HomeMy WebLinkAboutMinutes - City Council - 2015-10-20309 Redding City Council, Regular Meeting Civic Center Council Chambers 777 Cypress Avenue Redding, CA 96001 October 20, 2015, 6:00 PM The meeting was called to order by Mayor Francie Sullivan with the following Council Members present: Gary Cadd, Missy McArthur, Kristen Schreder, and Brent Weaver. Also present were: City Manager Kurt Starman, Assistant City Manager/Electric Utility Director Barry Tippin, City Attorney Barry E. DeWalt, Public Works Director Brian Crane, Planning Manager Kent Manuel, Deputy City Manager Greg Clark, Assistant City Clerk Teresa Rudolph, and Executive Assistant Sharlene Tipton. The City Manager introduced Department Directors that were in attendance: City Treasurer Allyn Van Hooser, Personnel Director Sheri DeMaagd, Support Services Director Rod Dinger, Finance Director Dennice Maxwell, Community Services Director Kim Niemer, and Police Chief Robert Paoletti. The Pledge of Allegiance to the Flag was led by Boy Scout Todd Mehr. The Invocation was provided by Sue Morehouse, Religious Society of Friends (also known as Quakers). PRESENTATIONS 2A. Presentation of City of Redding Employee Service Recognition Awards [P-100] Personnel Director DeMaagd highlighted the City of Redding Internal Communication (staff report), incorporated herein by reference, that listed the 68 employees who have achieved the milestone of 15, 20, 25, 30, and 35 years of service to the City of Redding. On behalf of the City of Redding, she expressed appreciation for their commitment to public service, the community, and the City. She noted that Department Directors will present the remaining service awards to those unable to attend the City Council meeting. Mayor Sullivan, along with each employee's Department Director, presented service awards to the following employees that were present: 20 -years — Pamela Brady (Electric Utility Demand Side Management Coordinator); 25 -years — Debbie Morgan (Development Services Technician III); and Teresa Rudolph (Assistant City Clerk); 30 -years — Kent Manuel (Planning Manager); and Craig Schrumpf, retired (Systems Analyst/Programmer). The City Council took no action on this informational item. 2B. Presentation of Eagle Scout Project by Todd Mehr, Boy Scout of America Troop No. 759 [A -050-060/P-050] Boy Scout Todd Mehr presented a PowerPoint presentation, incorporated herein by reference, describing his Eagle Scout Project that entailed the donation of a swing set in Indian Hills Park to the City of Redding. The City Council took no action on this informational item. 10/20/2015 310 CONSENT CALENDAR The following matters were considered inclusively under the Consent Calendar and each Report to Redding City Council (staff report) is incorporated herein by reference: 4(b). Approval of Payroll and Accounts Payable Register [A-050-100-500] Approve: (1) Accounts Payable Register No. 7 for the period of October 1, 2015, through October 15, 2015, for a total of $7,380,505.90, for check numbers 108893 through 109489, inclusive, ACH Transfer numbers 12233 through 12254, inclusive, and Wire Transfer numbers 5940 through 5954, inclusive; (2) Payroll Register No. 7 for the period of September 13, 2015, through September 26, 2015, in the amount of $2,879,396.47, for electronic deposit transaction numbers 400801 through 401657, inclusive, and check numbers 601223 through 601273, inclusive; and (3) Payroll Register No. 8 for the period of September 27, 2015, through October 20, 2015, in the amount of $2,716,453.76, for electronic deposit transaction numbers 401658 through 402531, inclusive, and check numbers 601274 through 601295, inclusive; SUMMARY TOTAL: $12,976,356.13. 4(c). Adopt Ordinance No. 2535, an ordinance of the City Council of the City of Redding amending Redding Municipal Code Title 10 (Public Peace, Morals and Welfare), Chapter 10.28 (Public Property Generally) by amending Section 10.28.010, relating to restrictions on sleeping in public parks and plazas. [C-110-100] Anthony Cash supported enforcement of the sleep -lie ordinance. 4.3(a). Approve the following: (1) authorization of Service Nos. 15-01, 15-02, and 15-03 with Mead & Hunt, Inc. (C-5534) for engineering design services for the West Tie - Down Apron Reconstruction Project, the T -Hangar Taxilane Reconstruction Project, and to conduct an Airport Pavement Management System Study at Redding Municipal Airport; (2) authorize the Mayor to execute the agreements; and (3) adopt Resolution No. 2015-086, a resolution of the City Council of the City of Redding approving and adopting the 9th Amendment to City Budget Resolution No. 2015-057 reducing previous appropriations by $173,350 to reflect updated project costs and grant awards for Fiscal Year 2015-16. [B -130-070/A-090-020] 4.3(b). Approve the following: (1) termination of Facilities and Ground Lease Agreement (C- 4741) with REACH Air Medical Services (REACH) for an equipment building (commonly known as old Fire Station 7) and apron located at 3790 Flight Avenue at the Redding Municipal Airport (RDD); (2) Facility and Ground Lease with REACH for 6030 Old Oregon Trail at RDD; and (3) authorize the Mayor to execute both agreements. [ C -070-100/A-090-100] 4.5(a). Approve the replacement purchase of one vacuum excavator truck from the National Joint Powers Alliance for $329,000 (including tax, license fees, and shipping). [B -050-100/E-090] 4.5(b). Accept the Redding Electric Utility monthly financial report for August 2015. [B-130-070] 4.5(c). Ratify a Supplemental Agreement with the Union Pacific Railroad (UPRR) executed by the Assistant City Manager to modify an existing overhead wireline crossing of the UPRR tracks as part of the Eureka Way/Sulphur Creek Transmission Line Reconductoring Project (Bid Schedule No. 4750). [B -050-020/E-090-160] 4.6(a). Accept Bid Schedule No. 4707, Redding Civic Auditorium Window Wall Replacement Project, awarded to Walker Construction, as satisfactorily complete, with a total project cost of $372,939.74. [B -050-020/C-050-050] 10/20/2015 311 4.8(a). Authorize the donation of the following: (1) 1987 FMC Van Pelt fire engine and 1990 Pierce fire engine which have both been removed from service to Shasta College for use in its Fire Technology program; and (2) 1989 International wildland fire engine to the Shasta Union High School District Career Technical Education program. [P-150-070] 4.10(a).Accept the General Fund Monthly Financial Report for August 2015. [B-130-070] 4.11(b).Authorize the following action relative to Bid Schedule No. 4744, Foothill Water Treatment Plant Improvement Project: (1) award the project to RTA Construction, Inc. in the amount of $1,929,500; (2) approve an additional $330,000 to cover the cost of contract administration and inspection fees; (3) approve $250,000 to provide construction contingency funding; and (4) authorize the City Manager to approve additional increases, in either the construction management or construction contingency amounts, up to a total of $15,000, for a grand total of $2,524,500. [B -050-020/W-030-425] Council Member Cadd recused himself from this item due to family relations. The Vote: AYES: Council Members — McArthur, Schreder, Weaver, and Sullivan NOES: Council Members — None ABSTAIN: Council Members — Cadd ABSENT: Council Members — None 4.11(c).Authorize the following action relative to Highland Park Subdivision, Unit 8 (S-18-05): (1) accept the Churn Creek Road -Canby Road intersection improvements in Highland Park Unit 8 Subdivision as satisfactorily completed; and (2) instruct the City Clerk to return the related securities to the developer, J & S Highland Park, LLC, and MCG, LP. [S-101-102] 4.11(d).Adopt Resolution No. 2015-087, a resolution of the City Council of the City of Redding summarily vacating the remaining portion of Fairlane Drive and the adjacent five-foot Public Service Easement (A-2015-00490) as created by the Redding Airport Business Park Subdivision (S-2-92) recorded in Book 21 of Maps at Page 42, filed April 12, 1994, Shasta County Records. [A-010-040] 4.11(e).Authorize the Mayor to sign a letter commenting on the Partially Recirculated Draft Environmental Impact Report/Supplemental Draft Environmental Impact Statement for the Bay Delta Conservation Plan's California WaterFix. [S -050-430/W-030] A MOTION WAS MADE by Council Member McArthur, seconded by Council Member Schreder, that the foregoing items on the Consent Calendar be accepted, acknowledged, adopted, approved, and/or authorized as recommended with the exception of the item(s) voted on separately above. Appointment to the Shasta County Commission on Aging [B-080-470] Mayor Sullivan summarized the Report to Redding City Council (staff report), incorporated herein by reference, and recommended that the City Council appoint Lupe C. Arness as the City of Redding representative to the Shasta County Commission on Aging to serve an unscheduled vacancy term expiring January 5, 2016. A MOTION WAS MADE by Council Member Schreder, seconded by Council Member McArthur, to appoint Lupe C. Arness as the City of Redding representative to the Shasta County Commission on Aging to serve an unscheduled vacancy term expiring January 5, 2016. The Vote: Unanimous Ayes. REGULAR CALENDAR: REPORTS & COMMUNICATIONS OF DEPARTMENTS, BOARDS, COMMISSIONS AND COMMITTEES 9.4(a). Ordinance - Regulation of Shopping Carts [C -110-100/A-050-0601 Planning Manager Kent Manuel summarized the Report to Redding City Council (staff report), incorporated herein by reference, recommended that the City Council offer an ordinance amending RMC Title 9 (Health and Safety) by adding Chapter 9.07 (Shopping Carts), Section 9.07.010 through 9.07.100, inclusive, all pertaining to the regulation of shopping carts for first reading by title only and waive the full reading. Pursuant to a request by Michel LeClerc, Mr. Manuel recommended that Section 9.07.050(A) be amended to replace "customers" with "unauthorized individuals". Chief Paoletti explained that an abandoned shopping cart button will be added onto the Redding Police Department's website to enable the reporting of abandoned shopping carts to the responsible store. Michel LeClerc supported the proposed ordinance with the recommended amendments to Section 9.07.050. Dale Ball supported the ordinance, however, expressed concern relative to potential liability involved if shopping carts are hit by a vehicle when left in roadways. A discussion amongst the Council ensued. A MOTION WAS MADE by Council Member Weaver, seconded by Council Member Schreder, to: (1) introduce for first reading by title only and waive the full reading of Ordinance No. 2536, an ordinance of the City Council of the City of Redding amending Redding Municipal Code Title 9 (Health and Safety) by adding Chapter 9.07 (Shopping Carts), Section 9.07.010 through 9.07.100, inclusive, all pertaining to the regulation of shopping carts as amended; and (2) directed staff to return to Council in 12 months with a status report as to the effectiveness of the ordinance. The Vote: AYES: Council Members — Cadd, McArthur, Schreder, Weaver, and Sullivan NOES: Council Members — None ABSTAIN: Council Members — None ABSENT: Council Members — None 9.5(d). Update on Redding Electric Utility Customer Assistance Programs [E-090] Electric Utility Manager Barry Tippin highlighted the report to Redding City Council (staff report), incorporated herein by reference, and recommended that the Council accept the report providing an overview of the following four existing assistance programs available to Redding Electric Utility customers: Lifeline/Lifeline Plus+; Community Assistance for Redding Electric Service (CARES); and Simply Helping Another Receive Energy (SHARE). 10/20/2015 313 A discussion amongst the Council ensued. A MOTION WAS MADE by Council Member McArthur, seconded by Council Member Schreder, to accept the report providing an overview of existing assistance programs available to Redding Electric Utility customers. The Vote: Unanimous Ayes. 9.14(a). Informational Report Regarding Social Host Ordinances [A -050-060/C-110-100] City Attorney DeWalt provided an overview of the Report to Redding City Council (staff report), incorporated herein by reference, and recommended that the City Council accept the report regarding social host ordinances and, if necessary, provide further direction to staff. The following spoke in support of a social host ordinance: Samantha Vazmendes, Anita Joseph, Cathy Grindstaff, Cindy Diersi, and Betty Cunningham. A discussion amongst the Council ensued. A MOTION WAS MADE by Council Member Schreder, seconded by Council Member Cadd, to direct the City Attorney to prepare a social host ordinance covering alcohol, marijuana, or any other controlled substance with the following components: (1) a civil and administrative process; (2) civil cost recovery and strict liability tied to the person in possession or control of the property; and (3) provide only one warning, after which there would be a range of progressive fines, with no set dollar amount at this time. The Vote: Unanimous Ayes. PUBLIC COMMENT [A-050-060] Ron Benton provided a letter to the Council, incorporated herein by reference, requesting that the Council adopt an ordinance concerning permissible dress regulations, specifically addressing "sagging pants", in the City of Redding. [A-050-060] Amanda Smith returned her Adopt -A -Block application and questioned why the program is not expanded beyond the downtown core area. POTENTIAL TOPICS FOR FUTURE CITY COUNCIL MEETINGS [A-050-060] At Council Member McArthur's suggestion, a consensus of the Council supported the receipt of a presentation from Jean King and Matt Moseley providing suggestions on how the City could assist with preventing sex trafficking in the community. [A-050-060] At Council Member McArthur's suggestion, a consensus of the Council agreed to discuss the installation of recycling containers in the Adopt -A -Block Program's downtown area, similar to what is currently being utilized on the City's trails. [P-100-230] At Council Member McArthur's suggestion, a consensus of the Council supported having an in-depth informational discussion regarding the California Public Employees' Retirement System (CalPERS) and associated implications to the City of Redding. CLOSED SESSION At the hour of 7:36 p.m., Mayor Sullivan announced that the Council would adjourn to Closed Session. At the hour of 7:49 p.m., Mayor Sullivan reconvened the Closed Session to Open Session and reported that in reference to: 10/20/2015 314 13A.
