Also present were: City Manager Kurt Starman, Assistant City Manager/Electric Utility Director Barry Tippin, City Attorney Barry E. DeWalt, Public Works Director Brian Crane, Interim Development Services Director Kent Manuel, Deputy City Manager Greg Clark, Assistant City Clerk Teresa Rudolph, and Executive Assistant Sharlene Tipton. The City Manager introduced Department Directors that were in attendance: City Treasurer Allyn Clark, Personnel Director Sheri DeMaagd, Fire Chief Gerry Gray, Finance Director Dennice Maxwell, Community Services Director Kim Niemer, and Police Chief Robert Paoletti. Mr. Starman introduced Deputy City Treasurer Ronica Sowers. The Pledge of Allegiance to the Flag was led by Rex Vaughn. The Invocation was provided by Pastor Eric Johnson, Bethel Church. CONSENT CALENDAR The following matters were considered inclusively under the Consent Calendar and each Report to Redding City Council (staff report) is incorporated herein by reference: 4(b). Approval of Payroll and Accounts Payable Register [A-050-100-500] Approve: (1) Accounts Payable Register No. 3 for the period of August 1, 2015, through August 14, 2015, for a total of $9,543,765.37, for check numbers 106990 through 107650, inclusive, ACH Transfer numbers 12088 through 12122, inclusive, and Wire Transfer numbers 5816 through 5843, inclusive; and (2) Payroll Register No. 3, for the period of July 19, 2015, through August 1, 2015, in the amount of $2,992,922.73, for electronic deposit transaction numbers 397117 through 398080, inclusive, and check numbers 600991 through 601118, inclusive; SUMMARY TOTAL: $12,536,688.10. 4(c). Adopt Ordinance No. 2532, an ordinance of the City Council of the City of Redding amending Title 2 (Administration and Personnel), Chapter 2.04 (City Council) of the Redding Municipal Code by amending Section 2.04.040 (Presiding Officer) relating to authorization of the Mayor Pro Tempore to act in the absence of the Mayor and Vice Mayor. [C -110-100/A-050-060] 4.3(a). Ratify the approval by the City Manager of the Microsoft Enterprise Subscription Agreement (C-5830), authorizing an increase of $19,538.44 for the first year of the Agreement, with a cost of $463,615.32 over the three-year term. [A -070-400/C-175-550] 4.3(c). Authorize the termination of Hangar and Ground Lease and Permit for Commercial Activities (C-2454) with Redding Aerotronics, Inc. at Redding Municipal Airport and authorize the City Manager, or designee, to execute a termination agreement. [C -070-100/A-090-100] 4.3(d). Approve the Second Amendments to Real Estate Purchase and Sale Agreements (C- 6505 and C-6279), with Redding Imperial, LLC, for Lots 12, 13 and 16 in the Redding Airport Business Park to amend the property description for each parcel; and authorize the Mayor to execute a corrective deed for Lots 13 and 16. [C -070-200/A-090-100] 08/18/2015 281 4.5(a). Authorize the following relative to Bid Schedule No. 4742, Treated Wood Poles: (1) award to McFarland Cascade/Stella Jones in the total amount of $257,367; and (2) authorize the Purchasing Officer to extend the bid award annually through August 31, 2019, if mutually agreeable, with all prices, terms, and conditions remaining the same to McFarland Cascade/Stella Jones. [B-050-100] 4.11(a).Authorize the City Manager, or his designee, to execute a Sub -Recipient Cooperative Agreement (C-6028) with the Shasta Regional Transportation Agency (SRTA) as a prerequisite to receiving federal planning funds through SRTA's Overall Work Program for Fiscal Year 2015-16. [T-100-375] 4.11(b).Approve the proposed increase to the City's Supplemental Environmental Project contribution amount from $5,000 to $7,800, reduce the minimum age of the lateral to 30 years, and make the additional reimbursement limit retroactive to lateral replacements that have already been completed, as a stipulation to the Regional Water Quality Control Board Administrative Civil Liability Negotiated Settlement Agreement. The Vote: AYES: Council Members — Cadd, McArthur, Schreder, Weaver, and Sullivan NOES: Council Members — None ABSTAIN: Council Members — None ABSENT: Council Members — None PUBLIC HEARINGS, PETITIONS, AND PROTESTS 6.1 Public Hearing; and Resolution - Regarding adjusting the City's Schedule of Fees and Service Charges [F-205-600] Finance Director Maxwell summarized the Report to Redding City Council (staff report), incorporated herein by reference, and recommended that the City Council conduct a Public Hearing and, upon conclusion, adopt a resolution adjusting the City of Redding's Schedule of Fees and Service Charges. The hour of 6:00 p.m. having arrived, Mayor Sullivan opened the public hearing to consider the proposed City of Redding's Schedule of fees and Service Charges. The Affidavit of Publication — Notice of Public Hearing is on file in the Office of the City Clerk. Mayor Sullivan determined that no one present wished to address this matter and closed the public hearing. A MOTION WAS MADE by Council Member Schreder, seconded by Council Member McArthur, to adopt Resolution No. 2015-071, a resolution of the City Council of the City of Redding amending the City of Redding's Schedule of Fees and Service Charges. The Vote: AYES: Council Members - Cadd, McArthur, Schreder, Weaver, and Sullivan NOES: Council Members - None ABSTAIN: Council Members - None ABSENT: Council Members - None Resolution No. 2015-071 is on file in the Office of the City Clerk. 08/18/2015 282 REGULAR CALENDAR: REPORTS & COMMUNICATIONS OF DEPARTMENTS, BOARDS, COMMISSIONS AND COMMITTEES 9.1(a). Proposed Purchase and Sale Agreement with Lassen Canyon Nursery regarding Lot 7 in Stillwater Business Park [C -070-200/E-050-500] City Manager Starman provided an overview of the Report to Redding City Council (staff report), incorporated herein by reference. He introduced Economic Development liaison and Electric Manager Pat Keener who recommended that the City Council: (1) approve a Purchase and Sale Agreement in the amount of $840,000 with Lassen Canyon Nursery for Lot 7, totaling 16.75 acres, in Stillwater Business Park; and (2) authorize the Mayor to sign all documents related to the purchase and closing of said transaction. A discussion amongst the Council ensued. A MOTION WAS MADE by Council Member Schreder, seconded by Council Member McArthur, to: (1) approve a Purchase and Sale Agreement in the amount of $840,000 with Lassen Canyon Nursery for Lot 7, totaling 16.75 acres, in Stillwater Business Park; and (2) authorize the Mayor to sign all documents related to the purchase and closing of said transaction. The Vote: Unanimous Ayes. 9.2(a). Contract with Haven Humane Society for Animal Regulation Dog Licensing Shelter Services [A -130-150/C-110-100] Deputy City Manager Clark summarized the Report to Redding City Council (staff report), incorporated herein by reference, and recommended that the City Council approve a contract (C-1618) with Haven Humane Society for the enforcement of City of Redding Municipal Code Title 7 (Animals) for animal regulation, dog licensing, and shelter services within the city limits through September 30, 2020, in the starting yearly amount of $645,660, with an annual adjustment based on the Consumer Price Index in October. Haven Humane Society's Chief Executive Officer Mark Storrey provided statistical data relative to the number of spay/neuters and adoptions performed over the last year, and highlighted its services. A discussion amongst the Council ensued. A MOTION WAS MADE by Council Member McArthur, seconded by Council Member Schreder, to approve a contract (C-1618) with Haven Humane Society for the enforcement of City of Redding Municipal Code Title 7 (Animals) for animal regulation, dog licensing, and shelter services within the city limits through September 30, 2020, in the starting yearly amount of $645,660, with an annual adjustment based on the Consumer Price Index in October. The Vote: AYES: Council Members - Cadd, McArthur, Schreder, Weaver, and Sullivan NOES: Council Members - None ABSTAIN: Council Members - None ABSENT: Council Members - None Council Member Cadd left the room at 6:47 p.m. 9.14(a).Ordinance - Repealing Cypress Bridge Construction Zone Emergency Rules During Construction [C -110-100/S-070-050-050] City Attorney DeWalt highlighted the Report to Redding City Council (staff report), incorporated herein by reference, and recommended that the City Council offer an ordinance amending Redding Municipal Code Title 10 (Public Peace, Morals and Welfare), Chapter 10.26 (Sacramento River Area Regulations) by repealing Section 10.26.065 (Cypress Bridge Construction Zone Emergency Rule) for first reading by title only and waive the full reading. 08/18/2015 283 A MOTION WAS MADE by Council Member McArthur, seconded by Council Member Weaver, to introduce for first reading by title only and waive the full reading of Ordinance No. 2533, an ordinance of the City Council of the City of Redding amending Redding Municipal Code Title 10 (Public Peace, Morals and Welfare), Chapter 10.26 (Sacramento River Area Regulations) by repealing Section 10.26.065; relating to Cypress Bridge construction zone emergency rules during construction efforts of the Cypress Bridge. The Vote: AYES: Council Members - McArthur, Schreder, Weaver, and Sullivan NOES: Council Members - None ABSTAIN: Council Members - None ABSENT: Council Members - Cadd City Attorney DeWalt read the full title of Ordinance No. 2533. Council Member Cadd returned to the room at 6:48 p.m. 9.15(a).Resolution - Approving Memorandum of Understanding (MOU) with Redding Independent Employees' Organization (RIEO) - Supervisory/Confidential Employees' Unit; and Resolution - Regarding RIEO — Supervisory/Confidential Employees' Unit Full Member Contribution to the California Public Employees Retirement System (CaIPERS) [P -100-050-129/P-100-230] Personnel Director DeMaagd provided an overview of the Report to Redding City Council (staff report), incorporated herein by reference, and recommended that the City Council: (1) adopt a resolution approving the MOU with RIEO — Supervisory/Confidential Employees' Unit, effective August 18, 2015; and (2) adopt a resolution pertaining to the City of Redding's CaIPERS retirement benefit plan whereby RIEO — Supervisory/Confidential employees begin to pay the full member contribution of seven percent to Ca1PERS effective August 16, 2015. A discussion amongst the Council ensued. A MOTION WAS MADE by Council Member Weaver, seconded by Council Member Schreder to: (1) adopt Resolution No. 2015-072, a resolution of the City Council of the City of Redding approving the Memorandum of Understanding with Redding Independent Employees' Organization (RIEO) — Supervisory/Confidential Employees' Unit, effective August 18, 2015; and (2) adopt Resolution No. 2015-073, a resolution of the City Council of the City of Redding rescinding paying and reporting the value of employer paid member contributions to the City of Redding's California Public Employees Retirement System retirement benefit plan whereby RIEO — Supervisory/Confidential employees begin to pay the full member contribution of seven percent to Ca1PERS effective August 16, 2015. The Vote: AYES: Council Members - Cadd, McArthur, Schreder, Weaver, and Sullivan NOES: Council Members - None ABSTAIN: Council Members - None ABSENT: Council Members - None Resolution Nos. 2015-072 and 2015-073 are on file in the Office of the City Clerk. PUBLIC COMMENT [ W-030] Nick Gardner shared a map depicting a flood concern relative to the Henderson Ditch area along Hartnell Avenue. He opined that due to the City's storm runoff, it is the City's responsibility to correct the issue. [P-150-150] Rex Vaughn opined that the problems associated with vehicle versus pedestrian accidents are not due to parked cars, but transients not utilizing crosswalks. [P -150-150/A-050-060] Susanne Baremore expressed her frustration and concerns relative to the transient population in Downtown Redding and the negative effects they have on her business. 08/18/2015 284 [P-050] John Belnap spoke in opposition to the proposed Panorama Pump Park's mountain biking course on City -owned land along Lake Boulevard. He opined that residents are upset because they have not had the opportunity to discuss the project, which now appears to be a done deal. [P -150-150/A-050-060] Dale Ball expressed concern with the transient population being visible to tourists at the Kmart/99 Cent Store shopping center located just off of Interstate 5. He opined that furlough days for City employees should continue and the savings be directed to the police department. [P -150-150/A-050-060] Anje Walfoort opined that the City needs to help alleviate the crime and transient issues in the community. POTENTIAL TOPICS FOR FUTURE CITY COUNCIL MEETINGS [C -110-100/P-150-150] In response to Council Member Schreder's request, City Attorney DeWalt stated that he would keep the Council apprised of any court decisions potentially impacting the City's Sit - Lie ordinance. [A-050-060] At Council Member Weaver's suggestion, a consensus of the Council agreed to discuss, at a future meeting, the concept of a volunteer -based program in the Downtown area, similar to Caltrans' Adopt -A -Highway Program. CLOSED SESSION At the hour of 7:24 p.m., Mayor Sullivan announced that the Council would adjourn to Closed Session. At the hour of 9:40 p.m., Mayor Sullivan reconvened the Regular Meeting to Open Session and reported that in reference to: 13A.
