ZZ 4I/ AN ORDINANCE OF THE CITY OF REDDING AMENDING REDDING MUNICIPAL CODE CHAPTER 16.02 THROUGH 16.05(BUILDING CODE ADOPTION), AND REPEALING CHAPTER 16.16 (SWIMMING POOL BARRIERS) THE CITY COUNCIL OF THE CITY OF REDDING DOES ORDAIN AS FOLLOWS: Section 1. Findings of fact and need for changes or modifications to the 2001 State Building Standards Code because of local conditions. A. Changes or Modifications. Pursuant to Section 17958.5, 17958.7 and 18941.5 of the State of California Health and Safety Code, the City of Redding adopts and amends the 1997 edition of the Uniform Building,the 2000 edition of the Uniform Plumbing and Mechanical Codes and the 1999 National Electric Code and the 2001 State Building Standards Code as it pertains to the regulation of buildings and structures. A copy of the text of such changes or modifications is attached. B. Findings. Pursuant to Sections 17958.5, 17958.7,and 18941.5 ofthe State of California Health and Safety Code, the City of Redding has determined and finds the attached changes or modifications are needed and are reasonably necessary because of local climatic,geological,and topographic conditions. C. Local Conditions. Local conditions have an adverse effect on the potential for life and property loss,making necessary changes or modifications to the 2001 California State Building Standards Code in order to establish and maintain an environment which will provide the community a desirable level of protection. Below are listed adverse local climatic, geological, and topographic conditions: 1. Climatic. a. Precipitation. The normal rainfall for the City of Redding is approximately 33.6 inches annually. Winter storms are responsible for the heaviest intensity of precipitation,with two-thirds of the rain coming between December and March and 15 percent between April and June. The city typically experiences snow once or twice a year with depth of less than a foot. b. Temperature. Redding averages over 39 days a year with temperatures of 100 degrees or higher with some days exceeding 110 degrees. Winter temperatures occasionally dip below freezing at night. 2. Geological and Topographic. a. The City of Redding is located in Shasta County in Northern California. It is approximately 100 miles south of the Oregon border and 160 miles north of Sacramento. The City encompasses approximately 61 square miles, was founded in 1872, and incorporated in 1887. Much of the downtown area is comprised of construction dating back to the late 1800s and the early 1900s. Balloon framing, lack of proper draft and fire stopping, and lack of adequate exiting and fire-protections systems can lead to unsafe conditions for the occupants of such buildings. Soils conditions often consist of varying types of soils at different depths leading to saturated soil conditions during winter rains and underground migration of water at all times of the year. b. The City consists of flat lands, hills, valleys, and ridges. The flatter areas are found in the southeast portion of the City. Most of the existing commercial areas are on relatively flat land. Residential development is being constructed in the hill areas on the west and northeast of the City of Redding. The majority of the hills in these areas have sloping ranges from 15 to 30 percent. The steeper slopes, west and north of the City, are planned for open-space use. Elevations are varied within the City and may be 500 feet to 1,000 feet above sea level. D. Summary. The above local climatic, geological, and topographic conditions increase the potential for excessive water below building slabs. There is a history of problems due to water migration up through floor slabs and into the interior space of buildings in the area. Many of the buildings in the City were constructed prior to the adoption of a requirement to design for snow loads and subsequently do not currently meet structural requirements. As a result of this "findings of fact," which identifies the various climatic, geological, and topographical elements,the requirements established by the City of Redding within the adopted Redding City ordinances are considered "reasonable and necessary" based on the following: • Geographic and topographical conditions necessitate the control ofmoisture migration into buildings. • Climatic conditions and the existing built environment necessitate guidelines for re-roofing existing structures to provide adequate weather protection and avoid a weakening of existing structures. • There is a need to provide a reasonable degree of safety to persons occupying existing buildings that provide for alterations to such existing buildings that do not conform with minimum requirements of the current building codes. Conclusion Local climatic,geological,and topographic conditions impact the built environment and necessitate amendments to the California Building Standards Code. Page 2 Therefore,it is found to be reasonably necessary that the State Building Standards Code be changed or modified to mitigate the effects of the above conditions. Furthermore, California Health and Safety Code Section 17958.7 requires the modification or change be expressly marked and identified as to each finding to which it refers. Therefore, the City of Redding finds that the following table provides code sections that have been modified pursuant to the ordinance which are building standards as defined in the Health and Safety Code Section 18909 and the associated referenced conditions or modifications due to local climatic, geological, and topographical reasons: CBC SECTION No. LOCAL CLIMATIC,GEOLOGICAL,AND TOPOGRAPHICAL CONDITIONS 1402.6 l a, 2a, 2b Appendix Chapter 15 la, lb Appendix Chapter 34 2a Section 2. Chapter 16.02 (Building Code) of the Redding Municipal Code is amended to read as follows: 16.02.010 California Building Code adopted. A. That certain document, a copy of which is on file and open for inspection in the office of the City Clerk,marked and designated as"California Building Code(CBC),2001 Edition,Volumes 1, 2, and 3," published by the International Conference of Building Officials, including Appendix Chapters 15 and 34, and the generic fire-resistive assemblies listed in the Fire Resistance Design Manual,Fourteenth Edition, dated April 1994,published by the Gypsum Association(CBC tables 7-A,7-B,and 7-C); and Structural Welding Code-Reinforcing Steel,AWS D1.4-92(CBC Standard 19-1);Load and Resistance Factor Design Specifications for Structural Steel Buildings,December 1, 1993 (CBC Chapter 22,Division II); Specification for Structural Steel Buildings Allowable Stress Design and Plastic Design, June 1, 1989 (CBC Chapter 22, Division III); Load Resistance Factor Design Specification for Cold Formed Steel Structural Members, 1986, with December 1989 Addendum (CBC Chapter 22, Division VI); Specification for Design of Cold Formed Steel Structural Members, 1986(CBC Chapter 22,Division VH); Standard Specification for Steel Joists, K-Series,LH-Series,DLH-Series,and Joist Girders, 1994(CBC Chapter 22,Division IX);Structural Applications of Steel Cables for Buildings, ASCE 17-95 (CBC Chapter 22, Division XI); and National Design Specification for Wood Construction, Revised 1991 Edition (CBC Chapter 22, Division III, Part I), as modified or amended in the California Building Code referenced herein, except as specifically amended in this title,are adopted as the building code of the city for regulating the erection,construction,enlargement,alteration,repair,moving,removal,demolition,conversion, occupancy, equipment, use, height, area, and maintenance of all buildings or structures in the city and are included in and made a part of this code as though set forth at length herein. B. CBC Table I-A, Building Permit Fees, is deleted. C. CBC Sections 107.2 and 107.3 are amended as follows: 107.2 General. The fee for each permit shall be as set forth by resolution. The determination of value or valuation under any of the provision of this code shall be made by the Building Official. The value to be used in computing the building permit and building plan review fees shall be the total value of all construction work for which the permit is issued, as well Page 3 as all finish work,painting,roofing, electrical,plumbing, heating, air conditioning, elevators, fire- extinguishing systems, and any other permanent equipment. 107.3 Plan Review Fees. When submittal documents are required by Section 106.3.2, a plan review fee shall be paid at the time of submitting the submittal documents for plan review. Said plan review fee shall be as set forth by resolution. The plan review fees specified in this section are separate fees from the permit fees specified in Section 107.2 and are in addition to the permit fees. When submittal documents are incomplete or changed so as to require additional plan review or when the project involves deferred submittal items as defined in Section 106.3.4.2,an additional plan review fee shall be charged at the rate set forth by resolution. D. CBC Section107.2 is amended as follows: An investigation fee,in addition to the permit fee, shall be collected whether or not a permit is then or subsequently issued. The investigation fee shall be equal to the amount of the permit fee required by this code. The minimum investigation fee shall be the same as the minimum fee set forth by resolution. The payment of such investigation fee shall not exempt an applicant from compliance with all other provisions of either this code or the technical codes nor from the penalty prescribed by law. E. Add Section 1402.6 to CBC Chapter 14 as follows: 1402.6 Vapor Barrier. A vapor barrier consisting of 2" of clean sand over a layer of polyethylene sheeting over 4" of 3/4" gravel or crushed rock, or an approved alternate, shall be installed under all residential concrete slab floors. Exceptions: 1. Accessory buildings not used for human occupancy. 2. In situations where a floor covering is provided above an existing concrete slab as part of a conversion, the vapor barrier may be installed on top of the slab. F. CBC Section 3406.2 of Appendix 34 is replaced by the following: 3406.2 Application. Appendix 34 shall become applicable to an existing building which does not conform with the minimum requirements of the California Building Code whenever the Fire Marshal or the Building Official has determined that the building is an unsafe building as designated by Section 102 of the California Building Code or Section 103.4.5 of the California Fire Code. (Ord. 2246 § 2 (part), 1999) Section 3. Chapter 16.03(Mechanical Code)of the Redding Municipal Code, is amended to read as follows: 16.03.010 California Mechanical Code adopted. A. That certain document, a copy being on file and open for inspection in the office of the city clerk, marked and designated as "California Mechanical Code, 2001 Edition," published by the Page 4 International Association of Plumbing and Mechanical Officials,is adopted as the mechanical code of the city and is included in and made a part of this code as though set forth at length herein. B. As an amendment to the California Mechanical Code, Section 115 regarding fees is deleted from this code. (Ord. 2246 § 2 (part), 1999) Section 4. Chapter 16.04(Plumbing Code)of the Redding Municipal Code, is amended to read as follows: 16.04.010 California Plumbing Code adopted. A. That certain document, a copy of which is on file in the office of the city clerk, marked and designated "California Plumbing Code, Edition," published by the International Association of Plumbing and Mechanical Officials,except as hereafter specifically amended or changed,is adopted as the plumbing code of the city, and is included in and made a part of this code as though fully set forth at length herein. B. As an amendment to the California Plumbing Code, Section 103.4 regarding fees is deleted from this code. (Ord. 2246 § 2 (part), 1999) Section 5. Chapter 16.05(Electric Code)of the Redding Municipal Code, is amended to read as follows: 16.05.010 California Electrical Code adopted. That certain document, a copy being on file and open for inspection in the office of the city clerk,marked and designated"California Electrical Code,2001 Edition,"published by the National Fire Protection Association,except as hereafter specifically amended or changed, is adopted as the electrical code of the city,and is included in and made a part of this code as though set forth at length herein. (Ord. 2246 § 2 (part), 1999) 16.05.020 Service disconnection. The city may disconnect an electric meter and cease the service to an electrical consumer whenever the fire marshal of the city or the city building official determines that the structure being served constitutes a serious fire hazard,or public health hazard,or is otherwise dangerous for human occupancy. (Ord. 2246 § 2 (part), 1999) Section 6. Chapter 16.16(Swimming Pools)ofthe Redding Municipal Code, is deleted in entirety Section 7. The passage of this ordinance is not a 'project" according to the definition in the California Environmental Quality Act, and therefore is not subject to the provisions requiring environmental review. Section 8. This ordinance shall take effect 30 days after the date of its adoption, and the City Clerk shall certify the adoption thereof and cause its publication according to law.
