HomeMy WebLinkAboutOrdinance - 2526 - Amend Title 6• ORDINANCE NO. 2526 9 AN ORDINANCE OF THE CITY OF REDDING REPEALING TITLE 6 (BUSINESS TAXES, LICENSES, AND REGULATIONS), CHAPTER 6.39 (DOWNTOWN REDDING BUSINESS IMPROVEMENT DISTRICT), OF THE REDDING MUNICIPAL CODE RELATING TO THE DISESTABLISHMENT OF THE DOWNTOWN REDDING BUSINESS IMPROVEMENT DISTRICT NOW, THEREFORE, BE IT RESOLVED THAT THE CITY COUNCIL OF THE CITY OF REDDING DOES ORDAIN AS FOLLOWS: Section 1. Title 6, Chapter 6.39 of the Redding Municipal Code is hereby repealed in its entirety. Section 2. Pursuant to Streets and Highways Code § 36550(a), the Downtown Redding Business Improvement District ("DRBID") is disestablished. Resolution 2015-020, which ordered the annual levy of assessments for the DRBID for fiscal year 2015-2016, is rescinded and shall have no further force or effect. Section 3. Pursuant to Streets and Highways Code § 36551(b), all remaining revenues derived from the levy of assessments after payment of any encumbrances required by law, or any revenues derived from the sale of assets acquired with the revenues, shall be refunded to the owners of the businesses then located within the area in which assessments were levied by applying the same method and basis that was used to calculate the assessments levied for fiscal year 2014-2015. The Downtown Redding Business Association shall deliver all funds subject to refund to those assessed under Street and Highways Code § 36551(b) to the City of Redding Director of Finance no later than 5:00 p.m. on June 18, 2015. Section 4. The passage of this ordinance is not a "project" according to the definition in the California Environmental Quality Act, and therefore is not subject to the provisions requiring environmental review. Section 5.
