The portion being considered for summary vacation was acquired by dedication with the recording of the Redding Airport Business Park Subdivision in 1994. B. This portion of the street right-of-way has not been used for the purpose for which it was dedicated or acquired. Therefore, the owners of the property has asked that the City vacate this portion of the street right-of-way, described in Exhibit "A" and shown hatched on Exhibit "B" attached and made a part hereof by reference. C. The City is RETAINING a public-service easement over the portion of right-of-way described in Exhibit "A" and shown hatched on Exhibit "B." D. The street closure falls within the criteria of CEQA Section 15305 and is categorically exempt. NOW, THEREFORE, THE CITY COUNCIL DETERMINES, RESOLVES, AND ORDERS AS FOLLOWS: 1. The City Council elects to proceed in this matter under the provisions of the California Streets and Highways Code, Section 8333. 2. The City Council approves the request to summarily vacate the portion of the right-of-way described in Exhibit "A" and shown hatched on Exhibit "B." 3. This portion of street right-of-way has not been used for the purpose for which it was dedicated or acquired for five consecutive years immediately preceding this vacation. V1 4. This proposed vacation would not result in any significant environmental impacts and falls within the criteria of a CEQA Section 15305 and is categorically exempt. 5. The City reserves and excepts from the vacation a public-service easement for the purpose of erecting, installing, constructing, removing, repairing, replacing, reconstructing, maintaining and using for public-service purposes any and all materials, fixtures, appliances, equipment, pipes pipelines, wires, and cables (including fiber optics) necessary for the transmission , distribution, and delivery of electricity, water, sewer, storm water, gas, cable television, communication, and information service utilities over, along, upon, under, and across the parcel of real property described in Exhibit "A" and shown hatched on Exhibit "B." 6. The City Clerk is directed to cause a certified copy of this resolution of vacation, attested by the Clerk under seal, to be recorded in the office of the Shasta County Assessor/Recorder. De T, City Attorney EXHIBIT "A" RIGHT OF WAY & PUBLIC SERVICE EASEMENT VACATION All that certain real property situate in the Southeast one-quarter of Section 27, Township 31 North, Range 4 West, M.D.M. in the City of Redding, County of Shasta, State of California, described as follows: All that portion of Fairlane Drive and the adjacent 5.00 foot Public Service Easements as shown on that certain map of Redding Airport Business Park Subdivision No. S-2-92 recorded in Book 21 of Maps at Page 42, Shasta County Records, and the adjacent 5.00 foot Public Service Easement reserved in that portion of Fairlane Drive vacated per Document 2003-0018888 Shasta County Records, described as follows: COMMENCING at the Southeast corner of Lot 16 as shown on said map; thence from said POINT OF COMMENCEMENT along the East line of said Lot 16 North 0'39'15" East, 175.00 feet to the TRUE POINT OF BEGINNING; thence from said TRUE POINT OF BEGINNING northwesterly along the East and North lines of said Lot 16 along a tangent curve concave southwesterly having a radius of 25.00 feet, through a central angle of 89°58'54", an arc distance of 39.26 feet; thence along the North line of said Lot 16 North 89°19'39" West, 7.00 feet to the Southeast corner of said vacated Fairlane Drive; thence along the East line of said vacated Fairlane Drive North 0'39'15" East, 64.00 feet to the Northeast coiner of said vacated Fairlane Drive; thence along the easterly prolongation of said vacated Fairlane Drive South 89°19'39" East, 31.99 feet to the northerly prolongation of the East line of 'said Lot 16; thence along said northerly prolongation South 0'39'15" West, 88.9 feet to the TRUE POINT OF BEGINNING.
