Also present were: City Manager Kurt Starman, City Attorney Barry E. DeWalt, Assistant City Manager/Electric Utility Director Barry Tippin, Deputy City Manager Greg Clark, Development Services Director Larry Vaupel, Personnel Director Sheri DeMaagd, City Clerk Pamela Mize, and Executive Assistant Sharlene Tipton. The City Manager introduced Department Directors that were in attendance: Information Technology Director Dave Allen, Public Works Director Brian Crane, Fire Chief Gerry Gray, Finance Director Dennice Maxwell, Community Services Director Kim Niemer, Police Chief Robert Paoletti, and City Treasurer Allyn Van Hooser. The Pledge of Allegiance to the Flag was led by Planning Manager Paul Hellman. The Invocation was provided by Police Chief Paoletti. PRESENTATIO 2A. Mayor's Proclamation presented to Rachelle Modena on behalf of the Child Abuse Prevention Coordinating Council proclaiming April 2016 as Child Abuse Prevention Awareness Month in the City of Redding. [A-050-060-600] The City Council took no action on this informational item. 2B. Presentation of Shasta Mosquito & Vector Control District's 2015 Annual Report by Peter Bonkrude, District Manager; and Presentation of Mayor's Proclamation to Mr. Bonkrude declaring April 17-23, 2016, as West Nile Virus and Mosquito and Vector Control Awareness Week in the City of Redding. [B-080-480] The City Council took no action on this informational item. 2C. Presentation by Volunteer Services Coordinator Kristy Lanham regarding the City of Redding's Volunteer Program in recognition of National Volunteer Appreciation Week in the City of Redding. [P-100-060-850] The City Council took no action on this informational item. 2D. Presentation by the Shasta County District Attorney's Office regarding the Redding Inn [A-050-060] Chief Deputy District Attorney Stephanie Bridgette and Deputy District Attorney Lucky Jesrani provided a PowerPoint presentation, incorporated herein by reference, summarizing the Final Judgement terms and implications that included compliance requirements and monetary terms imposed upon the owner's of the Redding Inn, which had become dilapidated and resulted in high calls for service from local law enforcement agencies. Police Chief Paoletti provided a brief overview of the success of the newly implemented Neighborhood Police Unit and will have more details at the next Council meeting. The City Council took no action on this informational item. 04/05/2016 41 CONSENT CALENDAR The following matters were considered inclusively under the Consent Calendar and each Report to Redding City Council (staff report) is incorporated herein by reference: 4(a). Approve Minutes — Regular Meeting of March 15, 2016. [A-050-060] 4(b). Approve Payroll and Accounts Payable Register. [A-050-100-500] Approve: (1) Accounts Payable Register No. 18 for the period of March 12, 2016, through March 31, 2016, for a total of $13,211,897.48, for check numbers 113602 through 114215, inclusive, ACH Transfer numbers 12567 through 12620, inclusive, and Wire Transfer numbers 6120 through 6145, inclusive; (2) Payroll Register No. 19 for the period of February 28, 2016, through March 12, 2016, in the amount of $2,649,389.11, for electronic deposit transaction numbers 411095 through 411949, inclusive, and check numbers 601773 through 601797, inclusive; and (3) Payroll Register No. 20 for the period of March 13, 2016, through March 26, 2016, in the amount of $2,733,550.01, for electronic deposit transaction numbers 411950 through 412798, inclusive, and check numbers 601798 through 601848, inclusive SUMMARY TOTAL: $18,594,836.60. 4(c). Accept the Project Status Report for March 2016. [A-050-080] 4.2(a). Accept the U.S. Department of Housing and Urban Development's mandated Analysis of Impediments to Fair Housing Choice. [H -150/G-100-030-1501 Council Member Schreder recalled that at the Housing Authority's meeting on March 21, 2016, it was determined that staff would review the recommended actions provided by the consultant, BAE Urban Economics, and report back to the Board by the end of the calendar year. 4.2(b). Affirm a position supporting Senate Bill 820, which would make permanent the California Land Reuse and Revitalization Act of 2004. [L-040-300] 4.2(c). REMOVED FROM THE AGENDA AT THE REQUEST OF THE DEPUTY CITY MANAGER Authorize the Mayor to send a letter to legislators opposing Assembly Bill 1707, which would place significant burdens on cities to comply with California Public Records Act requests. [L-040-300] 4.5(a). Reject the sole bid received in response to the Request for Proposal No. 4779, for the engineering and fabrication of a Unit 5 steam superheater at the Redding Power Plant, pursuant to Public Contract Code 20166. [ B -050-100/E-120-150] 4.5(b). Adopt Resolution No. 2016-031, a resolution of the City Council of the City of Redding approving and adopting the 27th Amendment to City Budget Resolution No. 2015-057 appropriating $107,300 for the completion of the system upgrade projects to the Unit 9 Automatic Voltage Regulator and the Unit 3 Control System. [B -130-070/E-120-150] 4.5(c). Affirm an "Oppose Unless Amended" position for Assembly Bill 2339, which proposes to increase the net energy metering (NEM) cap for publicly -owned utilities without consideration of the impacts to non -NEM customers. [L-040-300] 04/05/2016 42 4.9(a). Authorize the following action relative to purchase of two vehicles for sexual assault investigators from Sexual Assault Felony Enforcement Team funding, representing 75 percent of one vehicle and 50 percent of the second vehicle: (1) acceptance of approximately $50,000 in grant funds; and (2) adopt Resolution No. 2016-032, a resolution of the City Council of the City of Redding approving and adopting the 28th Amendment to City Budget Resolution No. 2015-057 appropriating $80,000 for said purchases. [G -100 -170B -130-070/P-150-150] 4.11(a).Authorize the following action relative to Bid Schedule No. 4766, Layton Lift Station Replacement Project: (1) award the project to MDS Engineering, Inc. in the amount of $1,729,943; (2) approve an additional $200,000 to cover the cost of contract administration and inspection fees; (3) approve $173,000 to provide construction contingency funding; and (4) authorize the City Manager to approve additional increases, in either the construction management or construction contingency amounts, up to a total of $15,000, for a grand total of $2,117,943. [B -050-020/W-020-560] 4.11(b).Approve the following: (1) the Consent to Sublease Agreement (C-1256) between the City of Redding, Benton Hangar Association, David Everson, and James Ostrich for Hangar Space A-1 at Benton Airpark; (2) authorize the Airports Manager to execute the Agreement; and (3) authorize the Airports Manager to execute future Consent to Sublease Agreements relative to Master Ground Lease (C-1256) with the Benton Hangar Association. [C -070-100/A-090-020] 4.11(d).Approve: (1) Lease Agreement (C-6846) with CGI Technical Services, Inc. for Executive Hangar No. 1 at Redding Municipal Airport for the period of April 6, 2016, through March 31, 2019, at an initial rate of $700 per month, with a three (3) percent annual escalation, and a $1,400 security deposit; and (2) authorize the Mayor to execute the agreement. [C -070-100/A-090-100] 4.11(e).Authorize and approve the following to provide additional exit lane monitoring services at the Redding Municipal Airport: (1) the Third Amendment to Consulting and Professional Services Agreement (C-6022) with North State Security; (2) the Mayor to execute the Amendment; and (3) the City Manager, or designee, to execute future Amendments to the Agreement. [B -050-100/A-090-1001 4.12(a).Adopt Resolution No. 2016-033, a resolution of the City Council of the City of Redding rescinding Resolution Nos. 2007-200 and 2014-117 and adopting a new City of Redding Records Retention Schedule (Schedule) for City records and authorizing the City Clerk, in cooperation with the City Attorney, to amend the Schedule as necessary to ensure compliance with regulatory requirements and to destroy records which have met legal retention requirements. Informational report regarding Redding Municipal Code Title 7 (Animals), Chapter 7.08 pertaining to bees in the City of Redding [A -130/C-110-100] City Manager Starman highlighted the Report to Redding City Council (staff report), incorporated herein by reference, and recommended that the City Council accept an informational report regarding Chapter 7.08 of the Redding Municipal Code (RMC) pertaining to bees and provide additional direction to staff, if necessary. Glenda Wooten, commercial beekeeper and owner of Wootens Golden Queens, spoke in support of relaxing regulations on keeping bees within the City limits, and provided handouts to the City Council, incorporated herein by reference. Steve Handy supported relaxing restrictions and provided a handout, incorporated herein by reference. A discussion amongst the Council ensued. A MOTION WAS MADE by Council Member Sullivan, seconded by Council Member Cadd, to explore the possibility of relaxing the restrictions set forth in Title 7 (Animals), Chapter 7.08 (Bees) of the Redding Municipal Code (RMC) and referred the matter to the City's Planning Department for additional analysis. The Vote: Unanimous Ayes. 9.2(d). Oral Report on Public Relations/Communications Consultant Services and Instaaram Project [P-145] Deputy City Manager Clark summarized the Report to Redding City Council (staff report), incorporated herein by reference, and recommended that the City Council accept an oral presentation on the City's utilization of Optimize Worldwide to provide public relations/communications services and an update on the status of the City's Instagram social media project. Matt Morgan, Chief Executive Officer of Optimize Worldwide, provided a PowerPoint presentation, incorporated herein by reference, and highlighted the improvements to the City's social media accounts that include Instagram and Facebook. Vice Mayor Weaver expressed enthusiasm that the social media platforms all complement each other and is optimistic that this will be a great partnership. The City Council took no action on this informational item. 9.15(a).Resolution approving Memorandum of Understanding (C-6179) with United Public Employees of California Local 792 Technical Employees Unit with a term ending December 31, 2017 [P-100-050-170] Personnel Director Sheri DeMaagd provided an overview of the Report to Redding City Council (staff report), incorporated herein by reference, and recommended that the City Council adopt a resolution approving the Memorandum of Understanding with United Public Employees of California Local 792 Technical Employees Unit for a two -and -one -half-year term ending December 31, 2017. A MOTION WAS MADE by Council Member Weaver, seconded by Council Member Sullivan, to adopt Resolution No. 2016-034, a resolution of the City Council of the City of Redding approving and adopting the Memorandum of Understanding (C-6179) with United Public Employees of California Local 792 Technical Employees Unit for a two -and -one -half-year term ending December 31, 2017. The Vote: AYES: Council Members — Cadd, Schreder, Sullivan, Weaver, and McArthur NOES: Council Members — None ABSTAIN: Council Members - None ABSENT: Council Members — None 04/05/2016 44 Resolution No. 2016-034 is on file in the Office of the City Clerk. 9.15(b).Resolution approving Memorandum of Understanding (C-3244) with Redding Independent Employees' Organization - Clerical, Technical & Professional Employees' Unit with a term ending June 30, 2016 [P -100-050-127/P-100-230] Personnel Director DeMaagd summarized the Report to Redding City Council (staff report), incorporated herein by reference, and recommended that the City Council: (1) adopt a resolution approving the Memorandum of Understanding (C-3244) with Redding Independent Employees' Organization (RIEO) — Clerical, Technical and Professional Employees' Unit, effective April 5, 2016, with a term ending June 30, 2016; and (2) adopt a resolution pertaining to the City of Redding's California Public Employees Retirement System (Ca1PERS) retirement benefit plan whereby RIEO — Clerical, Technical & Professional employees begin to pay a member contribution of 1 percent to CalPERS effective April 10, 2016, with an additional 6 percent member contribution to CaIPERS effective June 5, 2016, for a total contribution of 7 percent. A MOTION WAS MADE by Council Member Schreder, seconded by Council Member Sullivan, to: (1) adopt Resolution No. 2016-035, a resolution of the City Council of the City of Redding approving the Memorandum of Understanding (C-3244) with Redding Independent Employees' Organization (RIEO) — Clerical, Technical and Professional Employees' Unit, effective April 5, 2016, with a term ending June 30, 2016; (2) adopt Resolution No. 2016-036, a resolution of the City Council of the City of Redding pertaining to the City of Redding's California Public Employees Retirement System (Ca1PERS) retirement benefit plan whereby RIEO — Clerical, Technical & Professional employees begin to pay a member contribution of one (1) percent to Ca1PERS effective April 10, 2016, with an additional six (6) percent member contribution to Ca1PERS effective June 5, 2016, for a total contribution of seven (7) percent; and (3) agreed to send a letter of appreciation to the employees. COUNCIL TRAVEL REPORT(S) City Council Member attendance at conference/meetings reimbursed at City expense {Requirement of Assembly Bill 12341 [L-040-150] Council Member Gary Cadd attended the League of California Cities' Sacramento Valley Division Membership meeting on March 18, 2016, in Chico, California. [W-030] Vice Mayor Weaver attended the Northern California Water Association's Water Leaders Program session held on March 25, 2016, at the Sacramento National Wildlife Refuge, in Willows, California. [R-010-750] Council Member Schreder attended the California Association of Councils of Governments' (CALCOG) Regional Leadership Forum 2016, March 30-31, 2016, in Monterey, California, as the Redding Area Bus Authority's representative to the Shasta Regional Transportation Agency. POTENTIAL TOPICS FOR FUTURE CITY COUNCIL MEETINGS [L-040-300] At Mayor McArthur's suggestion, a consensus of the Council agreed to direct staff to draft a letter to California Governor Jerry Brown explaining the negative impact that increasing the state's minimum hourly wage rate to $15 will have on rural communities and requesting modifications. 04/05/2016 CLOSED SESSION At the hour of 7:41 p.m., Mayor McArthur announced that the Council would adjourn to Closed Session. At the hour of 8:06 p.m., Mayor McArthur reconvened the Closed Session to Open Session and reported that in reference to: 13A. Closed session pursuant to California Government Code Section 54957.6: CONFERENCE WITH LABOR NEGOTIATOR Designated Agency Representative: Personnel Director DeMaagd Employee Organization: Redding Peace Officers Association (RPDA). [P -100-050/P-100-050-127] The City Council took no reportable action. Pursuant to Government Code Section 54957.1(a)(6), the matter is not reportable unless an agreement concluding labor negotiations is final and has been accepted by the other party. 13B. Closed Session pursuant to California Government Code Section 54956.9(d)(2)(e)(3): CONFERENCE WITH LEGAL COUNSEL - ANTICIPATED LITIGATION Significant exposure to litigation Below listed claims re a sewer backup at 851 Mission De Oro Claim Nos. 16-040-874 by Hi -Valley Development Corporation; 16-041-874 by Charles Young; 16-042-874 by William Hoover; 16-043-874 by Roy Jones; 16-044-874 by Tammy Miles; 16-045-874 by Yashar Rafi [L-100] Pursuant to Government Code Section 54957.1(a)(4), the Redding City Council agreed to settle claims made against the City of Redding for a sewer back up into residential living spaces that occurred because of root intrusion into the City's sewer main.
