HomeMy WebLinkAboutReso 2016-059 - Measure D and Measure ERESOLUTION NO. 2016-059 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING ADOPTING POLICIES AND PROCEDURES FOR IMPLEMENTING THE TRANSACTIONS AND USE TAX SHOULD MEASURE D AND MEASURE E BE APPROVED BY A MAJORITY OF REDDING VOTERS IN THE NOVEMBER 8, 2016, ELECTION WHEREAS, the City Council ("Council") of the City of Redding ("City") adopted a resolution on May 3, 2016, to place a transactions and use tax measure ("Measure D") and an accompanying advisory measure ("Measure E") on the November 8, 2016, ballot; and WHEREAS, the Council also determined that it desired to implement certain checks and balances in the event Measure D and Measure E are approved by Redding voters; and WHEREAS, Measure D, if approved by a simple majority of the electorate, would impose a transactions and use tax of one-half cent on the sale of all tangible personal property sold at retail in the City for a period of ten years ("Sales Tax"); and WHEREAS, the proposed Sales Tax is a general tax, the revenue of which will be placed in the City's general fund and will be used to pay for essential City services; and WHEREAS, the Council desires to establish a separate account for any proceeds from Measure D for accounting and auditing purposes; and WHEREAS, the Council desires to create a Citizens Committee to assist the Council with the implementation of Measure D and Measure E; and WHEREAS, the Council desires to form a new City implementation team consisting of Council Member Brent Weaver, the City Manager, and the Police Chief to oversee the implementation of Measure D and Measure E; and WHEREAS, the Council desires to execute a contract with the County of Shasta with specific performance measures in order to ensure accountability for any funds disbursed to the County of Shasta from proceeds generated by the proposed Sales Tax; and WHEREAS, the Council desires to ensure proper oversight, transparency, and accountability of any proceeds from Measure D by requiring City staff to: (1) prepare a revenue/expense report at least annually, and (2) provide reminders to the Council during priority -setting meetings and budget meetings regarding the status of the ten-year sunset provision of Measure D. NOW, THEREFORE, be it resolved by the Council of the City of Redding as follows: Section 1. The foregoing recitals are true and correct, and this Council so finds and determines. G 1 O 1 tA Section 2. In the event Measure D and Measure E are approved by a majority of Redding voters, the Council hereby directs City staff to establish a separate account in which all general tax proceeds collected pursuant to Measure D shall be placed to be used for accounting and auditing purposes. Section 3. In the event Measure D and Measure E are approved by a majority of Redding voters, the Council hereby directs City staff to prepare a revenue/expense report of all general tax proceeds collected pursuant to Measure D at least annually to ensure proper oversight, transparency, and accountability. Section 4. In the event Measure D and Measure E are approved by a majority of Redding voters, the Council hereby directs City staff to draft a contract for services with the County of Shasta with specific performance measures in order to ensure accountability of all general tax proceeds collected pursuant to Measure D. Section 5. In the event Measure D and Measure E are approved by a majority of Redding voters, the Council hereby directs the formation of a new City implementation team consisting of Council Member Brent Weaver, the City Manager, and the Police Chief to oversee the implementation of Measure D and Measure E. Section 6. In the event Measure D and Measure E are approved by a majority of Redding voters, the Council hereby directs that a Citizens Committee shall be established to assist the City Council with the implementation of Measure D and Measure E. The specifics and parameters of the Citizens Committee, including the process for selecting members and scope of duties, shall be determined by further Resolution at a City Council meeting subsequent to the election on November 8, 2016. Section 7. This Resolution shall take effect on the date of certification of results of the election on November 8, 2016, and only if a simple majority of the Redding electorate approve Measure D and Measure E.
