On June 2, 2015, by Resolution 2015-044, the City Council (Council) approved the Reports of the Engineer as filed with the City Clerk relating to the Landscape Maintenance Districts outlined in the table below and gave notice of the time and place of the July 21, 2015, public hearing regarding the levy and collection of assessments for Fiscal Year 2015-16. B. A general location of each District is included in the table below, and maps of these Districts are attached to the Engineer's Reports on file with the City Clerk. C. The public hearing, duly and properly noticed, commenced at the City Council Chambers, 777 Cypress Avenue, Redding, California on July 21, 2015, and was concluded prior to the adoption of this resolution. At the public hearing, the Council gave every interested person an opportunity to object to the proposed assessments. D. The assessments for Fiscal Year 2015-16 are outlined in the table below. These assessments do not represent an increase within the meaning of the Streets and Highways Code sections 22624 and 22630.5, because the Fiscal Year 2015-16 cost of living adjustment in the amount of 2.8 percent is pursuant to a methodology approved at the time of the formation of the District. E. All legal prerequisites to the adoption of this resolution have occurred. THEREFORE THE CITY COUNCIL FINDS, RESOLVES, DETERMINES, AND ORDERS AS FOLLOWS: 1. The matters set forth above are true and correct. 1 2. The maps of the assessment districts contained in the Engineer's Reports are confirmed. Cr 3. The Council has considered all oral statements and written protests or communications V1 made or filed by interested persons at the public hearing of July 21, 2015, and expressly I overrules any and all protests filed objecting to the proposed annual assessments and levy amounts in the Districts. - fi 4. The- Council I finds that the ;Engineer's Reports have fairly and properly apportioned the: costs of tho,improvements to each developable lot, re m-aining. parcel, or assessable acre, of Iand, in the. districts in proportion 'to the -estimated benefits to be received by each, developable lot, remaining parcel, or assessable acre from, the improvements. 5. The assessments against each developable lot, remaining parcel, or assessable acre located, within the'Distficts for Fiscal. Year 2015-16 are confirmed, ad opted, and'Ievied -as .outlined in the table below, except, that an,assessment.'shall not -'he levied -on -property 'owned by, a federal Of state, governmental agency or another local agency,.
