A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING
AMENDING THE MEMORANDUM OF UNDERSTANDING BETWEEN THE
CITY OF REDDING AND THE INTERNATIONAL BROTHERHOOD OF
ELECTRICAL WORKERS — MAINTENANCE EMPLOYEES RELATIVE TO
UNIFORMS
WHEREAS, International Brotherhood of Electrical Workers — Maintenance Employees has
been recognized as the majority representative of an appropriate unit of employees; and
WHEREAS, the designated representatives of the City of Redding have conferred with and
entered into a Memorandum of Understanding with the designated representatives of International
Brotherhood of Electrical Workers — Maintenance Employees, where wages, hours, and terms and
conditions of employment were set and approved by City Council effective February 2, 2016, as required
by the provisions of the Meyers-Milias-Brown Act of 1968; and
WHEREAS, California Code of Regulations (CCR) §571 defines special compensation. The
monetary value for the purchase and maintenance of required clothing is defined as special compensation,
and is required to be reported to California Public Employees' Retirement System (CaIPERS) for eligible
Classic members; and
WHEREAS, California Code of Regulations (CCR) §571 further specifies the special
compensation be contained in a written labor policy or agreement and duly approved and adopted by the
City of Redding's governing body. By amending the Memorandum of Understanding between the City of
Redding and International Brotherhood of Electrical Workers — Maintenance Employees to include the
monetary value of uniforms, the City of Redding will be in compliance with California Code of
Regulations (CCR) §571; and
WHEREAS, the City of Redding and International Brotherhood of Electrical Workers —
Maintenance Employees met, and agreed to and approved the amendment to the Memorandum of
Understanding to comply with California Code of Regulations (CCR) §571 and report the monetary value
of required clothing to Ca1PERS for the CaIPERS Classic employees as follows:
Article 20: Miscellaneous, Section 20.7 (c)
20.7(c) Ten (10) shirts with City emblem for all employees except those employees who don't have
other clothing provided. Five (5) shirts shall be lightweight for summertime use and five (5) shall be
heavy long-sleeved shirts for winter use. Laundering will be provided by the employee. Employees
for whom the City supplies shirts shall be required to wear them while on duty. Effective July 1,
2011, the City will report to Ca1PERS the monetary value for providing employees with the required
uniforms on a per pay period basis. The uniform allowance amount reported to CaIPERS will be
derived from the City's total fiscal year budgeted amount for providing the uniform, not to exceed
$250.00 per employee per year, divided by 26 pay periods.
WHEREAS, the City Council deems it to be in the best interest of the City to adopt such
recommendation;
NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council that the City
shall approve the amendment to the Memorandum of Understanding between the City of Redding
and International Brotherhood of Electrical Workers — Maintenance employees to reflect the
statutory requirement of California Code of Regulations (CCR) 571to report the monetary value of
required uniforms to Ca1PERS effective July 1, 2011.
I HEREBY CERTIFY that the foregoing resolution was introduced and read at a regular
meeting of the City Council of the City of Redding on the 1st day of November, 2016, and was
duly adopted at said meeting by the following vote:
