AN ORDINANCE OF THE CITY OF REDDING AMENDING TITLE 18
(ZONING), CHAPTER 18.17 (TEMPORARY USE PERMITS), BY AMENDING
SECTION 18.17.060; CHAPTER 18.24 (ENVIRONMENTAL CLEARANCE) BY
AMENDING SECTION 18.24.050; CHAPTER 18.34 (INDUSTRIAL
DISTRICTS) BY AMENDING SCHEDULE 18.34.020-A; CHAPTER 18.41 (OFF-
STREET PARKING AND LOADING) BY AMENDING SECTIONS 18.41.030;
AND CHAPTER 18.60 (USE CLASSIFICATIONS) BY AMENDING SECTIONS
18.60.040 AND 18.60.050 ALL RELATING TO CLEAN-UP AND UPDATING
OF THE ZONING CODE
WHEREAS, the Planning Commission held a duly noticed public hearing on October
27, 2015, whereby it considered the amendments to the Redding Municipal Code Title 18
(hereafter "Zoning Code") set forth herein and recommended that the City Council adopt the
proposed amendments and the resulting addendum to the mitigated negative declaration adopted
for the Zoning Code; and
WHEREAS, the City Council held a duly noticed public hearing on this date, prior to the
first reading of this ordinance; and
WHEREAS, the Addendum to the Mitigated Negative Declaration (attached to the staff
report) prepared for the amendments to Redding Municipal Code Title 18 is appropriate, since
there is no substantial evidence, in light of the whole record before the City of Redding, that the
proposed amendments will have a significant effect on the environment.
NOW, THEREFORE, BE IT RESOLVED THAT THE CITY COUNCIL OF THE
CITY OF REDDING DOES ORDAIN AS FOLLOWS:
Section 1. Title 18 (Zoning), Chapter 18.17 (Temporary Use Permits), Section 18.17.060
is hereby amended to read as follows:
Section 18.17.060 —Approval.
A. [No change to subsection A.]
B. The Director may provide notice of an application to surrounding property owners for
comment on the application prior to making a determination to approve or deny the (�
application, or may refer an application to the Board of Administrative Review for action
on a temporary use permit request where a determination is made that the proposed use
may be of particular interest or concern to surrounding property owners or to the public at
large.
Section 1 Title 18 (Zoning), Chapter 18.24 (Environmental Clearance), Section
18.24.050 is hereby amended to read as follows:
Section 18.24.050 — Projects Exempt From State CEQA Guidelines.
A. Ministerial Projects. Projects determined to be ministerial, as defined in Section 15268 of
the State CEQA Guidelines, are exempt from CEQA. A list of activities determined to be
ministerial projects by the City of Redding has been adopted by resolution of the City
Council and includes:

7. Issuance of demolition permits that do not involve structures of historical significance.
For purposes of this section, properties listed on the Local Register of Candidate
Historic Properties are not considered historically significant unless sufficient
information/evidence is presented to the Director to establish a reasonable probability
of historical significance within the context of Council Policy 1808 pertaining to
Buildings Associated with Historic Events or Persons, Buildings Associated with
Historic Architecture or Historic Period, and/or Buildings or Places of Historic
Community Significance.

Section 4. Title 18 (Zoning), Chapter 18.41 (Off -Street Parking and Loading), Section
18.41.030 is hereby amended to read as follows:
Section 18.41.030 — General Provisions.
A — K. [No changes to subsections A through K.]
L. Exception for Downtown Central Business District, Mixed -Use Projects, and Historical
and/or Architecturally Significant Districts.
1— 2. [No Changes to subsections L.1 and L.2.]
3. In order to preserve the unique historical and/or architectural character of
certain areas of the City, the off-street parking requirements listed in Section
18.41.040 shall not apply in the following circumstances and geographical
areas:
a. The conversion/use of existing structures on the west side of Oregon
Street between Shasta Street and Yuba Street, and on the west side of
Pine Street between Eureka Way and Trinity Street, to uses allowed by
right or by discretionary permit by the base zoning district. Such
exclusion shall not apply to enlargements of buildings exceeding 20
percent of the existing floor area in which case off-street parking shall be
provided for the entire building in accordance with Chapter 18.41.

Section 5. Title 18 (Zoning), Chapter 18.60 (Use Classifications), Sections 18.60.040 and
18.60.050 are hereby amended to read as follows:
Section 18.60.040 — Commercial Use Classifications.
A — K. [No changes to subsections A through K.]
L. Food and Beverage Preparation. Businesses preparing and/or packaging food and
beverages for off-site consumption, excluding those of an industrial character in
terms of processes employed, waste produced, water used and traffic generation.
Uses include catering kitchens, bakeries with on-site retail sales and small-scale
specialty food and beverage production, such as manufacture of candy, jams and
jellies, beer, wine, and spirits.
M — Z. [No changes to subsections M through Z.]
Section 18.60.050 — Industrial Use Classifications.
A — C. [No changes to subsections A through C.]
D. Industry, General. Establishments engaged in any of the following types of
activities taking place within enclosed buildings: manufacturing finished parts or
products primarily from previously prepared materials; food and beverage
manufacturing/distribution; providing industrial services; or conducting industrial or
scientific research, including product testing. Ancillary activities customarily associated
with these uses such as industry related training or conferences, marketing events, and
similar activities are also appropriate. This classification excludes basic industrial
processing and recycling of cans, bottles, cardboard and similar consumer materials.
E — G. [No changes to subsections E through G.]
Section 6. Severability. If any section, subsection, sentence, clause or phrase of this
Ordinance is for any reason held by a court of competent jurisdiction to be invalid or
unconstitutional, such decision shall not affect the validity of the remaining portions of the
ordinance. The City Council of the City of Redding hereby declares that it would have passed
this ordinance and each section, subsection, sentence, clause and phrase thereof irrespective of
the fact that one or more sections, subsections, sentences, clauses or phrases may be held invalid
or unconstitutional.
Section 7. The City Council hereby adopts the Addendum dated October 22, 2015, to the
Mitigated Negative Declaration dated October 1, 2002, based on the information and findings set
forth in the staff report and the Addendum to the Mitigated Negative Declaration.
Section 8. This ordinance shall take effect thirty (30) days after the date of its
adoption, and the City Clerk shall certify to the adoption thereof and cause its publication
according to law.
I HEREBY CERTIFY that the foregoing ordinance was introduced and read by the City
Council of the City of Redding at a regular meeting on the 19`h day of January, 2016, and was
duly read and adopted at a regular meeting on the 16th day of February, 2016, by the following
