HomeMy WebLinkAboutMinutes - City Council - 2016-11-15141 Redding City Council, Regular Meeting Civic Center Council Chambers 777 Cypress Avenue Redding, CA 96001 November 15, 2016, 6:00 PM The meeting was called to order by Mayor Missy McArthur with the following Council Members present: Gary Cadd, Kristen Schreder, Francie Sullivan, and Brent Weaver. Also present were: City Manager Kurt Starman, City Attorney Barry E. DeWalt, Deputy City Manager Greg Clark, Public Works Director Brian Crane, Personnel Director Sheri DeMaagd, City Clerk Pamela Mize, and Executive Assistant Sharlene Tipton. The City Manager introduced Department Directors that were in attendance: Fire Chief Gerry Gray, Finance Director Dennice Maxwell, Community Services Director Kimberly Niemer, Information Technology Director Tony Van Boekel, City Treasurer Allyn Feci Van Hooser, and Development Services Director Larry Vaupel. The Pledge of Allegiance to the Flag was led by Mitchell Caranci. The Invocation was provided by Dr. Art Tilles, Temple Beth Israel. At Mayor McArthur's request, Keith Papini and Sheila Koester provided a detailed flyer, incorporated herein by reference, and spoke on behalf of missing Sheri Papini and asked for her safe return. Mayor McArthur and each of the Council Members expressed their acceptance of all people, regardless of race, ethnicity, religion, or political views and opined that they stand united against intolerance within the community. ----------------------------------------------------------------------------------------------------- PRESENTATION 2A. Mayor's Proclamation presented to Shasta Regional Community Foundation (SRCF) Chief Executive Officer Kerry Caranci declaring November 29, 2016, as Northstate Giving Tuesday in the City of Redding, and recognizing SRCF as the event coordinator for participating nonprofit organizations. [A-050-060-600] The City took no action on this informational item. Approve Minutes —Regular Meeting of November 1, 2016. [A-050-060] 4(b). Approve Payroll and Accounts Payable Register [A-050-100-500] Approve: (1) Accounts Payable Register No. 9 for the period of November 1, 2016, through November 11, for a total of $4,698,595.93 for check numbers 120331 through 120727, inclusive, ACH Transfer numbers 13079 through 13093, inclusive, and Wire Transfer numbers 6578 through 6593, inclusive; and (2) Payroll Register No. 10 for the period of October 23, 2016, through November 5, 2016, in the amount of $3,042,055.29, for electronic deposit transaction numbers 426755 through 427642, inclusive, and check numbers 602508 through 602533, inclusive; SUMMARY TOTAL: $7,740,651.22 11/15/2016 142 4(c). Adopt Ordinance No. 2557, an ordinance of the City Council of the City of Redding adopting an addendum to the Mitigated Negative Declaration prepared for the City of Redding Zoning Map and amendment to the City of Redding Zoning Map relating to the rezoning of the Riverway Villas Subdivision property (Assessors Parcel Number 050-330-022) consisting of 4.16 acres located at 2375 Star Drive in the City of Redding (RZ-2016-000368). Adopt Ordinance No. 2558, an ordinance of the City Council of the City of Redding, amending Redding Municipal Code Title 16 (Buildings and Construction), Chapter 16.02 (Building Code) by amending Section 16.020.010; Chapter 16.03 (Residential Code) by amending Section 16.03.010; Chapter 16.04 (Mechanical Code) by amending Section 16.040.010; Chapter 16.05 (Plumbing Code) by amending Section 16.050.010; Chapter 16.06 (Electrical Code) by amending Section 16.06.010; Chapter 16.07 (Energy Code) by amending Section 16.07.010; Chapter 16.08 (Green Building Code) by amending Section 16.08.010 and making findings of facts relating to local climatic, geological, and topographic conditions, all relating to adoption of the 2016 California Building Standards Code. Adopt Ordinance No. 2559, an ordinance of the City Council of the City of Redding, amending Redding Municipal Code Title 9 (Health and Safety) to repeal and reenact Chapter 9.20 (Fire Prevention). [C-110-275] 4.11(a).Authorize the Public Works Director and the Electric Director to jointly sign a letter to the Bureau of Reclamation supporting Alternative 2 in the "Long -Term Plan to Protect Adult Salmon in the Lower Klamath River; Draft Environmental Impact Statement." PUBLIC HEARINGS. PETITIONS. AND PROTESTS 6.1. Public Hearing - Regarding Proposed Monthly Rate Increases for the Water, Wastewater, and Solid Waste Utilities [S -101 -150/C -110-100/L-010] Public Works Director Crane summarized the Report to Redding City Council (staff report), incorporated herein by reference. The hour of 6:00 p.m. having arrived, Mayor McArthur opened the public hearing to consider the proposed monthly rate increases for the Water, Wastewater, and Solid Waste Utilities. The Affidavit of Publication — Notice of Public Hearing is on file in the Office of the City Clerk. 11/15/2016 143 The following spoke in opposition to the rate increases: Thomas Wiebelhaus, Dale Hillman, and Carol Lowe. Mayor McArthur determined that no one else present wished to address this matter. A MOTION WAS MADE by Council Member Weaver, seconded by Council Member Sullivan, to continue the public hearing regarding proposed monthly rate increases for the Water, Wastewater, and Solid Waste Utilities to 6:00 p.m., Thursday, December 15, 2016. The Vote: Unanimous Ayes. APPOINTMENTS 7.1. Appointment to Shasta Public Library Citizen's Advisory Committee [B-080-600-244] City Manager Starman summarized the Report to Redding City Council (staff report), incorporated herein by reference, and relayed Mayor McArthur's recommendation. A MOTION WAS MADE by Council Member Schreder, seconded by Council Member Sullivan, to appoint Scott Lyons to the Shasta Public Library Citizen's Advisory Committee to serve a four-year term from December 1, 2016 through November 30, 2020, as Janet Albright completed her term of service. The Vote: Unanimous Ayes 7.2. Appointment to Board of Appeals [B-080-050] City Manager Starman summarized the Report to Redding City Council (staff report), incorporated herein by reference, and relayed Mayor McArthur's recommendation. A MOTION WAS MADE by Council Member Sullivan, seconded by Council Member Weaver, to appoint Lynne Wonacott to the Board of Appeals to fill an unexpired term vacancy created by the resignation of Brent Day, ending January 1, 2019. The Vote: Unanimous Ayes. 7.3. Appointment to Community Development Advisory Committee [B-080-600-100] City Manager Starman summarized the Report to Redding City Council (staff report), incorporated herein by reference, and relayed Mayor McArthur's recommendations. A MOTION WAS MADE by Council Member Schreder, seconded by Council Member Sullivan, to appoint Leona McCoach, Jake Mangas, and Theresa Muth to the Community Development Advisory Committee to serve three-year terms from December 1, 2016, to November 30, 2019. Brad Williams, Walt Swift, and Julie Winter completed their terms of service. The Vote: Unanimous Ayes. REGULAR CALENDAR: REPORTS & COMMUNICATIONS OF DEPARTMENTS, BOARDS, COMMISSIONS AND COMMITTEES 9A. Resolution - Amending the Executive Management Pay -For -Performance Salary Plan for Classifications of Director of Community Services and Director of Finance [P-100-050-100] Personnel Director DeMaagd highlighted the Report to Redding City Council (staff report), incorporated herein by reference. The following spoke in opposition to increasing employee wages: Jason Fielding, Monica Frere, and Bob Reitenbach. A discussion amongst the Council ensued. 11/15/2016 1 144 A MOTION WAS MADE by Council Member Schreder, seconded by Council Member Sullivan, to adopt Resolution No. 2016-120, a resolution of the City Council of the City of Redding amending the Executive Management Pay -For -Performance Salary Plan as follows: (1) increase the monthly salary range for the classification of Director of Community Services from $10,789 to $11,789; and (2) increase the monthly salary range for the classification of Director of Finance from $10,275 to $10,775. The Vote: AYES: Council Members — Schreder, Sullivan, and McArthur NOES: Council Members — Cadd and Weaver ABSTAIN: Council Members — None ABSENT: Council Members — None Resolution No. 2016-120 is on file in the Office of the City Clerk. 9.2(a). Annual Report by Shasta Cascade Wonderland Association (SCWA) on Tourism Activity [B-130-030-700] Deputy City Manager Clark summarized the Report to Redding City Council (staff report), incorporated herein by reference. SCWA General Manager Laurie Baker provided a PowerPoint presentation, incorporated herein by reference, relating to the operation of the Redding Convention and Visitors Bureau under a Service Agreement (C-5348) with the City. A discussion amongst the Council ensued. A MOTION WAS MADE by Council Member Weaver, seconded by Council Member Cadd, to accept the Annual Report by the Shasta Cascade Wonderland Association and the accompanying presentation from its General Manager Laurie Baker relating to the operation of the Redding Convention and Visitors Bureau under a Service Agreement with the City. The Vote: Unanimous Ayes. 9.5(a). Electric Utility's Monthly Financial Report and Industry Update for September [B-130-070] Assistant Electric Utility Director Mark Haddad provided an overview of the Report to Redding City Council (staff report), incorporated herein by reference. Council Member Weaver, Council liaison to the Redding Electric Utility (REU), opined that REU is looked upon as a regional leader by the members of the Northern California Power Agency. A MOTION WAS MADE by Council Member Weaver, seconded by Council Member Sullivan, to accept the Redding Electric Utility Monthly Financial Report and Industry Update for September 2016. The Vote: Unanimous Ayes. 9.10(a).General Fund Monthly Financial Report for September [B-130-070] Finance Director Maxwell summarized the Report to Redding City Council (staff report), incorporated herein by reference. A MOTION WAS MADE by Council Member Schreder, seconded by Council Member Sullivan, to accept the General Fund Monthly Financial Report for September 2016. The Vote: Unanimous Ayes. 9.11(b).MOVED FROM CONSENT CALENDAR ITEM 4.11(b) AT THE REQUEST OF THE PUBLIC WORKS DIRECTOR Subdivision Agreement - with S&J Development, Inc., and Final Map - Shastina Ranch Subdivision, Unit 3, (S-7-03) [S-101-057] Public Works Director Crane provided an overview of the Report to Redding City Council (staff report), incorporated herein by reference. 11/15/2016 145 Mr. Crane noted that the developer has submitted a subdivision agreement and related security in the amount of $17,200 for the remaining work to be done, which is less than the stated amount of $29,154 included in the staff report, and recommended that the City Council approve the updated security amount. A MOTION WAS MADE by Council Member Schreder, seconded by Council Member Sullivan, to: (1) authorize the Mayor to execute a subdivision agreement with S&J Development, Inc. with a related security provided in the amount of $17,200 for the remaining work; (2) approve the final map for Shastina Ranch Subdivision, Unit 3, (S-7-03); and (3) instruct the City Clerk to file the map with the Shasta County Recorder. The Vote: Unanimous Ayes. 9.15(a).Ordinance No. 2555 - Amending the City's Contract with the California Public Employees Retirement System Relating to the Redding Peace Officers' Association [P -100-230/P-100-050-120] Personnel Director DeMaagd provided an overview of the Report to Redding City Council (staff report), incorporated herein by reference. A MOTION WAS MADE by Council Member Weaver, seconded by Council Member Schreder, to adopt Ordinance No. 2555, an uncodified ordinance of the City of Redding authorizing an amendment to the contract between the City Council of the City of Redding and the Board of Administration of the California Public Employees' Retirement System as allowed in Section 20516 of the Public Employees' Retirement Law (Employees Sharing Additional Cost) for Redding Peace Officers' Association covered employees. The Vote: AYES: Council Members — Cadd, Schreder, Sullivan, Weaver, and McArthur NOES: Council Members — None ABSTAIN: Council Members — None ABSENT: Council Members — None Ordinance No. 2555 is on file in the Office of the City Clerk. PUBLIC COMMENT [S -070 -285/A -050-060/R-010] Danielle Stern requested that sidewalk be installed along Boulder Drive to assist with a safer path of travel to the Redding Area Bus Authority bus stop. [A-030-070] Mr. Sharma requested the opportunity to operate the Americana Lodge. [A-050-060] Linda Johnson requested that the Council consider: (1) putting public comments back at beginning of meeting; (2) re-establishing the Redding Electric Utility Citizens Committee; and (3) the City's unfunded liabilities before authorizing employee wage increases. POTENTIAL TOPICS FOR FUTURE CITY COUNCIL MEETINGS [A-050-060] At Vice Mayor Weaver's suggestion, the City Council agreed to have Sara Hall, a local award winning runner, recognized at a future City Council meeting. [P-150-150] At Vice Mayor Weaver's suggestion, the City Council authorized the Vice Mayor to meet with the Police Chief, City Manager, and Redding Peace Officers Association Board Members, to discuss ways to utilize lower wage staff to assist the Police Department in light of the defeat of Ballot Measure D. [A-050-060] Council Member Sullivan invited community members to join her on monthly civic walks around the City, with the first walk to occur on December 1, 2016, at 7:00 a.m., with Fire Chief Gray and others in the Downtown area. 11/15/2016 146 [P-150-150] At Mayor McA thur's suggestion, Council agreed to direct staff' to return to a Council meeting in January during open session with an update on the status of the Redding Police Department utilizing body cameras. CLOSED SESSION City Manager Starman noted that two letters have been received from each of the parties interested in purchasing the former police facility located on California Street, The McConnell Foundation and Equity Streams LLC, requesting to postpone discussions in closed session at this time. A MOTION WAS MADE by Council Member Cadd, seconded by Council Member Schreder, to table discussions for both the Closed Session items 13A and 13B to the next regular City Council Meeting to be held on December 6, 2016.
