HomeMy WebLinkAboutReso 2002-022 - Records Destruction RESOLUTION NO. 2002- 2-7-- A vA RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING AUTHORIZING THE DESTRUCTION OF CERTAIN RECORDS IN THE CUSTODY OF THE REDDING POLICE DEPARTMENT. WHEREAS, the Chief of Police has recommended that certain records of the Redding Police Department, which have been retained for two or five years pursuant to Penal Code Section 832.5 and are not required to be kept by statute, should be destroyed; and WHEREAS, Section 34090 et seq. of the Government Code specifically provides that certain records may be destroyed, provided the written consent of the City Attorney has been obtained, and provided the City Council gives its approval of such destruction by resolution; and WHEREAS, the City Attorney has given his written consent hereunder to the destruction of said records; NOW, THEREFORE, BE IT RESOLVED by the City Council that the Chief of Police is hereby authorized to destroy records of the Redding Police Department that are two (2) or five (5) years old, which are identified in the attached Exhibit A. Nothing herein shall be deemed to authorize the destruction of any records which are specifically required to be kept by statute. Leonard Wingate, C Attorney 0 Exhibit A: REDDING POLICE DEPARTMENT RECORDS DESTRUCTION REQUEST Document Description Dates AVA AVA tags and registration printouts of vehicles tagged as abandoned on 1992 through Abandoned Ve- public and private property and the disposition of same. 1999 hide Abatement Tow Cases Records of vehicles towed by the Redding Police Department. Includes 1993 through registered owner notification receipts. (Original tow reports maintained 1999 in Records Division.) Overtime Cards Records of incidents of overtime worked by the employees of Redding 1996 through Police Department 1999 Pawn Slips Records of items of property sold, bought or pawned through second 1996 through hand dealers. 1999 Dead Cards Includes cards used to track time/location of traffic stops by officers 1991 through prior to CAD, and cards used by Records to take initial information 1998 from reporting persons at the front counter before relaying to the Telephone Response Unit or Shascom. Radio Cards Cards used to track calls for service and record the times involved in 1991 through the response prior to the implementation of CAD. 1995 Repossessed Paperwork forwarded to our agency by repossession companies and/or 1991 through Vehicle Notices lenders as follow-up to their phone call when the vehicle was repos- 1999 sessed. The teletype reflecting our entry of the vehicle into the California law enforcement system as repossessed and the vehicle registration information is attached. Citations For misdemeanors and infractions which would include traffic 1996 through violations,some municipal code violations,misdemeanor warrant cites 1999 and Jan to court,and misdemeanors such as possession of tobacco by a minor. 2000 to May (Misdemeanors being prosecuted by the DA are not included. The DA 2000 receives those copies.) The original copy of the citation is retained by the court. Document Description Dates Field Interview Cards filled out by officers in the field when making contact with 1990, 1995, Cards subjects under suspicious circumstances. This data is input into the 1996, 1998 computer system by the Investigation Department. and 1999 Front Counter Receipts given for monies received for fees charged for various 1996, 1998, 1999 Receipts services. For example, report requests, fingerprint services, vehicle and 2000 releases, etc. Copies of each receipt are forwarded daily to the City Treasurer and are retained in their records. E 9-1-1 Print- Printouts of calls received via 9-1-1 noting date and time of call and 1991, 1992, 1993 outs type of emergency. and 1994 EMS cards Cards used to track calls to Medcom for emergency medical services 1994 (Medcom radio and record the times involved in the response prior to the implementa- cards) tion of CAD. Monthly Arrest Computer printout of all arrests which occurred each month. Original 1988 through and Citation forwarded to DOJ. This information is accessible through Redding 1994 Register Police Department's computer system. Property Slips Record of property booked into Property and Evidence at the Redding 1973 through Police Department and its disposition. These records have been 1996 microfilmed.
