A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING
AUTHORIZING PREPARATION OF A PROPOSED REDEVELOPMENT
PLAN AMENDMENT FOR THE MARKET STREET REDEVELOPMENT
PROJECT, DESIGNATING THE LEAD AND RESPONSIBLE
AGENCIES, AND AUTHORIZING STAFF AND CONSULTANTS TO
PROCEED WITH THE PLAN AMENDMENT PROCESS PURSUANT TO
THE CALIFORNIA COMMUNITY REDEVELOPMENT LAW
WHEREAS, the City Council of the City of Redding (the "City Council") adopted the
Redevelopment Plan for the Market Street Redevelopment Project by Ordinance No. 974 on July
3, 1968, as amended by Ordinance No. 1173 on August 5, 1974, as further amended by
Ordinance No. 1295 on November 19, 1976, as further amended on by Ordinance No. 1299 on
December 20, 1976, as further amended by Ordinance No. 1923 on July 17, 1990 (adding
territory), as further amended by Ordinance No. 2103 on December 20, 1994, as further amended
by Ordinance No. 2150 on June 4, 1996, and as further amended by Ordinance No. 2185 on
August 5, 1997 (collectively, the "Original Plan"); and
WHEREAS, the Original Plan established the Redevelopment Project Area (the "Project
Area") to be redeveloped in accordance with the provisions of the California Community
Redevelopment Law (the "CRL", Health and Safety Code Section 33000 et seq.); and
WHEREAS, staff of the Redding Redevelopment Agency (the "Agency") recommends
proceeding with an additional amendment to the Original Plan which would extend the Agency's
authority to commence eminent domain actions for twelve years as permitted under the CRL (the
"Proposed Amendment"); and
WHEREAS, Section 15050 of the California Environmental Quality Act Guidelines (the
"CEQA Guidelines") requires that when a project requiring an environmental review process be
carried out or approved by more than one public agency, one public agency shall be responsible
for preparing the environmental review documentation for the project. This agency shall be
called the Lead Agency; and
WHEREAS, the City of Redding (the "City") and the Agency are the public agencies
involved in the preparation and adoption of the Proposed Amendment for which environmental
review documentation shall be prepared, and both agencies have responsibilities related to
approving and carrying out the Proposed Amendment; and
WHEREAS, Section 15051 of the CEQA Guidelines provides that where two or more
public agencies have a substantial claim to be the Lead Agency, the public agencies may by
agreement designate one of the agencies as the Lead Agency; and

WHEREAS, the City is the legal entity with final authority to approve and adopt the
Proposed Amendment pursuant to the California Redevelopment Law, and therefore should
serve as the "Lead Agency," as defined in the CEQA Guidelines; and
WHEREAS, the Agency has less broadly-defined governmental powers than does the
City and therefore should serve as "Responsible Agency," as defined in the CEQA Guidelines;
and
WHEREAS, the City desires to proceed with the formal processing of the Proposed
Amendment.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Redding:
1. That the City hereby authorizes and directs its City Manager or his designee to
take all reasonable and necessary steps to effectuate adoption of the Proposed Amendment.
2. That the City hereby consents to its designation as the Lead Agency for purposes
of the preparation of environmental review documentation for the Proposed Amendment.
3. That the City acknowledges that the Agency shall serve as the "Responsible
Agency" in the preparation and consideration of the environmental review documents for the
Proposed Amendment.
4. That the City Council, as Lead Agency, hereby authorizes and directs staff to
distribute the environmental review documents for the Proposed Amendment to all affected
taxing entities and any other interested persons and entities as required by law.
I HEREBY CERTIFY that the foregoing resolution was introduced, read, and adopted
at a regular meeting of the City Council on the 19th day of February, 2002 by the
following vote:
