Code§6103 APN 103-070-035 / i i1 RESOLUTION NO. 2017-020 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING SUMMARILY VACATING A PORTION OF A PUBLIC OPEN SPACE EASEMENT WITHIN LOT 12 OF PALATINE HILL SUBDIVISION (ABANDONMENT APPLICATION A-2016-01315) WHEREAS: A. The portion of a Public Open Space Easement being considered for summary vacation was acquired by dedication with the recording of Palatine Hill Subdivision S-5-00 recorded on November 13, 2003 in Book 23 of Maps at Page 35, Shasta County Records. B. This portion of the Public Open Space Easement has not been used for the purpose for which it was originally dedicated and has been determined to be excess. Therefore, the owners of the property has asked that the City vacate said portion described in Exhibit "A" and shown hatched on Exhibit"B"attached and made a part hereof by reference. C. This summary vacation falls within the criteria of CEQA Section 15305 and it categorically exempt. NOW, THEREFORE, THE CITY COUNCIL FINDS, DECLARES AND RESOLVES AS FOLLOWS: 1. The City Council elects to proceed in this matter under the provisions of California Streets and Highways Code Sections 8300 et seq. C, C; 2. The City Council approves the request to summarily vacate the portion of the Public Open Space Easement described in Exhibit"A" and shown hatched on Exhibit"B." 3. This portion of the Public Open Space Easement has not been used for the purpose for which it was dedicated for five consecutive years immediately preceding this vacation and has been determined to be excess. 4. Pursuant to Streets and Highways Code §8324, the Council finds that the easement is unnecessary for present or prospective public use. 5. This proposed vacation would not result in any significant environmental impacts and falls within the criteria of a CEQA Section 15305 and is categorically exempt. 6. Pursuant to Streets and Highways Code §8325, the City Clerk is directed to record a certified copy of this resolution, attested by the Clerk under seal, in the office of the Shasta County Assessor/Recorder.
