RESOLUTION FOR EXCEPTION TO THE 180-DAY WAIT PERIOD
GC sections 7522.56 & 21224
WHEREAS, in compliance with Government Code section 7522.56 the Redding City Council
must provide Ca1PERS this certification resolution when hiring a retiree before 180 days has passed
since his or her retirement date; and
WHEREAS, Jon Oldham, CID# 5377968158, retired from the City of Redding in the position
of Environmental Compliance Manager, effective December 30, 2016; and
WHEREAS, section 7522.56 requires that post-retirement employment commence no earlier
than 180 days after the retirement date, which is June 28, 2017, without this certification resolution;
and
WHEREAS, section 7522.56 provides that this exception to the 180-day wait period shall not
apply if the retiree accepts any retirement-related incentive; and
WHEREAS, the Redding City Council, the City of Redding and Jon Oldham certify that Jon
Oldham has not and will not receive a Golden Handshake or any other retirement-related incentive;
and
WHEREAS, the Redding City Council hereby appoints Jon Oldham as an extra help retired
annuitant to perform certain duties of the Environmental Compliance Manager for the City of Redding
under Government Code section 21224, effective February 12, 2017; and
WHEREAS, the entire employment agreement, contract or appointment document between
Jon Oldham and the City of Redding has been reviewed by this body and is attached herein; and
WHEREAS, no matters, issues, terms or conditions related to this employment and
appointment have been or will be placed on a consent calendar; and
WHEREAS, the employment shall be limited to 350 hours per fiscal year; and �+J

WHEREAS, the compensation paid to retirees cannot be less than the minimum nor exceed the -_1
maximum monthly base salary paid to other employees performing comparable duties, divided by `
173.333 to equal the hourly rate; and C'

WHEREAS, the maximum base salary for this position is $8,737 and the hourly equivalent is
$50.41, and the minimum base salary for this position is $5,507 and the hourly equivalent is $31.78;
and
WHEREAS, the hourly rate paid to Jon Oldham will be $50.41; and
WHEREAS, Jon Oldham has not and will not receive any other benefit, incentive,
compensation in lieu of benefit or other form of compensation in addition to this hourly pay rate; and
THEREFORE, BE IT RESOLVED THAT the Redding City Council hereby certifies the
nature of the appointment of Jon Oldham as described herein and detailed in the attached employment
agreement/contract/appointment document and that this appointment is necessary to fill a critically
needed role of Environmental Compliance Manager for the City of Redding only to assist with special
compliance work for the Public Works Department. Mr. Oldham will be working on the special work
including 1) the environmental compliance and related conservation parcel impacts of proposed
development within the Stillwater Business Park, 2) the City's environmental compliance coordination
with the Bureau of Indian Affairs processing of a National Environmental Policy Act Environmental
Impact Statement for the Redding Rancheria's fee to trust and hotel/casino project in South Redding,
and 3) standards development and environmental compliance associated with National Pollutant
Discharge Elimination System (NPDES) municipal separate storm sewer systems (MS4) permit
compliance related to City owned un-paved utility access roads. Although Mr. Oldham will be
assigned the title of Environmental Compliance Manager, he will not be assuming all of the roles and
responsibilities of that position. The full-time position of Environmental Compliance Manager was
filled by an incumbent on December 19, 2016.
I HEREBY CERTIFY that the foregoing resolution was introduced, read and adopted at a regular
meeting of the City Council on the 7th day of February, 2017,by the following vote:
