A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING
SUMMARILY VACATING AN EASEMENT FOR A PIPELINE FOR THE
TRANSPORTATION OF WATER, ROAD PURPOSES, AND OTHER
INCIDENTAL PURPOSES, ALONG THE NORTH 20' OF LOTS 1-4 OF
UNIT 1 OF THE SILVER CREEK ESTATES SUBDIVISION (A-7-01).
WHEREAS:
A. An easement for a pipeline or pipelines for the transportation of water, and for road
and other incidental purposes, was granted to the Enterprise Public Utility District in a Deed of
Right-of-Way recorded April 11, 1969, in Book 986 at page 630, Shasta County Records
(hereinafter referred to as the "Easement"). The Easement was acquired by the City of Redding
through annexation.
B. The Easement has been superseded by relocation. Therefore, the owners of Lots 1
through 4 of Unit 1 of the Silver Creek Estates Subdivision have asked that the City vacate the
Easement on the property more particularly described in Exhibit A and shown crosshatched on
Exhibit B attached and made a part hereof by reference.
C. The Engineering Division of the Development Services Department has advised the
City Council that there are no in-place public utility facilities that are in use or would be affected
by the proposed vacation, and that the Easement is not required for the transportation of water,
road purposes, or the other incidental purposes described in the Deed of Right-of-Way.
NOW, THEREFORE, THE CITY COUNCIL DETERMINES, RESOLVES AND
ORDERS AS FOLLOWS:
1. The City Council elects to proceed in this matter under the provisions of the Public
Streets, Highways and Service Easements Vacation Law as set forth in Section 8333, et
seq., of the Streets and Highways Code of the State of California.
2. The City Council approves the request to summarily vacate the Easement in its entirety,
as set forth in the Deed of Right-of-Way recorded April 11, 1969, in Book 986 at page
630, Shasta County Records, on the property described in Exhibit A and shown
crosshatched on Exhibit B attached hereto.
3. The Easement has been superseded by relocation, and there are no other public facilities
located within the Easement. Therefore, from and after the date this resolution is
recorded, the Easement shall be vacated in its entirety and shall no longer constitute an
Easement for (a) a pipeline or pipelines for the transportation of water, with right of
ingress and egress to and from the same; (b) the right to build, maintain and operate a
road on, over and through the property; or (c) the other incidental purposes described in
the Deed of Right-of-Way, including the right to convey sewage and waste materials in
connection with the operation of a sanitation system.
4. The City Clerk is directed to cause a certified copy of this resolution of vacation, attested
by the Clerk under seal, to be recorded in the office of the Shasta County
Assessor/Recorder.

a regular meeting of the City Council on the 15th day of January , 2002,by the following vote:

of Official Records at Page 630, Shasta county Records, and shown on that certain map
recorded in Book 19 of Maps at Page 72, Shasta County Records, lying within Lots 1,2,3,
&4 as shown on S-5-97 Silver Creek Unit 1 and recorded in Book 22 of Maps at Page
25, Shasta County Records, situate in the Northeast one-quarter of Section 16, Township
31 North, Range 4 West, M.D.M., City of Redding, County of Shasta, California, said
portion being more particularly described as follows:
The North 20.00 feet as measured at right angles to the North line of said Lots 1,2,3, &4
of Silver Creek Unit 1 as recorded in Book 22 of Maps at Page 25 Shasta County
Records.
