Code§6103 A.P.N. 113-330-013 RESOLUTION NO. 2017-002 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING SUMMARILY VACATING FIVE PUBLIC SERVICE EASEMENTS GRANTED TO THE CITY OF REDDING WITHIN PARCEL 2 OF PARCEL MAP PM-1-00 RECORDED IN BOOK 33 OF PARCEL MAPS AT PAGE 53, SHASTA COUNTY RECORDS. (A-2016-00113) WHEREAS: A. These five public utility easements were dedicated to the City of Redding by Easement Grant Deeds recorded March 12, 1965 in Book 827 of Official Records at Page 228 and March 19, 1965 in Book 828 of Official Records at Page 422 and by Parcel Map Lot Split No. 17-78 filed May 3, 1978 in Book 14 of Parcel maps, Page 151, Shasta County Records (hereafter called the Easements). B. The owners of Parcel 2 have asked that the City vacate the Easements, described in Exhibit A and shown on Exhibit B, attached and made a part hereof by reference. C. The Engineering Division of the Development Services Department has advised the City Council that there are no in-place public utility facilities that are in use or would be affected by the proposed vacation, and that the Easements, described in Exhibit A and shown on Exhibit B, are not required for public use. NOW, THEREFORE, THE CITY COUNCIL DETERMINES, RESOLVES AND ORDERS AS FOLLOWS: 1. The City Council elects to proceed in this matter under the provisions of the California Streets and Highways Code, Section 8333. • .s. 2. The City Council approves the request to summarily vacate five public service easements within Parcel 2 of Parcel Map PM-1-00 recorded on May 30, 2000 in Book 33 of Parcel Maps at Page 53: a. 10' Utility Easement by Easement Grant Deed recorded March 12, 1965 in Book 827 of Official Records at Page 228. b. 10' Utility Easement by Easement Grant Deed recorded March 19, 1965 in Book 828 of Official Records at Page 422. c. 7.5' Public Utility Easement by Parcel Map Lot Split No. 17-78, recorded on May 3, 1978 in Book 14 of Parcel Maps at Page 151. d. 10' Public Utility Easement by Parcel Map Lot Split No. 17-78. e. 5' x 25' Anchor Easement by Parcel Map Lot Split No. 17-78. 3. The easements being vacated are not required; and there are no public facilities located therein. Therefore, from and after the date this resolution is recorded, the public utility easements, described in Exhibit A and shown on Exhibit B, shall be vacated in their entirety and no longer constitute easements for public service purposes. 4. The City Clerk is directed to cause a certified copy of this resolution of vacation, attested by the Clerk under seal, to be recorded in the office of the Shasta County Assessor/Recorder.
