Code§6103 A.P.N.073-460-18 RESOLUTION NO. 2002- / 7 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING SUMMARILY VACATING THE 20-FOOT TEMPORARY SECONDARY EMERGENCY ACCESS EASEMENT SHOWN ON PARCEL 25 OF THE FAIRWAY ESTATES SUBDIVISION, S-14-90, UNIT 1, FILED 11-27-96 IN BOOK 21 OF MAPS AT PAGE 92, SHASTA COUNTY RECORDS (5908 LA QUINTA COURT; A-11-01). WHEREAS: A. The 20-foot temporary secondary emergency access easement proposed for abandonment on Parcel 25 of the Fairway Estates Subdivision, S-14-90, Unit 1, was dedicated to the City of Redding on the map recorded November 27, 1996, in Book 21 of Maps at page 92, Shasta County Records. B. The easement has been superseded by relocation; and the property owners have requested that the easement, more particularly described in Exhibit A and shown on Exhibit B attached and made a part hereof, be vacated. C. The Engineering Division of the Development Services Department has advised the City Council that there are no in-place public utility facilities that are in use or would be affected by the proposed vacation, and that the easement is not required as a temporary secondary emergency access easement. NOW, THEREFORE, THE CITY COUNCIL DETERMINES, RESOLVES AND ORDERS AS FOLLOWS: 1. The City Council elects to proceed in this matter under the provisions of the Public Streets, Highways and Service Easements Vacation Law as set forth in Section 8333, et seq., of the Streets and Highways Code of the State of California. 2. The City Council approves the request to summarily vacate the 20-foot temporary secondary emergency access easement described in Exhibit A and shown on Exhibit B. 3. The easement has been superseded by relocation, and there are no other public facilities located within the easement. Therefore, from and after the date this resolution is recorded, the 20-foot temporary easement hereby vacated shall no longer constitute a temporary secondary emergency access easement. 4. The City Clerk is directed to cause a certified copy of this resolution of vacation, attested by the Clerk under seal, to be recorded in the office of the Shasta County Assessor/Recorder.
