Also present were: City Manager Kurt Starman, Assistant City Manager/Electric Utility Director Barry Tippin, City Attorney Barry E. DeWalt, Public Works Director Brian Crane, Development Services Director Larry Vaupel, Deputy City Manager Greg Clark, City Clerk Pamela Mize, and Executive Assistant Sharlene Tipton. The City Manager introduced Department Directors that were in attendance: Personnel Director Sheri DeMaagd, Fire Chief Gerry Gray, Community Services Director Kim Niemer, Police Chief Robert Paoletti, and City Treasurer Allyn Van Hooser. The Pledge of Allegiance to the Flag was led by Nancy Dutton. The Invocation was sung by the Pilgrim Congregational and Interfaith Choir. CONSENT CALENDAR The following matters were considered inclusively under the Consent Calendar and each Report to Redding City Council (staff report) is incorporated herein by reference: 4(a). Approve Minutes — Regular Meeting of November 17, 2015. [A-050-060] 4(b). Approve Payroll and Accounts Payable Register. [A-050-100-500] Approve: (1) Accounts Payable Register No. 11 for the period of December 1, 2015, through December 10, 2015, for a total of $4,235,403.79, for check numbers 110680 through 111126, inclusive, ACH Transfer numbers 12353 through 12372, inclusive, and Wire Transfer numbers 6000 through 6016, inclusive; and (2) Payroll Register No. 12 for the period of November 22, 2015, through December 5, 2015, in the amount of $2,834,386.35, for electronic deposit transaction numbers 405146 through 406000, inclusive, and check numbers 601444 through 604468, inclusive; SUMMARY TOTAL: $7,069,790.14. 4.2(a). Approve the Tourism Marketing Business Improvement District Annual Report for Fiscal Year 2015-16. [A-170-015-004] 4.2(b). Adopt Resolution No. 2015-097, a resolution of the City Council of the City of Redding amending City Council Policy No. 804 (Economic Development Incentive Program) allowing job credits to be applied to Traffic Impact Fees. [A -050-060-555/T-080-400] 4.5(a). Authorize the Mayor to execute the First Amendment to the Legal Services Agreement (C-3332) with Duncan, Weinberg, Genzer, & Pembroke, P.C. amending the established billing rate by approximately three (3) percent effective January 1, 2016. [E-120-050] 4.5(c). Accept the Redding Electric Utility Monthly Financial Report for October 2015. 12/15/2015 336 4.6(a). Authorize the following actions relative to the contract (C-3003) with the Shasta County Opportunity Center for janitorial services at various City facilities: (1) approve Contract Amendment No. 8 adjusting the days of service for janitorial services at City Hall; authorize the Mayor to execute said amendment; and ratify approval of Contract Amendment Nos. 1 through 7 for the contract period July 1, 2009, through December 31, 2015; (2) award a successor contract at an annual fee of $169,903.44 for the period of January 1, 2016, through December 31, 2017; and (3) adopt Resolution No. 2015-098, a resolution of the City Council of the City of Redding approving and adopting the 12th Amendment to City Budget Resolution No. 2015-057 appropriating $14,500 in Fiscal Year 2015-16 and $25,600 in Fiscal Year 2016-17 for said services. [A-070-0208-130-070] 4.8(a). Authorize: (1) renewal of the Cooperative Agreement for the loan of Federal Excess Personal Property (FEPP Agreement Number 992422) with the State of California Department of Forestry and Fire Protection (C-4245), allowing the City to utilize federal excess property; and (2) adopt Resolution No. 2015-099, a resolution of the City Council of the City of Redding authorizing the Fire Chief to execute the agreement. Authorize the Fire Department to apply for a grant from the Department of Homeland Security, Federal Emergency Management Agency, Assistance to Firefighters Grant, in the amount of $175,000 for the purchase of nine (9) new thermal imaging cameras. [G -100-070/P-150-0701 4.9(a). Adopt Resolution No. 2015-100, a resolution of the City Council of the City of Redding authorizing the transfer of unclaimed funds in the amount of $31,309.33 in the custody of the Redding Police Department to the General Fund pursuant to Government Code Section 50053, for the purchase of police equipment. [B -130-070/P-150-150] 4.10(a).Accept the Monthly General Fund Financial Report for October 2015. [B-130-070] 4.11(a).Approve the replacement of Vehicle No. 594 and purchase one vacuum excavator truck from the National Joint Powers Alliance for $325,751.88 (including tax, license fees, and shipping) for Public Works -Water Utility. [B -050-100/W-030] 4.11(b).Authorize the following relative to Request for Proposals, Schedule No. 4765, Water, Wastewater, and Solid Waste Utility Rate Program Update Project: (1) award to NBS of Temecula, California; (2) staff to negotiate a Consulting and Professional Services Contract with NBS for an initial contract amount not to exceed $165,000; (3) the Mayor to execute the Contract; and (4) the City Manager to approve contract amendment increases up to $25,000. [B-050-100] 4.11(c).Approve the First Amendment to Consulting and Professional Services Agreement (C-6022) with North State Security to add exit lane monitoring services and to increase hourly rates for contract security services and law enforcement officer services at the Redding Municipal Airport. [ B -050-100/A-090-100] 4.11(d).Approve the Ground Lease Agreement with Exelis, Inc., for the operation and maintenance of an Automatic Dependent Surveillance Broadcast system for the Federal Aviation Administration at the Redding Municipal Airport. [C -070-100/A-090-100] 4.11(e).Approve the First Amendment to Lease Agreement (C-4507) with the U.S. General Services Administration for the mobile office trailer located at the Redding Municipal Airport, which is utilized by the Transportation Security Administration. [A -090-100/C-070-100] 12/15/2015 337 4.11(f).Approve the Amendment to extend the Lease Agreement (C-4390) with Williams Scotsman, Inc., for the mobile office trailer at the Redding Municipal Airport for one (1) year, with a 30 -day termination clause, at a fee of $1,871.32 per month. [A -090-100/C-070-100] 4.11(g).Approve the License Agreement (C-3881) with the Shasta Kart Klub, Inc. for the use of the kart track at the Redding Municipal Airport with an initial term of three (3) years, with two (2) one-year options to extend the term. [A -070-080/A-090-100] 4.11(h).Approve: (1) the Consent to Assignment of Lease (C-2216) and Permit for Commercial Activities, and the Consent to Assignment of Lease (C-2643) and Permit for Commercial Activities (C-2644), assigning said leases from North West Air, LLC, to Benton Air Center, Inc.; (2) authorize the Mayor to execute the Agreements; and (3) authorize the City Manager, or designee, to authorize future amendments to the Agreements. [C -070-100/A-090-020] 4.110).Adopt Resolution No. 2015-101, a resolution of the City Council of the City of Redding approving and adopting the 11th Amendment to City Budget Resolution No. 2015-057 appropriating $11,600,000 for Fiscal Year 2015-16 for claims settlement, legal expenses, and staff time associated with the Cypress Bridge Project. [B -130 -070B -050-020/S-070-050-050] 4.12(a).Accept the Local Appointments List relative to 2016 term expirations and vacancies for City Boards, Commissions, and Committees as fulfilling the requirements of Government Code Section 54972 (Maddy Act). APPOINTMENTS 7.1. Appointment to the Shasta County Commission on Aging [B-080-470] City Manager Starman summarized the Report to Redding City Council (staff report), incorporated herein by reference, and relayed Mayor McArthur's recommendation that the City Council reappoint Lupe C. Arness as the City of Redding's representative to the Shasta County Commission on Aging to serve a two-year term expiring January 8, 2018. A MOTION WAS MADE by Council Member Sullivan, seconded by Council Member Weaver, to reappoint Lupe C. Arness as the City of Redding's representative to the Shasta County Commission on Aging to serve a two-year term expiring January 8, 2018. The Vote: Unanimous Ayes. 7.2. Appointment to the Shasta_ Mosquito Abatement & Vector Control District [B-080-480] City Manager Starman highlighted the Report to Redding City Council (staff report), incorporated herein by reference, and relayed Mayor McArthur's recommendation that the City Council appoint Michael McNamara as the City of Redding's representative to the Shasta Mosquito Abatement & Vector Control District to serve a two-year term expiring December 31, 2017. 12/15/2015 338 A MOTION WAS MADE by Council Member Schreder, seconded by Council Member Cadd, to appoint Michael McNamara as the City of Redding's representative to the Shasta Mosquito Abatement & Vector Control District to serve a two-year term expiring December 31, 2017. The Vote: Unanimous Ayes. 7.3. City Council Liaison Assignments for Calendar Year 2016 [B -080-650/A-050-060] City Manager Starman highlighted the Report to Redding City Council (staff report), incorporated herein by reference, and relayed Mayor McArthur's City Council Liaison assignments, noting that some are subject to approval by the Mayors' City Selection Committee in January 2016. The City Council took no action on this informational item. REGULAR CALENDAR: REPORTS & COMMUNICATIONS OF DEPARTMENTS BOARDS, COMMISSIONS AND COMMITTEES 9A. Possibility of Dedicating the Proceeds from the Sale of the Former Police Facility Toward Creating; a Local Sobering Center. [A -050-060/C-050-550] City Manager Starman summarized the Report to Redding City Council (staff report), incorporated herein by reference, provided background information, and relayed Mayor McArthur's request to discuss the possibility of dedicating the proceeds from the sale of the former Police Facility on California Street toward creating a local sobering center. April LaFrance, Founder of the Safe City Project, spoke in support of the Council creating a Sobering Center. A discussion amongst the Council ensued. In response to Council Member Sullivan, Police Chief Paoletti noted that a sobering center for both alcohol and controlled substances would be valuable and beneficial to the community. A MOTION WAS MADE by Council Member Weaver, seconded by Council Member Cadd, to support dedicating the proceeds from the sale of the former police facility on California Street, in an amount not -to -exceed $375,000, toward creating a local sobering center, unless other groups or agencies implement a sobering center, if so, the proceeds would be applied to paying down the debt on the new police facility. The Vote: AYES: Council Members — Cadd, Weaver, and McArthur NOES: Council Members — Schreder and Sullivan ABSTAIN: Council Members - None ABSENT: Council Members — None 9.5(b). Set Public Hearing for Redding Electric Utility rate increase in the amount of 1.5 percent effective March 1, 2016 [E-090-100] Electric Utility Director Tippin provided an overview of the Report to Redding City Council (staff report), incorporated herein by reference, and recommended that the City Council set a public hearing for the regularly scheduled meeting of the City Council on January 19, 2016, to consider a change in the rate (1.5 percent rate increase) for the Redding Electric Utility (REU) effective March 1, 2016. A discussion amongst the Council ensued. A MOTION WAS MADE by Council Member Weaver, seconded by Council Member Sullivan, to set a public hearing for the regularly scheduled meeting of the City Council on January 19, 2016, to consider a change in the rate (1.5 percent rate increase) for the Redding Electric Utility (REU) effective March 1, 2016. The Vote: Unanimous Ayes. 12/15/2015 Klati 9.6(b). Oral update from Shasta County Arts Council on Public Access Television [T-040-350] Debra Lucero, Executive Director of the Shasta County Arts Council, provided a brief video clip and PowerPoint presentation, incorporated herein by reference, highlighting the achievements of the Public Access Television Project and noting upcoming events. A discussion amongst the Council ensued. The City Council took no action on this informational item. 9.11(i).Request by Redding Drag Strip, Inc. to modify License Agreement [A-070-080] Public Works Director Crane summarized the Report to Redding City Council (staff report), incorporated herein by reference, and recommended that the City Council consider a request from the Redding Drag Strip, Inc. (Drag Strip) to amend the terms of the License Agreement (C-6072) at the Redding Municipal Airport with regard to the following: (1) reducing the limits of liability on the insurance requirements from $5 million to $3 million; (2) increasing the license fee from $417 per month to $450 per month for 2016 and beyond; and (3) retroactively eliminating the percentage of gross receipts fee effective January 1, 2015. He noted that staff recommends Request No. 1, but does not favor Request Nos. 2 and 3. Drag Strip President Shirlene Bramson advocated for all three changes and requested that a maintenance component be worked into the Drag Strip's License Agreement with the City. City Attorney DeWalt advised that for the Drag Strip to avoid triggering state prevailing wage law issues, a waiver of liability could be incorporated into the agreement as an amendment if both the Drag Strip and the Council agreed. City Manager Starman reiterated that the Fair Market Value was previously established through the Request for Proposal (RFP) process. A discussion amongst the Council ensued. A MOTION WAS MADE by Council Member Weaver, seconded by Council Member McArthur, to proceed with drafting an amendment to the license agreement with Redding Drag Strip, Inc. to reduce the limits of liability insurance from $5 million to $3 million, with the license fee remaining at $417 per month and the percentage of gross receipts due the City remaining in place. The Vote: Unanimous Ayes. A SECOND MOTION WAS MADE by Council Member Cadd, seconded by Council Member Sullivan, to direct staff to return with potential funding options to assist the Redding Drag Strip, Inc. with maintenance costs to offset the City's Fire and Police Department's usage of the drag strip for training purposes at the next City Council meeting on January 19, 2016. The Vote: AYES: Council Members - Cadd, Schreder, Sullivan, and McArthur NOES: Council Members - Weaver ABSTAIN: Council Members - None ABSENT: Council Members - None 9.15(a).Resolution - Approving Amendments to the Schedule of Part -Time Unrepresented Employee Classifications and Wage Rates/Ranges and to the International Association of Fire Fighters Schedule of Wage Rates [P-100-050-100] Personnel Director DeMaagd provided an overview of the Report to Redding City Council (staff report), incorporated herein by reference, and recommended that the City Council adopt a resolution amending the following effective January 3, 2016: (1) amending the Schedule of Part -Time Unrepresented Employee Classifications and Wage Rates/Ranges to provide increases to the nonrepresented part-time employee classifications assigned to the Recreation Division, three classifications assigned to Redding Police Department, and one classification assigned to Redding Fire Department to reflect the changes being made to California minimum wage; and 12/15/2015 (2) amending the International Association of Firefighters schedule of wage rates to increase the pay rate for the Apprentice Firefighter classification to meet the affordability mandate established by the Affordable Care Act. A discussion amongst the Council ensued. Ms. DeMaagd noted that the savings to the City is $18,000 over the entire two-year contract term, not annually as stated in the staff report. A discussion amongst the Council ensued. A MOTION WAS MADE by Council Member Schreder, seconded by Council Member Weaver, to adopt Resolution No. 2015-103, a resolution of the City Council of the City of Redding approving the Memorandum of Understanding between the City of Redding and the Redding Peace Officers' Association Miscellaneous Employees Unit for a term ending December 31, 2017. The Vote: AYES: Council Members — Cadd, Schreder, Sullivan, Weaver, and McArthur NOES: Council Members - None ABSTAIN: Council Members - None ABSENT: Council Members — None Resolution No. 2015-103 is on file in the Office of the City Clerk. PUBLIC COMMENT [A-050-250-074] Danny Brown proposed a homeless camp be established. [A-050-250-074] Vernon Price presented a document entitled "stigmatizing labels identified by the Expert Panel used to describe people who are homeless with cognitive impairments " on the overhead projector and invited the Council and community to review Senate Bill 608 on January 5, 2016. [C-050-550] Stephen Blanchard proposed that the former police facility and the property located across the street be utilized for drug/alcohol addiction counseling purposes. 12/15/2015 1 341 POTENTIAL TOPICS FOR FUTURE CITY COUNCIL MEETINGS [P-150-150] At Council Member Cadd's suggestion, the City Council directed staff to research the potential cost and placement of moving the existing flagpole from the old police station on California Street to the new police station on Cypress Avenue, and return to the Council at a future Council meeting. [A-050-060] At Vice Mayor Weaver's suggestion, the City Council directed staff to reach out to the Shasta County Office of Education, or various school districts to invite middle and high school classes to receive a City Hall campus tour led by the Council Members on a monthly rotation. CLOSED SESSION At the hour of 8:24 p.m., Mayor McArthur announced that the Council would adjourn to Closed Session. At the hour of 9:02 p.m., Mayor McArthur reconvened the Closed Session to Open Session and reported that in reference to: 13A.
