignated. D. No substantial changes in existing improvements are proposed for fiscal year 2002- 2003. E. The Engineer has filed his Report with the City Clerk pursuant to Streets and Highways Code Section 22565, et seq. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL THAT: 1. The Report of the Engineer, as filed, is hereby approved. 2. Within Area 2 of the District, all of that certain real property situate in the City of Redding, Shasta County, California, formerly designated as R-2, is now described as: (a) Lots 1-10 inclusive of the College Highlands Subdivision,Unit 3,Phase 1,as shown on the map recorded July 26, 2000, in Book 22 of Maps at page 61, Shasta County Records (APN 076-250-01 through 10); and (b) Lots 1-9 inclusive of the College Highlands Subdivision,Unit 3, Phase 2, as shown on the map recorded July 26, 2000, in Book 22 of Maps at page 61, Shasta County Records (APN 076-250-11 through 19). 3. Within Area 2 of the District, all of that certain real property situate in the City of Redding, Shasta County, California, formerly designated as R-1, is now described as: (a) Lots 1-17 inclusive of the College Highlands Subdivision,Unit 4,Phase 1,as shown on the map recorded July 26, 2000, in Book 22 of Maps at page 61, Shasta County Records (APN 076-250-30 through 46); and (b) Lots 1-10 inclusive of the College Highlands Subdivision,Unit 4,Phase 2,as shown on the map recorded July 26, 2000, in Book 22 of Maps at page 61, Shasta County Records (APN 076-250-20 through 29). 4. Within Area 3 of the District, all of that certain real property situate in the City of Redding, Shasta County, California, formerly designated as R-1, is now described as: (a) Lots 1-8 inclusive of the Forest Hills Estates Subdivision, Unit 3, as shown on the map recorded October 3, 2000, in Book 22 of Maps at page 67, Shasta County Records (APN 110-030-41 through 48); and (b) Lots 9-35 inclusive of the Forest Hills Estates Subdivision,Unit 4, as shown on the map recorded October 3, 2000, in Book 22 of Maps at page 67, Shasta County Records (APN 110-030-49 through 75). 5. It is the intention of the City Council to: (a) Annex Lots 1 through 48 and Remaining Parcel R-1 of the Churn Creek Park Subdivision into Area 1 of the District. The developer has signed a Petition and Consent for the annexation, and a waiver of the proceedings pursuant to Streets and Highways Code Section 22608. (b) Levy and collect assessments for fiscal year 2002-2003 equally amongst all the lots and remaining parcels that encompass the District,which lots and remaining parcels are more particularly described in the diagrams and location maps attached and made a part hereof, except that it shall not impose an assessment upon a federal or state governmental agency or another local agency. 6. The Report of the Engineer,on file with the City Clerk,contains a full and detailed description of the improvements,the boundaries of the District—including the area proposed to be annexed in—and any zones therein, and the proposed assessments upon the assessable lots and remaining parcels within the District. 7. The existing improvements for each subdivision in the District are set forth in attached Part G of the Engineer's Report under the column entitled "Landscape Description &Square Feet." 8. The general locations of the lots and remaining parcels in the District are set forth in attached Part G of the Engineer's Report under the column entitled "Access/Location." 9. No substantial changes in existing improvements are proposed for fiscal year 2002-2003. Only costs for the maintenance of landscaping,miscellaneous lighting,mulching,vandalism,repairs 2 to the irrigation system, electric and water charges, replacement of vegetation as necessary, removal of trimmings, rubbish, debris and other solid waste, the cleaning, sandblasting and painting of any walls and other improvements to remove or cover graffiti,administrative costs, and such other maintenance and incidental expenses as are authorized by Streets and Highways Code Sections 22526 and 22531, will be assessed. 10. A public hearing will be held on Tuesday, June 4, 2002, at the hour of 7:00 p.m., or as soon thereafter as the matter may be heard, in the City Council Chambers located at 777 Cypress Avenue, Redding,California,to address the proposed annexation of the additional territory into the District and the levy of the proposed assessment for fiscal year 2002-2003. The proposed assessment for fiscal year 2002-2003 of$7.46 is the same as last year's assessment.
