HomeMy WebLinkAboutOrdinance - 2515 - Amend Title 18 ORDINANCE NO. 2515 AN ORDINANCE OF THE CITY OF REDDING ADOPTING AN ADDENDUM TO THE MITIGATED NEGATIVE DECLARATION PREPARED FOR THE CITY OF REDDING ZONING TEXT AND AMENDING TITLE 18 (ZONING), CHAPTER 18.17 (TEMPORARY USE PERMITS), BY AMENDING SECTION 18.17.030; CHAPTER 18.40 (DEVELOPMENT AND SITE REGULATIONS) BY AMENDING SECTION 18.40.180; AND CHAPTER 18.41 (OFF-STREET PARKING AND LOADING) BY AMENDING SECTIONS 18.41.040 AND 18.41.170 (RZ-2014-00851) WHEREAS, the Planning Commission held a duly noticed public hearing pertaining to the attached amendments to portions of Redding Municipal Code Title 18, Zoning Ordinance, on October 14, 2014, and recommended that the City Council adopt said Addendum and amendments. WHEREAS, the City Council held a duly noticed public hearing on this date, prior to the first reading of this ordinance. WHEREAS, the Addendum to the Mitigated Negative Declaration (attached to the staff report) prepared for the amendments to Redding Municipal Code Title 18 is appropriate, since there is no substantial evidence, in light of the whole record before the City of Redding, that the proposed amendments will have a significant effect on the environment. NOW, THEREFORE, BE IT RESOLVED THAT THE CITY COUNCIL OF THE CITY OF REDDING DOES ORDAIN AS FOLLOWS: Section 1. The City Council hereby adopts the Addendum to the Mitigated Negative Declaration prepared for the attached amendments to portions of Redding Municipal Code Title 18, Zoning Ordinance. Section 2. Title 18 (Zoning), Chapter 18.17 (Temporary Use Permits), Section 18.17.030 is hereby amended to read as follows: 18.17.030 Temporary Uses Requiring Permits The following temporary uses may be allowed on commercially zoned properties, or as otherwise noted below, subject to the issuance of a temporary use permit. Uses that do not fall within the categories defined below shall comply with the use and development regulations and entitlement review provisions that otherwise apply to the property. A temporary use permit will not be issued for a use that is not permitted within the zoning district for the site on which the use is proposed. A: [No changes to subsections A and B] Ul .. 1 •Z: C. Community Gardens. Non-commercial community gardens within any zoning district. D. [Renumbered only. No change to text] E. [Renumbered only. No change to text] Section 3. Title 18 (Zoning), Chapter 18.40 (Development and Site Regulations), Section 18.40.180 is hereby amended to read as follows: 18.40.180 Walls and Fences A. Residential Districts. 1. Height. Fences or walls in required front-yard setbacks or within 10 feet of the property line in a required street-side setback shall not exceed 3 feet. All other fences shall not exceed 6 feet in height, except for along any interior side- or rear-yard not fronting on a public right-of-way, in which case the fence shall not exceed 7 feet in height with any attachments to the fence designed to be of similar/compatible architecture and materials as the fence to which it is attached. However, legal, nonconforming fences may be repaired or replaced. Fence or wall heights between sloped lots are measured from the grade of the "uphill" side of the fence as shown. Walls and fences required by a site development permit, parcel map, or subdivision may exceed the maximum height limits and minimum setbacks of the zoning district as required by the conditions of approval for the project. 2. Title 18 (Zoning), Chapter 18.41 (Off-Street Parking and Loading), Section 18.41.040 and Schedule 18.41.170-A are hereby amended to read as follows: 18.41.040-A: Parking Spaces Required [Note: Only the portion of the schedule pertaining to bicycle parking is amended by the Ordinance. The remainder of the schedule remains unchanged.] A. Bicycle Parking. Projects must comply with,the short-term and long-term bicycle parking requirements, as applicable, of Section 5.106.4 of the California Green Building Standards Code. B. [No changes to subsections B through D] 18.41.170 Access Requirements for the Disabled A. [No changes to subsections A through C] D. One in every 8 accessible spaces, but not less than one, shall be "van-accessible," consisting of a 12-foot-wide parking space and a 5-foot-wide access aisle, or alternatively, a 9-foot-wide parking space, together with an 8-foot-wide access aisle, in accordance with the accessibility requirements of the California Building Code. Where single spaces are provided in addition to the van-accessible space, they shall be 14 feet wide and outlined to provide a 9-foot-wide parking area and a 5-foot-wide loading and unloading area on the passenger side of the vehicle. When more than one space is provided, 2 spaces can be provided within a 23-foot- wide area lined to provide a 9-foot-wide parking area on each site of a 5-foot-wide loading and unloading aisle in the center. The minimum length of each parking space shall be in accordance with Section 18.41.070, not to be less than 18 feet. E. [No changes to subsections E and F] Section 5. This ordinance shall take effect 30 days after the date of its adoption, and the City Clerk shall certify to the adoption thereof and cause its publication according to law.
