Code §6103 A.P.Nos. 050-420-024, 056 RESOLUTION NO. 2002- 3 7 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING SUMMARILY VACATING PORTIONS OF ROAD RIGHT-OF-WAY DEDICATED ON THE MAP OF TOBIASSON SUBDIVISION, UNIT 2, RECORDED IN BOOK 8 OF MAPS AT PAGE 13, SHASTA COUNTY RECORDS (SHOWN ON SAID MAP AS CUL-DE-SAC AT THE SOUTHWESTERLY END OF RIVERSIDE DRIVE,AKA ISLAND DRIVE) [A-4-011. WHEREAS: A. The areas proposed for vacation—dedicated to the County of Shasta as road for public use forever—and acquired by the City through annexation—are shown on the map of the Tobiasson Subdivision, Unit 2, recorded on October 8, 1952, in Book 8 of Maps at page 13, Shasta County Records, as part of a cul-de-sac at the southwesterly end of Riverside Drive (aka Island Drive). B. The street was to end at the cul-de-sac at that time; however, the cul-de-sac was never built, and the street now continues through and turns into Girvan Road, west of this area. C. The owners of the properties on which the cul-de-sac was dedicated have asked that the City vacate the areas described in Exhibits A-1 and A-2 and shown crosshatched on Exhibit B attached and made a part hereof by reference, as they have not been used for the purpose for which they were dedicated or acquired for five consecutive years immediately preceding the proposed vacation. D. The Engineering Division of the Development Services Department has advised the City Council that there are no in-place public utility facilities that are in use or would be affected by the proposed vacations, and that—subject to the City retaining the easements set forth in Exhibits A-1 and A-2--the areas proposed for vacation are not required as road for public use. NOW, THEREFORE, THE CITY COUNCIL DETERMINES, RESOLVES AND ORDERS AS FOLLOWS: 1. The City Council elects to proceed in this matter under the provisions of the Public Streets, Highways and Service Easements Vacation Law as set forth in Section 8333, et seq., of the Streets and Highways Code of the State of California. 2. The City Council approves the request to summarily vacate the areas described in Exhibits A-1 and A-2 and shown crosshatched on Exhibit B attached and made a part hereof, SUBJECT TO the City of Redding reserving and excepting therefrom the easements more particularly described in said Exhibits A-1 and A-2 and shown on Exhibit B, TOGETHER WITH THE RIGHT TO: (a) Grant said easements or a portion thereof to other public utilities or public agencies; (b) Review and control the planting, trimming, maintenance and/or removal of any trees or other plants within said easements; and (c) Enter upon said easements for the purpose of construction, replacement, maintenance and repair of pipelines and appurtenances. 3. The areas being vacated have not been used for the purpose for which they were dedicated or acquired for five consecutive years immediately preceding the proposed vacation; are not required; and there are no other public facilities located therein. Therefore, from and after the date this resolution is recorded, the areas hereby vacated—but not the easements set forth in paragraph 2 above being retained by the City—shall no longer constitute a road for public purposes. 4. The City Clerk is directed to cause a certified copy of this resolution of vacation, attested by the Clerk under seal, to be recorded in the office of the Shasta County Assessor/Recorder.
