Redding City Council, Regular Meeting Civic Center Council Chambers 777 Cypress Avenue Redding, CA 96001 May 5, 2015, 6:00 PM by Mayor Francie Sullivan with the following Missy McArthur, Kristen Schreder, and Also present were: City Manager Kurt Starman, Assistant City Manager/Electric Utility Director Barry Tippin, Interim City Attorney W. Leonard Wingate, Public Works Director Brian Crane, Development Services Director Bill Nagel, Deputy City Manager Greg Clark, City Clerk Pamela Mize, and Executive Assistant Sharlene Tipton. The City Manager introduced Department Directors that were in attendance: Personnel Director Sheri DeMaagd, Support Services Director Rod Dinger, Fire Chief Kevin Kreitman, Finance Director Dennice Maxwell, Community Services Director Kim Niemer, and Police Chief Robert Paoletti. The Pledge of Allegiance to the Flag was led by Laurie Baker. The Invocation was provided by Debbie Ivey, Redding Police Department Chaplain. PRESENTATIONS 2A. Presentation of Mayor's Proclamations to Redding Police Officer Paul Slagle and Redding Fire Engineer Allen Gunderson, Redding Exchange Club's 2014 Police Officer and Firefighter of the Year [A -050 -060 -600/A -050-140/A-050-270] The City Council took no action on this informational item. 2B. Presentation by Mark Lascelles, President of the Shasta County Economic Development Corporation (EDC) [B -080 -150/E -050/A-050-060] Mr. Lascelles provided a PowerPoint presentation, incorporated herein by reference, highlighting the Shasta County EDC's past, present, and future activities, and unveiled its new logo and brand — "Shasta — North of Expected", and disbursed pamphlets to the Council and staff, incorporated herein by reference, showcasing the new logo and marketing information. Shasta County EDC Chairman Mike Pohlmeyer thanked the City Council for its continued support. The City Council took no action on this informational item. CONSENT CALENDAR The following matters were considered inclusively under the Consent Calendar and each Report to Redding City Council (staff report) is incorporated herein by reference: 4(a). Approval of Minutes - Special Meeting of April 15, 2015; and Special Meeting of April 21, 2015. [A-050-060] 4(b). Approval of Payroll and Accounts Payable Register [A-050-100-500] Approve: (1) Accounts Payable Register No. 20 for the period of April 17, 2015, through April 30, 2015, for a total of $11,607, 675.91, for check numbers 103975 through 104431, inclusive, ACH Transfer numbers 11831 through 11872 inclusive, and Wire Transfer numbers 5565 through 5608, inclusive; and (2) Payroll Register No. 22, for the period of April 12, 2015, through April 25, 2015, in the amount of $2,731,982.44, for electronic deposit transaction numbers 390704 through 391559, inclusive, and check numbers 600662 through 600723, inclusive; SUMMARY TOTAL: $14,339,658.35. 05/05/2015 1 1 1 231 4(c). Accept a second position on the Shasta County Air Pollution Control Board and authorize the Mayor to coordinate with the City Selection Committee to fill the vacancy. [B-080-460] Vice Mayor McArthur suggested to Mayor Sullivan that Council Member Schreder should be considered to fill the City of Redding's second position on the Shasta County Air Pollution Control Board. 4.5(a). Accept the Redding Electric Utility (REU) monthly financial report for February 2015. [B-130-070] 4.9(a). Adopt Resolution No. 2015-035, a resolution of the City Council of the City of Redding proclaiming May 3, 2015, and May 4, 2015, as California Peace Officers' Memorial Days; May 14, 2015, as Shasta County Peace Officers' Memorial Day; and May 10 through May 16, 2015, as National Police Week in the City of Redding. [A-050-060-600] 4.10(a).Accept the General Fund Monthly Financial Report for February 2015. [13-130-070] 4.11(a).Accept Bid Schedule No. 4411 (Job No. 9403), Redding Municipal Airport Terminal Expansion Project, awarded to Danco Builders Northwest, as satisfactorily complete with a total project cost of $9,732,991.63. [B -050-020/A-090-100] 4.11(c).Accept Bid Schedule No. 4690 (Job No. 8657), ADA Curb Ramp 2014 Project, awarded to The Builder, Inc., as satisfactorily complete, with a final cost of $83,686.77. [B-050-020] 4.11(d).Accept Bid Schedule No. 4647 (Job No. 2421), ADA Curb Ramps and Sidewalk Repair 2013-14, awarded to Roy Allen King Construction, as satisfactorily complete, with a final cost of $379,696.70. [B-050-020/5-070-285] A MOTION WAS MADE by Council Member McArthur, seconded by Council Member Schreder, that the foregoing items on the Consent Calendar be accepted, acknowledged, adopted, approved, and/or authorized as recommended. The Vote: AYES: Council Members — Cadd, McArthur, Schreder, Weaver, and Sullivan NOES: Council Members — None ABSTAIN: Council Members — None ABSENT: Council Members — None Resolution No. 2015-035 is on file in the Office of the City Clerk. 05/05/2015 232 At Mayor Sullivan's request, it was the consensus of the City Council to discuss item 9.2(a) before the Public Hearing, item 6.1. 9.2(a). Service Agreement with Shasta Cascade Wonderland Association and Redding Tourism Marketing Group, Inc. [B -130-030-700/E-050] Deputy City Manager Clark provided an overview of the Report to Redding City Council (staff report), incorporated herein by reference, and relayed the Community Services Advisory Commission's recommendation that the City Council approve a Service Agreement (C-5348) with the Shasta Cascade Wonderland Association (SCWA) and Redding Tourism Marketing Group, Inc. (RTMG) for tourism promotion through June 30, 2020. SCWA General Manager Laurie Baker answered questions from the Council relative to the past, present, and future activities of the SCWA and the RTMG. A discussion amongst the Council ensued. A MOTION WAS MADE by Council Member Cadd, seconded by Council Member Schreder, to approve a Service Agreement (C-5348) with the Shasta Cascade Wonderland Association and Redding Tourism Marketing Group, Inc. for tourism promotion through June 30, 2020. The Vote: Unanimous Ayes. PUBLIC HEARINGS, PETITIONS, AND PROTESTS 6.1. Public Hearing; and Ordinance — Regarding repealing Redding Municipal Code (RMC) Chapter 6.39 (Downtown Redding Business Improvement District) [C -110-100/A-170-015-002] Deputy City Manager Clark provided an overview of the Report to Redding City Council (staff report), incorporated herein by reference, and recommended that the City Council conduct a Public Hearing and, upon conclusion, offer for first reading and waive the full reading of an ordinance repealing RMC Chapter 6.39 (Downtown Redding Business Improvement District) and disestablishing the Downtown Redding Business Improvement District (BID); and authorize staff to send written notice to the Downtown Redding Business Association (DRBA) terminating the Agreement (C- 3518) for Administration of the BID. Mr. Clark noted that the draft ordinance includes a technical error stating that the date that the DRBA shall deliver funds subject to refund to those assessed under Street and Highways Code section 36551(b) to the City of Redding Director of Finance no later than 5:00 p.m. on June 5, 2015, however the date actually is June 18, 2015, and will be corrected in the ordinance. The hour of 6:00 p.m. having arrived, Mayor Sullivan opened the public hearing to consider the ordinance relative to the Downtown Redding BID and potential termination of the Agreement with DRBA. The Affidavit of Publication — Notice of Public Hearing is on file in the Office of the City Clerk. The following spoke in opposition to disestablishing the Downtown Redding BID: Dave Gerard, Sam Allen, Vint Stevenson, Tammy Boone, Walt McNeill, and Joanne McCarley, Dale Woods spoke in support. Mayor Sullivan determined that no one else present wished to address this matter and closed the public hearing. A discussion amongst the Council ensued. 05/05/2015 233 A MOTION WAS MADE by Council Member Cadd to decline introduction of the ordinance, and direct staff to work with the DRBA and if still unable to resolve the issues, then move forward with disestablishing the Downtown Redding Business Improvement District. Motion died due to lack of a second. A MOTION WAS MADE by Council Member Schreder, seconded by Council Member McArthur, to: (1) offer for first reading by title only and waive the full reading of Ordinance No. 2526, an ordinance of the City Council of the City of Redding repealing RMC Title 6 (Business Taxes, Licenses, and Regulations), Chapter 6.39 (Downtown Redding Business Improvement District) and disestablishing the Downtown Redding Business Improvement District (BID); (2) authorize staff to send written notice to the Downtown Redding Business Association terminating the Agreement (C-3518) for administration of the BID; and (3) directed staff to retain a Certified Public Accountant to inspect and examine DRBA's financial records as soon as is feasible pursuant to Section 12 of the agreement for administration of the BID. Ordinance No. 2526 is on file in the Office of the City Clerk. REGULAR CALENDAR: REPORTS & COMMUNICATIONS OF DEPARTMENT BOARDS, COMMISSIONS AND COMMITTEES 9A. Appointment of the City Attorney of the Cid of Redding [A-050-050] City Manager Starman summarized the Report to Redding City Council (staff report), incorporated herein by reference, and relayed the City Council's recommendation to appoint Barry E. DeWalt as the City Attorney of the City of Redding and authorize the Mayor to execute the Employment Agreement, incorporated herein by reference. A discussion amongst the Council ensued. The City Council and staff thanked outgoing Interim City Attorney Wingate for his legal assistance during this interim period. A MOTION WAS MADE by Council Member McArthur, seconded by Council Member Cadd, to: (1) appoint Barry E. DeWalt as the City Attorney of the City of Redding; and (2) authorize the Mayor to execute the Employment Agreement. The Vote: Unanimous Ayes. 9.11(b).Ordinance - Storm Water Quality Management and Discharge Control [C -110 -100/W -030/A-170-100] Public Works Director Crane summarized the Report to Redding City Council (staff report), provided a PowerPoint presentation, both incorporated herein by reference, and recommended that the City Council offer an ordinance amending Redding Municipal Code, Title 14 (Utilities), by adding a new Chapter 14.19, (Storm Water Quality Management and Discharge Control), to address the requirements of the City's Municipal Separate Storm Sewer System (MS4) permit issued by the State Water Resources Control Board, for first reading by title only and waive the full reading; and authorize the City Clerk to publish a Summary Ordinance. A discussion amongst the Council ensued. 05/05/2015 234 A MOTION WAS MADE by Council Member Schreder, seconded by Council Member McArthur, to: (1) introduce for first reading by title only and waive the full reading of Ordinance No. 2527, an ordinance of the City Council of the City of Redding amending Redding Municipal Code, Title 14 (Utilities), by adding Chapter 14.19, (Storm Water Quality Management and Discharge Control), to address the requirements of the City's Municipal Separate Storm Sewer System (MS4) permit issued by the State Water Resources Control Board; and (2) authorize the City Clerk to publish a Summary Ordinance. PUBLIC COMMENT [A-050-060] Bob Braz opined that the homeless and transient population has taken over the Parkview Riverfront Park and proposed converting it into a dog park for use by the community. [C -110-100/A-050-250-074] Patricia Townsley spoke in opposition to the City's implementation of a sit -lie ordinance, and opined that not all homeless are the same, some have real medical and mental health needs, and some just need jobs. [A-050-060] Charles W. Alexander opposed Revive Redding's facebook page that only allows a "share" option, not the "like, comment or share" option. [A -050-060/A-050-250-074] Tom Hildebrand spoke in opposition to the transient issues within the community. TRAVEL REPORTS City Council Member attendance at conference/meetings reimbursed at City expense {Requirement of Assembly Bill 12341 [W -030-075/S-050] Mayor Sullivan attended a meeting with California Governor Jerry Brown on April 28, 2015, in Sacramento, California, to discuss the drought issues in California. [E-120-400] Mayor Sullivan attended a Northern California Power Agency Commission meeting on April 23, 2015, in Roseville, California. POTENTIAL TOPICS FOR FUTURE CITY COUNCIL MEETINGS [A-050-060] At Council Member Weaver's suggestion, a consensus of the Council directed staff to place an item on a future agenda to discuss ideas to abate abandoned shopping carts throughout the community. [A-050-060] At Council Member McArthur's suggestion, a consensus of the Council agreed to discuss the possibility of creating a community partnership to install a zipline in the Palisades Avenue area and referred the matter to the Community Services Advisory Commission to explore the feasibility. CLOSED SESSION At the hour of 9:03 p.m., Mayor Sullivan announced that the Council would adjourn to Closed Session. At the hour of 9:35 p.m., Mayor Sullivan reconvened the Regular Meeting to Open Session and reported that in reference to: 05/05/2015 235 13A.
