HomeMy WebLinkAboutReso 2016-043 - Kent ManuelRESOLUTION NO. 2016-043 April 19, 2016 RESOLUTION FOR EXCEPTION TO THE 180 -DAY WAIT PERIOD GC sections 7522.56 & 21224 WHEREAS, in compliance with Government Code section 7522.56 the Redding City Council must provide Ca1PERS this certification resolution when hiring a retiree before 180 days has passed since his or her retirement date; and WHEREAS, Kent Manuel, CID 6715416294, retired from the City of Redding in the position of Planning Manager, effective April 15, 2016; and WHEREAS, section 7522.56 requires that post-retirement employment commence no earlier than 180 days after the retirement date, which is October 13, 2016, without this certification resolution; and WHEREAS, section 7522.56 provides that this exception to the 180 -day wait period shall not apply if the retiree accepts any retirement -related incentive; and WHEREAS, the Redding City Council, the City of Redding and Kent Manuel certify that Kent Manuel has not and will not receive a Golden Handshake or any other retirement - related incentive; and WHEREAS, the Redding City Council hereby appoints Kent Manuel as an extra help retired annuitant to perform certain duties of the Planning Manager for the City of Redding under Government Code section 21224, effective April 24, 2016; and WHEREAS, the entire employment agreement, contract or appointment document between Kent Manuel and the City of Redding has been reviewed by this body and is attached herein; and WHEREAS, no matters, issues, terms or conditions related to this employment and appointment have been or will be placed on a consent calendar; and 1v WHEREAS, the employment shall be limited to 960 hours per fiscal year; and WHEREAS, the compensation paid to retirees cannot be less than the minimum nor exceed the maximum monthly base salary paid to other employees performing comparable duties, divided by 173.333 to equal the hourly rate; and w WHEREAS, the maximum base salary for this position is $9,753 and the hourly equivalent is $56.27, and the minimum base salary for this position is $6,170 and the hourly equivalent is $35.60; and WHEREAS, the hourly rate paid to Kent Manuel will be $56.27; and WHEREAS, Kent Manuel has not and will not receive any other benefit, incentive, compensation in lieu of benefit or other form of compensation in addition to this hourly pay rate; THEREFORE, BE IT RESOLVED THAT the Redding City Council hereby certifies the nature of the appointment of Kent Manuel as described herein and detailed in the attached employment agreement/contract/appointment document and that this appointment is necessary to fill a critically needed role of Planning Manager for the City of Redding only to assist with special project work for the Development Services Department. Mr. Manuel will be working on the special project of assisting with the potential site relocation of retailer Costco Wholesale from its current Dana Drive location to another suitable location within the City of Redding city limits. With 30 years of direct experience in community development, Mr. Manuel has a unique understanding of the City's land use regulations and permitting process. The project will require significant coordination between multiple departments of the City of Redding and outside regulatory agencies of the State and Federal government. Mr. Manuel will also assist with updating the Parks Master Plan, to include complete long range planning, Parks inventory, policy updates, delineating new trails, planning for open spaces, and updating GIS mapping. Although Mr. Manuel will be assigned the title of Planning Manager, he will not be assuming all of the roles and responsibilities of that position. The full time position of Planning Manager was filled by an incumbent on April 4, 2016.
